29.09.2017 CMD BSNL meeting with BSNL Unions and Associations Core Group:

GS along with GS of BSNLEU, GS NFTE and GS SNEA has attended the meeting convened by CMD BSNL today at 1530 hrs to discuss the present condition of BSNL.

CMD apprised about the Indian Mobile congress (IMC) on 25-26 September 2017 at Pragati Maidan wherein many private operators CEOs visited BSNL Stall and commented  by  Shri Mukesh Ambani, chairman of Reliance industries that  himself said that BSNL is  standing in the competition in comparison to other operators. Best stall there is of BSNL.

Current market scenario CMD informed that positive side for BSNL is that the market share of BSNL has increased from 8.6 in March,2017 to 8.84 in July 2017 in mobile segment despite of  tough competition. Media has also reported that BSNL has challenge the Reliance Jio in the ongoing tariff war. Whole credit goes to the BSNL employees and we are proud of it.

However BSNL has suffered on financial front. Revenue in July impacted huge due to GST implementation. But with the sincere and dedicated efforts of the BSNL Finance wing officers in BSNL CO and IFA sin field units met the challenge and could resolve the problems immediately. In the month of Aug the realisation was 98.9% and in September till date 55%.  Due to this cash crunch in the month of July the salary was disbursed on OD.

Earlier IUC charges benchmark was 0.14 paisa which is now reduce to 0.6 paisa. In our opinion it should be minimum 0.22 paisa.

Now BSNL has to launch aggressive tariffs in view of this BSNL in collaboration with micromax is launching bundled feature phone having smartphone features on the price of Rs 2,200 and Rupees 97 sim with unlimited voice and Data. It will be matching brand with Jio. This product will save customers in rural and medium class. BSNL is subsidising Rs 1200 out of 2200 and this product will be named Bharat-1.

BSNL has also tied up with Vodafone on prepaid service for free roaming  now customer of BSNL may roam on Vodafone network freely . post-paid will also take place soon.

Recently BSNL has received Rs 1500 crores from NFS amount which will help immediately.

Mobile phase –VIII PO s have been placed in North south and West zone . In east zone PO will be placed shortly.

BSNL is earning around 12000 crores revenue per annum from CFA business. Hence its own strategies are different than other operators. As About Rs 16000 crore on salary payment alone .Wi-Fi, landline and Wi-Fi integrated to mobile network are being provided by BSNL only. Landline broadband it is giving good revenue through NGN wireless services, Wi-Fi services holds on the broadband market. Further any suggestion may be given by unions and association within one week time in this regard.

BSNL has also applied for 4G spectrum allocation (2100 MHz band) which will cater 3G also. The spectrum charges will be paid on yearly basis up to ten years. 2G phase VIII order need to be reviewed.

Regarding Core network, OTN phase-I and phase-II has come. PGCIL connectivity also effective.

3^rd PRC implementation in BSNL with 15 % fitment benefit: CMD informed that BSNL MC has approved the 3^rd PRC report with 15% fitment benefit and it has been sent to DOT for clearance. Simultaneously it will be placed in the next Board meeting for approval shortly. He further mentioned that Secretary Telecom also commented that BSNL deserves for 3rd PRC implementation and she will meet Hon'ble MOSC(I/C) along with CMD BSNL in the next week to get his consent. He also mentioned that Hon'ble MOSC (I/C) wants to implement 3^rd PRC in BSNL from his core of heart.

Creation of tower subsidiary:

CMD mentioned that after creation of tower subsidiary immediately BSNL will get 8% tax saving benefit and tower subsidiary may help in giving more revenue to BSNL. The depreciation amount of BSNL will reduce about 1500 crores. BSNL will be giving initially Rs 7000 crores notional loan to tower subsidiary against which it will get interest.

As per our opinion the negative side is to pay rent to tower subsidiary for hiring towers. And the strategic  business partner induction may pave the way for its complete disinvestment and privatisation. CMD commented that in his opinion for next ten year it is not visible.

On the issue of PLI payment this year CMD assured to look into.

We also discussed our "Candle Light March" also with CMD.

After detailed discussions meeting ended at 1745 hrs.

