Dear CS/CPs , your attention is requested to the letter from BSNL CO to All Heads of  Telecom Circles/Metro Districts & Other Administrative Units  All PGMs /Sr. GMs/GMs of BSNL on the issue of entering the ofline APAR data in SAP Portal for the period 2010-11 onwards of all SDEs/AOs under the jurisdiction of the concerned and sending report (generated by T-code ZHR_GET APAR_DATA), duly signed by members of APAR Data Verification committee to the Corporate Office by 15.03.2022.

Even after many reminders , some circles have not send the details yet especially regarding that of Accounts officers . You are kindly requested to take up the matter with concerned Circle / Unit head so that all the relevant APAR Datas would be available in SAP without delay for the smooth conduction of CPC from AO to CAO and SDE to AGM

11.10.2022    GS, President and Dy.GS had an elaborated meeting with GM (Pers) on 10.10.2022 and discussed pending HR issues. Subsequent meetings on the HR matters have been continued today 11.10.2022 also with joint GM (Pers) and DGM (Pers- Legal) CO, BSNL .

Update on SDE (E) to EE (E) Promotion: we enquired on the promotion process already started by BSNL upon the request of AIBSNLEA to the CMD BSNL. GM (Pers) informed that the SDE(E) to EE (E) promotion process is started as per the direction of CMD, BSNL and there are no hurdles in completing the promotion process. However, to have an undisputed promotion process, BSNL sought some more clarity from DOPT on the implementation of PwBD reservation in the BSNL promotion process. BSNL Management is waiting for the clarification from DOPT as some officers belongs to the PwBD category are in the zone of consideration from SDE(E) to EE (E) Promotion. The clarifications are expected shortly. As and when the clarification received, the CPC process will be completed and promotion orders will be issued.

AIBSNLEA submitted that as per the request of AIBSNLEA to the CMD BSNL to issue the Promotions Orders from SDE (E) to EE (E) as there is no court cases against the promotion in Electrical Stream and to share the feeling that BSNL Management is not against any eligible promotions for employees in any stream while most expected promotion orders of other streams are caused to hit legal blockage due to our own Executives, CMD BSNL was kind enough to issue instructions for the same. However, the delay in issuing promotion orders may be sensed differently.

AIBSNLEA strongly expressed our apprehensions in the delay in releasing the promotion orders after having detailed discussion on the delay.  GM (Pers) assured that; the promotion orders can be expected shortly especially on the fact that CMD BSNL is very much keen on issuing promotions to all the eligible Executives in all verticals wherever litigations are not there.  Jt.GM (Pers) was also there with GM(Pers) during the meeting

Promotion from AO to CAO Cadre: 

AO to CAO promotion process struck in 2018 through the “status-quo” called by Hon'ble CAT Chandigarh (OA No 1435/2018 with MA 168/2019 & MA 1749/2022). The case is Scheduled for 27.10.2022 after multiple adjournments AIBSNLEA submitted one solution for the AO to CAO promotion before BSNL Management and the BSNL Management readily agreed on it, and the same has already been reported by this association through our CHQ website.  In the backdrop of the proposal, AIBSNLEA enquired on the progress in the CPC preparatory works for AO to CAO promotion process. GM (Pers) mentioned that BSNL Management is very positive on the submission of AIBSNLEA and the preparatory works are already ON.

The matter is discussed in detail with DGM (Pers-Legal) also . AIBSNLEA extended our sincere thanks to  GM (Pers) and DGM(Pers-Legal) for their supporting steps in AO to CAO promotion process.

SDE (T) to AGM (T) Promotion:

Subsequent to the direction of Hon’ble CAT Kolkata (OA No 350/01626/2022) on recasting the SDE Seniority Lists, BSNL has filed Review Application (RA 22/2022) on 27.09.2022 and waiting for hearing.

