18.03.2023     CP & Ex CS AIBSNLEA Karnataka Com . R.Ganesh Reports on the 8th Karnataka Circle Conference ....

The 8th AIBSNLEA KARNATAKA CIRCLE Conference was held on 11th and 12th of March 2023 in a jubilant manner at ZTTC, Mysuru. From CHQ, the General Secretary, President and Finance Secretary  attended the conference.

The meeting started by hoisting of National Flag and Association Flag and slogans of Unity and BSNL Zindabad & AIBSNLEA Zindabad. On 11th March 2023, Pre-CEC meeting was held in the presence of all the CHQ leaders. The delegates from all over the circle attended. Com.B.S.Sunil Kumar, Circle President welcomed all the CHQ leaders, delegates, veteran leaders to the said Pre-CEC Meeting. Sri.R.Ganesh, Circle Secretary, presented his Report from Feb.2021 to Feb.2023. Smt.S.Vanitha, Finance Secretary presented the Audited Statement of Accounts. Both the Reports were adopted and approved by the House.

Com.Raj Pal, CHQ President elaborately informed the House about the efforts being made by AIBSNLEA about various HR issues. He highlighted about the pending court cases especially regarding AO to CAO promotion, DGM promotion etc.

Com.V.Shaji, General Secretary, narrated about the relationship AIBSNLEA is having with the BSNL Management. He explained in detail about the pending issues. The light was thrown on PA/PS Cadre issues, need for the AIBSNLEA to become MA. He also expressed happiness about the legacy that AIBSNLEA possesses in resolving the HR issues. He recalled that due to consistent efforts made by AIBSNLEA promotions could be effected in Electrical Stream of recent. He did not forget to highlight that around 18000 Executives were got promotion in all streams owing to the persuasive approach of AIBSNLEA during 2018.

From 1500 hrs, Open Session was arranged. Sri.Shivakumar, Mayor, Mysore City Corporation, Sri.L.Nagendra, Member of Legislative Assembly, Govt. of Karnataka, Sri.G.R.Ravi, CGMT, KTK Circle, Sri.Rajkumar, PGMT, Mysore BA, GM (L& B), CO, BG, Sri.Sheshadri, Dy.General Secretary and Circle Secretary, NFTE-BSNL, Sri.Jagadale, Circle Secretary, SNEA, KTK Circle, Com.B.T.Ramachandra, SEWA-BSNL, Sri.K.Puttaswamy, BSNLEU and representatives from Retired Associations were also present.

Sri.Shivakumar, Mayor, MCC, Mysore highlighted about the performance of BSNL in the present competitive world. He recalled that Corporation was always co-operating with BSNL in respect of trenching and laying of OF cable in Mysore City. He assured full support and co-operation for BSNL.

Sri.L.Nagendra, MLA, Govt. of Karnataka appreciated the role of BSNL in rural services and at the time of National disaster. He informed the House that Govt. of India has allotted 1800-2000 lands to BSNL for offering optic connectivity under Bharath Udayami Project. As a part of Atmanirbharatha, the present Government is striving hard to revive BSNL and offered two packages. He explained the role of Prime Minister and his dream to get the BSNL back to its pristine glory by rendering financial support.

Sri.Sheshdari, Dy.GS & Circle Secretary, NFTE-BSNL explained in detail about the absorption process took place and also about insertion of 37-A into CCS Pension Rules. He explained the position of Pension Revision, Pay Revision by way of 3rd PRC and in unequivocal terms informed the House that the Government has agreed to delink Pension Revision with Pay Revision. He also recalled the activities taken through AUAB. Finally, he thanked AIBSNLEA for givin him an opportunity to address the House.

Sri.Jagadale, Circle Secretary, SNEA, KTK Circle, informed that during Covid-19, the Executives were forced to maintain the telecom services by spending from their own pocket. He also highlighted the robust transmission network. He narrated about the forthcoming mass executive transfer both inter and intra circle.

Sri.G.R.Ravi, CGMT, Karnataka Circle also spoke at length and narrated about the position of Karnataka Circle in the provision of FTTH connections and also Govt projects. He informed that all out efforts are being made to complete the project in a time bound manner. He also appreciated the active role being played by all the officers/officials in achieving the targets set by BSNL Corporate Office.

Sri.Rajkumar, PGMT, Mysore BA about the steps taken by BSNL to improve the financial position. He called upon all the executives to work in unity for the better performance of BSNL.