27.09.2017  General  Body Meeting of AIBSNLEA, West Bengal CIRCLE  on 23.09.2017:

A General Body Meeting of AIBSNLEA, West Bengal Circle was held on 23.09.2009 in the T.I.Hall, CTO Building, Kolkata in the presence of Shri Prahlad Rai, GS & Shri Sivakumar, President, AIBSNLEA CHQ, New Delhi. The hall was fully filled up with the AIBSNLEA Members. Shri Prasun Mukhopadhyay, O.S. (East), Shri Basudeb Chakraborty, Adviser, CHQ, Subhasis Mitra CS CTD,  were also present in the meeting. Shri Prasun Mukhopadhyay requested the GS to take up the various issues of CTD & W.B. Circle with BSNL HQ for early settlement. Shri Aniruddha Basu, CS, West  Bengal Circle, Shri Prasanta Nag CS, AITEEA, Subhasis Mitra CS CTD,  S. Sarkar CS, Retired Association delivered their valuable speech. Shri Sivakumar, President, CHQ stated that this is his first meeting with the Members of West Bengal Circle. He explained in details the problem being faced by CHQ due to opportunistic approach of some sister Unions/Association. Shri Prahlad Rai, GS explained in details the status 3rd PRC issue, 15% fitment benefit, status of CPC of various cadres, transfer related issue of Accounts Cadre, deduction of GPF contribution on actual basic pay, non-deduction of additional increment benefit in respect of EPP from pensionory benefit of retired employees, continuance of dual membership by SEWA members. He requested to the AIBSNLEA Members of CTD & West Bengal Circle to work more actively to upgrade the status of CTD & WBTC like Orissa, Ketala Circle. Shri Kalyan Halder, President, AIBSNLEA, WBTC conducted the whole meeting smoothly. In his speech he stated that CCA, DOT is deducting additional increment benefit from the retirement benefit of employees and this should be stopped immediately. He conveyed vote of thanks and finally concluded the meeting with national anthem.

26.09.2017 DGM (F) Promotion orders issued:

AIBSNLEA's consistent efforts yielded results in getting released the promotion orders in respect of 57 executives of STS (CAO/AGM) working on regular basis, to officiate on purely temporary and ad-hoc basis and till further orders in the grade of Deputy General Manager equivalent to JAG with immediate effect, as per BSNL MS Recruitment Rules. AIBSNLEA extends its sincere thanks and gratitude to CMD BSNL, Director (HR)/(Finance), GM (FP) and entire SEA Cell for their kind hearted support in issuance of these long awaited promotion orders.

24.09.20176th CIRCLE CONFERENCE OF AIBSNLEA ,CALCUTTA TELEPHONES CIRCLE ON 21th & 22nd SEPTEMBER'2017 AT MOULALI YUBA KENDRA, KOLKATA.

FIRST DAY :

The 6th Circle Conference of AIBSNLEA Calcutta Telephones Circle was held at Swami Vivekananda Auditorium, Moulali Yuba Kendra, Kolkata on 21st and 22nd September 2017 in an excellent and jubilant manner.

The day one of the conference started with flag hoisting. In the presence of CHQ President Com S.Sivakumar, our CTD President Com Tridip Chakraborty, hoisted the Association flag. All delegates assembled in the hall with the thundering slogan AIBSNLEA ZINDABAD, BSNL ZINDABAD,6th Circle Conference Zindabad.

The meeting started with welcome address by President/CTD. One minute silence was observed for the memory of our departed members and well wishers.

The minutes of 2015 Conference was confirmed by the house. All Branch Secretaries, Organizing Secretaries, Assistant Secretaries placed their brief report which was summed up by the CS.

There after a brief and consolidated CS Report was placed by Com Prasun Kumar Mukhopadhyay CS/AIBSNLEA/CTD. Our Senior leaders like Com Aniruddha Bose CS WB Circle, Com Sitanshu Sarkar CS AIRBSNLEWA and two senior comrades Susanta Das and Prasun Mukherjee greeted the conference.

After Lunch FS Com Dilip Battacharjee placed the two years audited accounts report and discussions were invited about CS and FS report from the delegates.

7 delegates took part in the discussion after which both CS & FS report were adopted by the house unanimously.

CHQ President Com S. Siva Kumar addressed in the delegate session. He analyzed all the points of CPC, 50% MT Diversion of CAO Post, 3rd PRC, E2-E3 pay scale, etc. He also told about the MOU with AIGETOA and how it was built up and broken by them. An interaction session was started and the delegates placed their queries and President clarified them meeting adjourned for the day at about 7PM.