Understandably, as per the direction of CMD BSNL, DGM (Pers-Legal) Shri. Uday kumar has been deputed to Kolkata for dealing the Case with BSNL Advocate before the Hon’ble CAT Kolkata to explore all the possibilities and seeking direction from the CAT Kolkata for moving ahead with SDE(T) to AGM(T) promotion after submitting the legitimate grounds led to the finalisation of SDE(T) seniority lists in BSNL . As the Court went on vacation, the expected directions pending from Hon’ble CAT. Thus SDE(T) to AGM(T) promotion orders would be delayed further.

This is a very saddened situation in BSNL that anyone can derail the promotion process indefinitely through legal platforms may be by projecting one or another half-cooked reasons. This delay created in the promotion process certainly demotivating the long waited eligible executives for their promotions and their demotivation may naturally reflect in their working efficiency. In most of the Court cases, after hearing the submissions of BSNL, the Hon'ble Courts vacating the stays already granted as in the case of CAT Jabalpur (OA No: 746/2022). The applicants approaching the courts are not only delaying the promotion process but it leaks already weakened BSNL exchequer also. This unpardonable hurdles from the part of some executives are neither beneficial to BSNL nor beneficial to that executives but this infelicitous hurdle mercilessly derailing the deserved promotions of thousands of BSNL executives who are really working for the interest of BSNL services. BSNL management shall not be mute spectator here with this unfortunate and avoidable chaos created against the interest of BSNL by some executives, especially when BSNL is granted the 2nd revival package to turnaround BSNL to its pristine glory.

AIBSNLEA already requested CMD BSNL to address the situations lead to the hurdles for smoothening the Promotion Process. CMD BSNL strongly agreed with our submissions and assured to take a call on the matter.

We requested GM(Pers) to take all out efforts to release the much-awaited SDE(T) to AGM(T) promotions at the earliest . GM(Pers) assured to explore all the possible solutions for the same.

Removal of Bug in the APAR software package:

AIBSNLEA Enquired on the progress of the APAR issue which already AIBSNLEA submitted to different levels of Management. We submitted that the wrong option getting selected inadvertently by the Reporting Officer against “Integrity” column under para 4 of e-APAR. Instead of the option selected “Beyond Doubt”, another option “Not Watched the Officer’s work” got reselected while moving ahead with APAR process by Reporting Officer. The same is unnoticed in many cases by Reviewing Officer also and agreeing with the comments of the reporting officer.

Jt.GM (Pers) informed that management started to settle the issue once for all and assured that it will not affect granting of Financial Upgradation and Regular Promotions of any of the affected Executive. AIBSNLEA thanked Jt.GM (Pers) for his sincere support to all the eligible HR issues taken up with him.

We requested to release all the Pending OTP Transfer Orders and GM(Pers) assured to look into and issue the pending orders.

AIBSNLEA has been perusing to release all the request transferred AO and  it is informed that BSNL management issued instructions to all the concerned CGMTs to release the already transferred AOs vide BSNL CO order dated 06.04.2022.

When discussing on the pending promotions of all other cadres viz AGM(T) to DGM(T) , CAO to DGM(F) , CAO (Adhoc) to CAO (Regular)  , Civil Wing , PS to PPS, DGM Telecom/Finance (Adhoc) to DGM(Regular) ;  GM(Pers) assured to consider all eligible promotions one after another as directed by CMD BSNL.

GS, Dy GS and Auditor CHQ met the DIR HR BSNL Board Shri Aravind Vadnerkar and discussed all the agenda items. DIR HR was very much open and supportive to all the points submitted by AIBSNLEA.

Some Important Outcomes of the Discussions follows... 

SDE (E ) to EE ( E ) Promotion: We requested DIR HR to consider the Promotions from SDE (E ) to EE ( E ) as there is no court cases against the promotion in electrical stream . By issuing Promotion orders in Electrical Stream , we requested , BSNL management can share the feeling among executives that BSNL management is  not against releasing any eligible promotion orders for employees in any stream as most awaited SDE(T) to AGM(T) promotion struck in court of law by our own executives .

DIR HR appreciated the suggestion of AIBSNLEA and informed that the suggestion is well taken by BSNL Management. The DPC/Promotion Process from SDE (E ) to EE ( E ) Started and BSNL Management is completing the Promotion Process Shortly .