Sri.V.Shaji, General Secretary, AIBSNLEA touched upon the financial parameters of BSNL and also various revival packages announced by Government. GS eloborately naratted all the Service / HR issues of BSNL and its executives . GS also expressed the need for unification of Associations in order to extract out all the deprived benefits of executives including 3rd PRC  from BSNL/DOT. Neither MA nor SA could extract any of the pending issues of BSNL executives   indicates the fact that unifications of association is the want of the time for the benefits of BSNL & its executives .

Finally, the Open House Session concluded with vote of thanks by Sri.Ullas.V.Gurav, Finance Advisor, AIBSNLEA KTK Circle.

Thereafter, the delegate session continued. The present HR issues were discussed at length. GS AIBSNLEA CHQ updated house about different HR issues, its persuasion by AIBSNLEA and overall growth of BSNL. He satisfactorily replied all the queries and doubts raised the delegates present in the house. The CHQ President was nominated as a Presiding Officer for election of office bearers. Finally, the following office bearers of AIBSNLEA KARNATAKA CIRCLE were elected unanimously for the next term of 03 years.

CS Odisha Com Prasanth Kumar Rout reports that CS and team met DIR HR BSNL Board Shri . Arvind Vadnerkar during the visit of DIR HR to Odisha and submitted representation on the pending HR matters .

17.03.2023     GS , CHQ President and Dy GS had a meeting with the GM (Pers) on 16.03.2023  and discussed all the pending HR matters pertaining to the executives of BSNL. At the outset AIBSNLEA expressed our sincere thanks and gratitude to GM(Pers) in considering all our genuine requests for transfer and posting. GM(Pers) reciprocate welcome note.

Pending SDE T to AGM(T) Promotions for all SDEs up to List 13 :

AIBSNLEA requested to release all the pending promotions against available & the projected vacancies for AGM T so that all the 3053 qualified SDEs up to list 13 can be promoted .

Total SDEs waiting for AGM 3053 : (List – 9 (206 ) , List - 10(112) , List – 11 (584) ,List - 12 (1769) ,List - 13 (382)) .

Total Working strength of AGM(T) : 3269
Sanctioned Strength of AGM(T): 4500 (4050 SQ+LICE & 450 SETs DRs & MTs) ;

AIBSNLEA submitted that there is no financial burden for BSNL in promoting these young and Dynamic executives to the post of AGM T . These promotions will certainly improve the working efficiency of the Telecom Operation Stream due to officers motivated on promotion.

GM ( Pers) had a very patient listening to all our submissions and mentioned that the matter of promoting all eligible SDEs may be taken up with higher levels for positive solutions . AIBSNLEA responded that we are working on it with higher levels too for a positive outcome and further requested PGM ( Pers) to release AGM T promotions for the available @700 vacancies , firstly. It is informed that management is on the job for releasing the LICE and SQ promotions to AGMT for the available vacancies .

AO to CAO Promotion Status Quo case and Pending Promotions in Accounts Cadre :

AIBSNLEA requested GM(pers) that BSNL management may think on granting Adhoc promotions from AO to CAO & to other cadres too till the finality of court cases on the following grounds.

The Hon’ble CAT Chandigarh verdict on 25th February 2020, in Shri. Prakash Vir (OA 60/332/2017) case against JAO to AO promotions praying for Catch Up Rule and in Shri. Ramesh Kumar (OA 60/750/2018) case against SDE to AGM promotion praying for Catch Up Rule , not endorsed for the Consequential Seniority due to want of clarity that “Unless and until a decision at the highest level is taken as regards the implementation of the reservation in promotions, the same shall not be affected”

Further, in the verdict , it was made clear that “If any promotions have taken place contrary to the law as it exists now, it shall be open to the respondents to take corrective steps. Pending such action, the promotions so made shall be treated as provisional, without giving rise to any right to seniority in the promoted post.”

The two live cases in the Hon’ble CAT Chandigarh viz Shri. Anupam Yadav: OA No 1435/2018: Status Quo in the AO to CAO Promotion in 2018 & Shri. Naresh Thakur Vs BSNL: O.A./531/2017 (SHIMLA) [ PROMOTION] With M.A./238/2018 With O.A./912/2017 :( DGM-Adhoc to DGM Regular) are also praying for the Catch Up Rule in the same CAT Chandigarh.