SECOND DAY :

The second day Conference on 22nd September 2017, was started with welcome to our beloved GS Com Prahlad Rai. GS addressed in the delegate session elaborately. GS covered all the points including 3rd PRC, E2-E3 pay scale, cadre hierarchy, 30% superannuation benefit, condition of CPCs, AD (O/L), E1+5 increment, relation with other Unions and Associations. He analyzed in the house about misstatements of the ‘friendly' Association which damaged the unity of the executives.

A grand interactive session started thereafter, GS clarified all the questions from the delegates upto their satisfaction. The second half was allotted for open session. A grand and historical open session was conducted in the 2nd half of day 2.

OPEN SESSION:

The Chief Guest of this occasion was Smt. Sujata.T.Ray Director (HR & FIN) and Guest of Honour was Sri S.P.Tripathi CGM Calcutta Telephones.

The open session started with the felicitation of the dignitaries and there after lighting the lamp with Tagore's Song, " Aguner Parasmani Chhoao Prane....".(Let our souls be ignited to completeness....).

President Com Tridip Chakraborty welcomed the guests and the members. CS Com Prasun Kumar Mukhopadhyay in his key note address discussed about the viability of BSNL as well as the way of improvement of CTD, the major All India Demands, and recent developments of the pressurization to the executives by the CTD Management.

Com Siva Kumar in his brief address thanked CS and his team for arranging this conference in a grand manner and requested Director Madam regarding CPCs and of accounts cadre and some related problems as well.

Com Prahlad Rai GS congratulated CS and his team for arranging this historical conference and open session in a befitting manner. Com GS also thanked the executives of CTD for making AIBSNLEA as number one association in recent referendum. Com GS described the history of formation of our association and the actions taken by CHQ for solving the HR issues. He congratulated Director (HR) Madam for her support by which the 3rd PRC Proposal is passed in BSNLMC. GS expressed his utmost hope that by the help of Madam and our respected CMD our 3rd PRC will be achieved in the BSNL very soon. He expressed our views about E2-E3 pay scale and cadre hierarchy, etc.. .

Sri S.P.Tripathi CGM/CTD in his address thanked CS and his team for inviting him in this august gathering and expressed his venture for the improvement of CTD. He also supported the key note address as placed by CS and requested all executives to work hard to convert CTD in a profitable condition.

Then our Chief Guest, Smt. Sujata T. Ray, Director (HR & FIN) addressed the gathering. She expressed her homely feelings in Kolkata because she spent 21 years of her life in Kolkata. Madam congratulated CS & Kolkata Team for arranging such a august gathering and expressed that she was dealing with Prahlad Rai for about two decades, she appreciated his positive approach and experienced leadership and solve any problem with the management. She also told that whenever some cases are going to be solved with a consensus opinion, the matter was spoiled due to rivalry of any other association. Madam assured the house about good news regarding 3rd PRC before De​​wali.

Due to some prior appointment Director (HR & FIN) Madam and CGM /CTD left the house but meeting continued.

Sri K.C.Ghosh PGM/CFA-II , Sri P.K. Mahapatra GM (HR & ADMN), Sri. Achintya Biswas GM (BA-EAST) were also present.

Sri Sekhar Mazumder CS /NFTE BSNL/CTD, Sri Prabir Dutta ACS/BSNLEU/CTD, Sri Saikat Das CS/AIGETOA/CTD, Sri Jayant Kumar CS/AITEEA/CTD also greeted the conference in their brief deliberation.

Sri Amit Gupta our Senior Leader AGS/AIRBSNLEWA & Consultant (CHQ) described the different problems of the retired executives.

Sri Achintya Biswas GM expressed the positive approach and fellow feelings of this association will continue in future also.

Sri P.K.Mahapatra GM (HR)/CTD in his deliberation thanked all and expressed that always he is available for the discussion and solving the problem with this association.

Election was conducted to form a new body. Election commissioner was Com Basudev Chakraborty Advisor CHQ.

A strong circle body for the next term was elected unanimously with Com Tridip Chakraborty as President (9433000488), Com Subhasis Mitra as Circle Secretary (9432001010) and Com Debabrata Dey as Circle Financial Secretary (8902000119). New body took oath with President Com Siva Kumar & Com Prahlad Rai GS welcomed the new body on behalf of the CHQ.