During the discussion, DIR HR called the GM ( Pers) and sought the latest status of the DPC process and suggested to complete the Promotion process at the earliest .

 We thanked DIR HR for the acceptance of our suggestion and initiate action upon our  request.                                                                    

The SDE (E) to EE (E) Promotion Orders are expected Shortly.

 Subsequent to the SDE(E) to AGM(T) promotion JTO(E) to SDE(E) promotions will take place.  

Long Pending Promotion from AO to CAO promotion:  

AIBSNLEA submitted the solution to DIR(HR) also for issuing the AO to CAO promotion orders without much delay and sought support of Management for the same. After listening our suggestion ,  DIR ( HR ) readily assured his full Support for the Submission which results in the release of promotion orders for the long awaited AO to CAO cadre.

AO to CAO promotion process struck in 2018  through the “status-quo” called by Hon'ble CAT Chandigarh (OA No 1435/2018 with MA 168/2019 &MA 1749 / 2022). Due to the “Status quo” called by the Court, Some of the AOs could not join to their CAO posts as per the promotion orders issued in 2018 .The case is  lingering for more than  4 years in court with 29 adjournments  and Scheduled further for 27.10.2022.

 The case in Court may be going on going. Many eligible AOs for CAO promotions  are retiring every moth heavy heartedly cursing their misfortune . Many young officers in AO cadre completed their 7 years of service in AO cadre , after 1.1.2022, for CAO promotion will be eligible for promotion by 1.1.2023 . These points caused AIBSNLEA to act upon with management for the possible Solution for the AO to CAO Promotions.

AIBSNLEA expect the AO to CAO promotion in the First week of Jan 2023 . JAO batch 1996 , JAO batch 1999 and JAO batch 2004 will be considered for the CAO Promotion . AO to CAO Promotion pending for more than 4 years are expected to release in the First week of January-2023

AIBSNLEA thanked DIR HR for the total support for our suggestion .

SDE to AGM Promotion:

The Stay  on SDE(T) to AGM(T) promotion  by Hon'ble CAT Jabalpur (OA No: 746/2022) has been vacated  on 28.09.2022. Regarding the direction of Hon’ble CAT Kolkata (OA No 350/01626/2022) on recasting the SDE Seniority Lists, BSNL has filed Review Application (RA 22/2022) on 27.09.2022 and waiting for hearing.

AIBSNLEA had a lengthy and detailed discussion on the recasting the SDE Seniority Lists with DIR (HR) . AIBSNLEA made clear our crystal clear stand to DIR HR that all the available seniority Lists of SDEs from List 6 to 13 are finalized as per the Date Of Joining to the cadre of SDE. All these seniority lists had been well finalized after high-cost lengthy Legal process based on the Hon’ble Supreme Court direction/order. Hence, the Lists cannot be changed by the directions of any lower courts. Hence any change in the list can create turmoil and series of fresh court cases.

Understandably BSNL management is of the same stand that none of the SDE Seniority Lists would be recast.

Hence, after submitting the facts & the situations lead to the finalisation of the SDE Seniority Lists in Hon’ble CAT Kolkata, SDE(T) to AGM(T) promotion orders are expected with the consent of Court.

AGM(T) to DGM(T) and CAO to DGM promotions:

AIBSNLEA requested to release all the promotions orders from AGM equivalent cadres to DGM equivalent cadres as there is no road block in the promotion process . DIR HR replied that the request will be considered as there is no hurdles for the Promotions.

The promotion orders for all the eligible AGM(T) and CAO who are completing 4 years of regular service as on 1.1.2023 are expected by  Jan 2023.

Subsequent to the promotions of AGM(T) /CAO to DGM cadre in Jan 2023, additional promotion for SDE(T) to AGM(T) and AO to CAO cadres are also expected to be released proportional to the resultant vacancy created in the AGM(T) /CAO cadres.