General perception for the expected verdict of the two live cases from the CAT Chandigarh is just imaginable in the light of the other two verdicts already happened on 25th February 2020 from the same CAT.

Hence, AIBSNLEA requested to consider CAO regular promotions as per the DOP&T office memorandum No. 36012/16/2019-Estt (Res) dated 12.04.2022 or issue CAO Adhoc promotions pawing way for JAO to AO(Adhoc) . CAO to DGM(Adhoc) Promotion can also be considered as the final directions from Hon’ble court cases may be happening after prolonged arguments and the time frame for the final direction from the Hon’ble court cannot be predicted . Since the long time frame in the finalisation of the cases in CAT shadowing the process of Regular promotions of executives to higher cadres which leads to the retirement of executives from the working cadre , BSNL management may think of issuing Adhoc promotions to the eligible executives to higher cadres in all Streams .

GM(Pers) had a patient hearing on all our submissions and appreciated the concern of AIBSNLEA and replied that management can think in the same line submitted by AIBSNLEA if the legal constrains for Regular promotions continues.

Pending Promotions in all other Streams/Cadres:

AIBSNLEA had a detailed discussion on all the Pending Promotions in all other Streams/Cadres including the pending case in SDE Civil to AGM Civil . In the Pending PA-PS /PS-PPS promotions, AIBSNLEA submitted that after completing all the formalities the CPC files are waiting in BSNL CO from December 2022 onwards. On enquiry it is learned that BSNL CO is to finalize and approve for the promotion orders as per MSRRs 2009 or with MSRRs 2023. Now it is clarified that the CPC is going to happen as per MSRRs 2023.

GM(Pers) responded that PA to PS promotion is pending want of the finalisation of new RRs in line with SDE RR 2021. PS to PPS being the all India Cadre as per the new MSRRs, BSNL CO is in preparation of the All India Seniority list of PSs and once list is finalised , the promotion orders will be issued . AIBSNLEA responded that PA to PS promotion may be carried out through the present RR and promotion postings shall be given in the same circles.

Inter Circle Long Stay transfer of AGMT/SDET for 25/24 Years:

AIBSNLEA requested to favourable consideration of the options of executives for nearby circles/choices as it was facilitated in the last year. If possible exempt executives from long stay transfer as far as possible upon their genuine requests in addition to the exemptions defined as per BSNL CO Letter No 28-6/2017-SCT(Part-I)1041 dated 20.11.2018. GM (Pers) replied that everything in the Inter-Circle Long Stay Transfer will be 100% transparent in it and assured that all kinds of genuine requests will certainly be considered. The transfer orders are expected  in April 2023.

Long pending 147 LDCE case:

AIBSNLEA discussed the latest developments in 147 LDCE case in details with GM (Pers). We informed that Hon. SC in Order dated 14.02.2023 in SLP 30281-30282/2019 filed by BSNL against the judgement of Hon’ble HC Chandigarh granted four weeks’ time to BSNL counsel to get fresh instruction from BSNL in this matter. AIBSNLEA discussed the matter in length and requested to settle the case as per statutory rule i.e. As per RR 1981 amended in 1986. We also submitted that BSNL has already revised the seniority of 147 executives and assigned due seniority from 1994 onwards as per Hon'ble HC of Ernakulum judgement and submitted the same before the Ld Expert committee constituted by Hon'ble SC vide it's judgement dated 21.01.2015. The same had been accepted by the Ld Expert committee. Also, BSNL has given undertaking in this matter in the Hon’ble SC in 2016 that seniority of 147 executive already revised as per Hon HC Ernakulum. So, AIBSNLEA requested to settle this issue of 147 Case as per Law and extend justice to all the executives.

GM(Pers) assured to do the needful as the case is coming up for hearing on 11-04-2023 in Hon’ble SC of India.
 

16.03.2023    Com Amit Kr. Mukherjee , Circle Secretary  WB  Reports that :  

AIBSNLEA WB and CTD Circles jointly met Hon'ble CMD, BSNL on 15.03.2023 at the Telelphone Bhawan, Kolkata during the visit of CMD BSNL to Calcutta . On behalf of AIBSNLEA, WBTC, Circle Secretary, Circle President, Financial Secretary and Branch Secretary CNTX-E were present. From CTD side CS, CP and AFS CHQ were present . We welcomed Hon'ble CMD Sir with flower Bouquet. Later, we submitted a memorandum and apart from the memorandum, a brief discussion was held with him on the following points.