24.09.2017  Meeting with Shri Manoj Sinha Ji, Hon'ble Minister of State for Communication (I/C)

On behalf of the Associations and Unions of BSNL, Tamilnadu Circle, a delegation led by Com. C. Duraiarasan, CS, AIBSNLEA TN Circle met Shri. Manoj Sinha ji, Honourable Minister for State for Communications (I/C) during his official visit to RGM TTC Chennai for inaugurating “Swatch Bharath” programme and submitted a memorandum on “Implementation of 3^rd PRC in BSNL with 15% fitment benefit” and “Formation of Subsidiary Tower Company” 

1.  On PRC issue, he appreciated our concern and assured to settle in the interest of employees of BSNL. At the same time he advised to increase the revenue in BSNL so as to get more benefits.

2.  On the other issue, he clarified the proposed Tower Company is a part of business activity and will be fully owned by BSNL and assured that the same will not be privatized at least till he is assuming the office. However we requested to have discussions with the Associations and Unions to clear the apprehension in the minds of the employees.

The case filed by AIBSNLEA vide OA/100/2649/2017 in Hon'ble Principal Bench CAT New Delhi against the DOT order dated 05.07.2017 for withdrawal of additional increment by fixation in same scale on post based promotion under EPP came up for hearing today in the Principal Bench of Hon'ble CAT (Court No. 4 Item No.-13). the case was argued by the councillor of AIBSNLEA to grant an interim stay order on the implementation of the DOT order dated 05.07.2017 for withdrawal of additional increment by fixation in same scale on post based promotion under EPP. The councillor appeared for DoT requested some more time to file rejoinder. Our advocate opposed it. However, Hon'ble court granted some time and now the case is postponed for hearing on 05.10.2017.

22.09.2017 Status / update on DGM (F) promotions:

It is reliably learnt the CMD BSNL has approved the CPC minutes for promotions to DGM (F). Posting orders shall be issued in the next week after arrival of Director (HR)/(Finance), BSNL Board from tour.

It is understood that NUBSNLW (FNTO) has agreed and support the agitation call given by AIBSNLEA on 04.10.2017. The web publication on their website as mentioned below:

21.09.2017 Meeting with CMD BSNL:

GS,  AGS (HQ) and AGS (F) met CMD BSNL and discussed regarding implementation of 3rd PRC report with 15% fitment benefit in BSNL. CMD confirmed that the proposal regarding 3rd PRC report implementation with 15% fitment benefit in BSNL has been approved by the Management Committee of BSNL Board yesterday. Now, it will be sent to NRC & BSNL Board for approval shortly and thereafter to DoT for issuance of Presidential Directives.

It is understood that BSNL Management Committee has recommended implementation of 3rd PRC report with 15% fitment benefit in BSNL and suggested to revise the allowances/perks by BSNL ater teh approval of DoT on pay scale revision.

21.09.2017 Meeting with Member (Services), Telecom Commission, DoT:

GS, FS, AGS (HQ) and AGS (F) met Member (Services), Telecom Commission, Dot and discussed regarding:

A. De-linking of the revision of Pension of BSNL Pensioners from the revision of pay scales of BSNL serving employees: We requested for de-linking of the revision of Pension of BSNL Pensioners from the revision of pay scales of BSNL serving employees in view of the fact that BSNL Pensioners are not related with the profit & loss of BSNL. BSNL Pensioner's pension should also be revised like revision of the pension of the Central Govt. employees. Member (S) appreciated our concern and assured to recommend the case to DPE and Cabinet Secretariat for consideration.

B. Payment of pension contribution of BSNL employees on actual basic pay instead of the ,maximum of the pay scale: We requested Member (S) to consider and give favourable remarks on BSNL's proposal for DPE. Member (S) assured for favourable remarks in this regard.

21.09.2017 Status of the Court Cases against the DoT order dated 5.7.2017 for withdrawal of additional increment by fixation in same scale on post based promotion under EPP.

AIBSNLEA had filed an OA vide O.A./100/2649/2017 in Hon'ble Principal Bench CAT New Delhi against the DOT order dated 05.07.2017 for withdrawal of additional increment by fixation in same scale on post based promotion under EPP. The case came up for hearing today in the Principal Bench of Hon'ble CAT (Court No. 4 Item No.-11). the case was argued by the councillor of AIBSNLEA to grant an interim stay order on the implementation of the DOT order dated 05.07.2017 for withdrawal of additional increment by fixation in same scale on post based promotion under EPP. But the junior councillor of DoT informed that the rejoinder is being submitted today by the afternoon. Now, the case is postponed for hearing tomorrow.