MSRR 2009 : Educational qualification for AGM/CAO/Equivalent Promotion

One association approached Hon’ble court on the Ambiguity in foot Note 2 below schedule 1A of MSRR and praying “Educational qualification for executives to be promoted to the grade of DE/AGM/CAO shall be engineering degree or equivalent in Telecommunications, Electronics & Computer Science /IT/Electrical for Telecom Operations & graduate or equivalent of Finance” All other “Unqualified” Executives shall not be promoted.

AIBSNLEA had a detailed discussion on the matter with DIR(HR) . AIBSNLEA appraised DIR(HR) that BSNL filed Minutes of the Management Committee Report Submitted on 27.06.2018 to the Court admitting that there is an ambiguity in Foot Note 2 below schedule 1A of MSRR but all the  existing incumbents holding the post of Executives on regular basis on the date of notification of these RRs (released on 14.07.2009 with effect from  21.06.2009) shall continue to be eligible for promotion to the grade of DE/AGM/CAO/Equivalent cadres.

DIR(HR) had a very patient hearing to AIBSNLEA on this matter and assured that the Management Committee Report Submitted on 27.06.2018 to the Hon’ble court is final and all the executives will be considered for DE/AGM/CAO equivalent grade of promotions against available vacancies according to their seniority alone.

After understanding the mistake, it cannot be revoked, many Controlling/Reviewing Officers are issuing correction letter to the affected officer but the affected officers are not being considered for the Financial Up gradation/ Due Promotion to higher grade. DIR(HR) called Jt.GM ( Pers) and directed to issue correction note on it and direct ERP team also for  debugging the issue .

New SDE RR 2022 :

We sought the latest status of the New SDE RR 2022. DIR HR informed that BSNL Board approved the SDE RR 2022. The approval is referred to DOT and DOT sought some clarifications. All the clarifications were answered. BSNL expect the SDE RR 2022 approval from DOT, shortly. AIBSNLEA already submitted our suggestions for the SDE RR 2022.

Pending Promotions in all other cadres including Civil, PS-PPS, DGM Telecom/Finance (Adhoc) to DGM(Regular) & CAO (Adhoc) to CAO (Regular) Promotions have also been discussed . DIR HR was very positive to our request.

We requested to release all the Pending Transfer Orders and DIR HR assured to complete the orders .

AIBSNLEA Thanked DIR(HR) for the very positive approach and support from him to all the issues taken up by AIBSNLEA .

26.09.2022   Update on the Court Case at Hon'ble CAT Jabalpur intervention on SDE(T) to AGM(T) Promotion:

The case (OA No: 746/2022) was listed  for the hearing today (26-09-2022)  but could not be heard fully due to paucity of time .

23.09.2022   GS and President had an emergency meeting with CMD BSNL Shri P. K. Purwar Ji and discussed the following.

AIBSNLEA started the meeting by appreciating CMD BSNL anew that as the result of the 2nd revival package the Cash infusion is arranged to come to BSNL to pay the outstanding debts to field contractors and thus BSNL could strengthen BSNL Services in a better way. The confidence level of BSNL employees is enhanced very much with the 2nd revival package especially due to the truth that the authorized capital of BSNL is jumping from 40,000 Crore to 1,50,000 Crore.  

However, some pockets of executives are very much disheartened, demoted and disturbed badly due to the non-release of their long pending promotion orders. Multiple court cases lodged by our own executives only are derailing the promotion process. It is unfortunate that many of the Court directions are ordered against BSNL promotion process without hearing the views of BSNL on the petitions filed to the Courts. This kind of multiple litigations not only derailing the promotion process but affecting the performance of BSNL also, in multiple ways.

AIBSNLEA shared our strong views in details with CMD BSNL in respect of various court cases which blocked promotions in BSNL by our own executives that resulted multiple unhealthy events hampering the growth of BSNL . CMD BSNL 100% agreed the views of AIBSNLEA and assured that the suggestion will be implemented in BSNL for a better BSNL.