1. Roster of ‘PA to PS promotion’ was sent to Corporate Office, New Delhi in the year 2019 by WBTC before restructuring, but the roster was not executed for promotion yet. In this regard, CMD Sir said that after restructuring, promotion of all cadres have already been executed except AO to CAO and CAO to DGM (Fin) promotions. Beside these, CMD Sir informed us that a Promotion Calendar of all cadres of BSNL staff will be published within end of this month (March’2023) for maintaining transparency in this regard.

2. Regarding posting of regular DGM(Fin.), CMD said due to Court Case no promotion of AO to CAO and CAO to DGM(Fin.) could be given yet even after having positive attitude of BSNL Management. As soon as the court case issue is resolved, promotions order will be issued and DGM(Fin.) posting will be made to WBTC.

3. Regarding 3rd PRC, CMD BSNL did not give any assurance for implementation.

4. Besides, CMD sir assured us that he will deliberate and consider all the issues given in the memorandum.

The meeting was very enthusiastic and effective. AIBSNLEA WB & CTD Circles appreciated CMD for arranging two back to back  revival packages from the GOI for BSNL . The meeting  ended with applause to the CMD BSNL . <<Representation to CMD by WB Circle>>

14.03.2023     Greeting Shri. Puran Chand Bhatt PGM EF , BSNL CO ....+

Today , AIBSNLEA CHQ team comprising of GS, President , Dy GS, FS , Auditor and Advisor ( CHQ) met Shri. Puran Chand Bhatt, PGM EF, BSNL CO and honored him with Shawl and Bouquet subsequent to the integration of the HR related matters of Finance Steam with PGM(EF). This is a highly encouraging step from the BSNL Management for the speedy processing of the HR related issues in Finance Stream. We extend sincere thanks to the CMD BSNL and BSNL management for arranging the facility with Finance Stream also so that Pers wing of BSNL CO can showcase the fullest efficiency in handling and releasing all the HR matters of all Streams timely.

CHQ leaders discussed all the pending issues of Finance Stream with the PGM (EF) including the pending transfers,  Promotions between the cadres of AO to CAO , CAO to DGM F and JAO to AO. Though PGM (EF) is well aware of all the matters pertaining to Finance stream , PGM (EF) made a patient hearing to all the submissions of AIBSNLEA CHQ  and assured to share the best out of him for the smooth and speedy happening of HR matters pertaining to Finance Stream through Pers department of Corporate Office.

CS TN Circle Com. Anand and CS Chennai Telephones Com. Ramalingam with their team met Shri V Ramesh ITS , Director EB  at Chennai and extended warm greetings to DIR EB . The Circle Secretaries submitted request to strengthen the core and transmission network of BSNL fot meeting the heavy data demands from FTTH/EB and Mobile Customers. DIR EB was very proactive to the submissions and the meeting ended with positive note.

13.03.2023     All the executives will be required to submit the self-certification regarding Professional Up gradation Allowance for purchasing books. Journals etc. at the end of every financial year to regularize the payment of PUA for the respective financial year in terms of the provisions of this office orders dated 23.08.2006 and 18.10.2006.

In case of non-submission of the mandatory certificate, PUA for the subsequent year will not be paid.

The youthful and energetic Open Session of the Circle Conference has been inaugurated by PGMTD Ahmedabad Mr. Nitin Mahajan , GM (Admin) ATD Shri Sandeep Bhavsagar and GM (EB) ATD Shri Devendra Dwivedi. The open session has also been addressed by the Circle Secretaries of all other associations and unions.

CHQ President Com Raj Pal Sharma , Dy. GS Com J K Patel were attended and addressed the Circle Conference. The new Circle Body has been unanimously elected by the house and the meeting concluded with National Anthem.

Circle President: Com. Navsheel Pandey- S.D.E (EB) ATD, Circle Secretary: Com. Jignesh Solanki -JTO (EB) Bhuj and Circle Finance Secretary: Com. Jayesh Bhatt- JAO (TR) Bhuj , Dy. Circle Secretary:Com. V.K.Patel – JTO(PM) ATD, Com. Harshad Dharejiya SDE (EB) ATD and Com. Nilesh Poriya JTO (CM) Bhavnagar are elected as CWC Members.