AIBSNLEA is not against and cannot stand against any executives from achieving their legitimate rights through the Hon’ble court of law, if BSNL management is not listening them repeatedly. But this association is deadly against in turning down the very eligible rights of thousands of executives waiting for their long cherished and most eligible promotions by hooking the process of promotions in the Court of Law unwantedly by submitting half cooked data, emotionally.

Many SDEs retired in the last month, on superannuation, also expected their most eligible AGM promotions before their retirement after serving more than 30 years but unfortunately, they wept their heart out while leaving BSNL due to the non-release of their righteous promotion due to the Stay obtained from Court of Law for the reason no way related to them. This is a very cruel and unpardonable situation, whoever be responsible for cause.   

Release the very long pending Promotions Orders from SDE(E) to EE(E) and JTO (E) to SDE (E) subsequently:

AIBSNLEA requested to CMD BSNL to issue the Promotions Orders from SDE (E ) to EE ( E ) as there is no court cases against the promotion in electrical stream and to share the fact that BSNL management is not against any eligible promotions for employees in any stream while most expected promotion orders of other streams are caused to hit legal blockage due to our own executives . We shared the letter addressed to CMD BSNL in this regard. CMD Sir considered our suggestion very positively. Some more discussion going on this matter.

AIBSNLEA expects the release of Promotion Orders from SDE(E) to AGM (E) without delay. AIBSNLEA extended sincere gratitude to CMD BSNL. 

SDE (T) to AGM(T) Promotion, CAT Kolkata OA No 350/01626/2022 and CAT Jabalpur OA No: 746/2022.

AIBSNLEA submitted to CMD BSNL that all the available seniority Lists of SDEs from List 6 to 13 are finalized on the Date Of Joining to the cadre of SDE. All these seniority lists had been well finalized after high-cost lengthy Legal process based on the Hon’ble Supreme Court.

The inter-se Seniority between the 67% SCF quota and 33% LDCE quota (that is 2:1 Rotation applicable w.e.f 28.8.2015 only) was introduced as an addition / modification to the SDE(T) RR dated on 08.05.2018, hence the ROTA-Quota / Inter-se-seniority between the Seniority Quota (SQ) and Competitive Quota (CQ) cannot be applicable for those promotions happened before 28.08.2015 viz date of promotion orders for the Lists:  9 & 10 on 15.05.2009, 11 on 30.03.2011 and 12 & 13 on 02.07.2013.

Since all the lists had been finalised as per the direction of the Hon’ble Apex Court of India, BSNL management cannot initiate any reordering for changing seniority as per the direction from any lower court.

AIBSNLEA earnestly requested CMD BSNL to submit this fair views in Speaking Order to the CAT kolkatta bench for OA No 350/01626/2022 and go ahead with promotion process from SDE(T) to AGM(T)  

AO to CAO Promotion Status Quo case and Pending Promotions in Accounts Cadre : 

We requested to CMD BSNL to take all possible efforts to get the  Stay  “Status Quo” vacated. The Case pending for the last 4 years from 2018 in the Hon’ble CAT Chandigarh is again postponed the case to 28-09-2022 due to the non – availability of bench on the last date of hearing.  CMD assured to do all the possible efforts .

Pending Promotions in all other cadres including Civil, PS-PPS, DGM Telecom/Finance (Adhoc) to DGM(Regular) & CAO (Adhoc) to CAO (Regular) Promotions have also been discussed. CMD BSNL made it very clear that BSNL Management is not against issue of any eligible promotions .

When we requested CMD BSNL to share latest information if any, CMD BSNL shared the very positive development in the Indigenous 4G under Atmanirbhar Bharat . The 4G development is completing all the formalities as it is under the direct monitoring of the Hon’ble PMO office. CMD BSNL continued that the 4G can be inducted to BSNL without delay and one meeting of CMD BSNL , Directors of BSNL Board, the concerned officers in DOT and the Concerned Developers is scheduled to have . We extended sincere good wishes for the early induction of the indigenous 4G into BSNL . We further extended earnest gratitude to CMD Sir for the permission for the emergency meeting .