20.09.2017  Meeting with CMD BSNL and Director(HR) BSNL Board:-

a) GS, President immediately met today with CMD BSNL and Director(HR) BSNL Board and expressed our resentment against non-holding of any discussions with all the stake holder Executive Associations on such important cadre issue. Dir (HR) mentioned that PGM(Pers) has already been directed to hold discussion with all the stake holder Associations before 15th October-2017.

b) Implementation of 3rd PRC report with 15% fitment benefit in BSNL:- We requested to get approved the 3rd PRC report with 15% fitment benefit from Management Committee of BSNL Board. CMD mentioned that the committee report may be discussed in the Management Committee of BSNL Board today. It is understood that the MC has approved 3rd PRC report with 15% fitment benefit in BSNL today. Now the MC approval will be put up before the Nomination and Remuneration Committee (NRC) and to BSNL Board for approval. The NRC and BSNL Board meeting is expected to be held in the Ist  week of October-2017. After the approval of the BSNL Board the proposal will be sent to DOT for approval and issuance of presidential directives. During this period we have to be vigilant and pursue continuously.

20.09.2017  Meeting with PGM (Pers) BSNL CO: GS, President met PGM(Pers) and discussed regarding;-

a) CPC from DE to DGM (Engg.) left out cases: We requested to expedite CPC from DE to DGM (Engg.) left out cases and issue promotion orders. PGM (Pers) mentioned that Hon'ble CAT Chandigarh Judgement on this issue has been sent to legal cell for legal opinion. We pleaded that Hon'ble CAT Chandigarh has pronounced the Judgement related to 14 respondents only which cannot be generalized. PGM (Pers) assured to look into the matter and an early action.

b) CPCs from SDE to DE, AO to CAO, JTO to SDE(LDCE quota) and SDE (C) to EE(C) etc.: we requested to expedite the CPCs from SDE to DE, AO to CAO, JTO to SDE(LDCE quota) and SDE(C) to EE(C) by getting an early clearance from the Hon'ble Apex Court. PGM(Pers) mentioned that IA has been filed in the Hon'ble Supreme Court in all three pending SLPs in this regards. The IA is posted for hearing on 27th October-2017. He clarified that in BSNLs IA it has been prayed to allow BSNL to issue promotions orders by considering the SC/ST roster on promotions as per DOP&T guidelines till the final outcome of the Court case. He assured that on the basis of the direction given by the Hon'ble Supreme Court on BSNLs IA the further immediate action will be taken.

c) CPC from JTO to SDE (Telecom.): We requested to get vacated the stay order on promotions from JTO to SDE(Telecom.) from the Hon'ble High Court Kerala. PGM(Pers) mentioned that one MA has been finalized and sent to Kerala Circle for filing in the Hon'ble High Court Kerala for an early hearing and pronouncement of the Judgement. After getting stay order vacated the CPC will be expedited.

d) Implementation of CPSU Cadre Hierarchy: We expressed our serious concern against not holding any discussion on CPSU cadre hierarchy with all the stake holder Executive Associations. PGM(Pers) mentioned that the discussions on CPSU cadre hierarchy are continue with the recognized Association which yet to be completed. Thereafter discussion with other Executive Associations will also be arranged.

20.09.2017  Meeting with GM(SR) BSNL CO: GS, FS met GM(SR) BSNL CO and discussed regarding payment of pension contribution to DOT on actual basic pay instead of the Maximum of the Pay Scale. GM(SR) mentioned that today he along with Director(HR), PGM(PF) met Member (Finance) DOT and discussed the matter in detail. Now it seems that with Dir(HR) pleadings the Member (Finance) DOT is convinced and may recommend BSNL proposal to DOE for considering the payment of pension contribution on actual basic pay instead of maximum of the pay scale. It will save minimum 1600-1700 crores rupees to BSNL per annum and will pave the way for smooth implementation of 3rd PRC report with 15% fitment benefit in BSNL.

19.09.2017  Meeting with CMD BSNL:

GS, President Met CMD BSNL and discussed regarding,

a) Implementation of 3^rd PRC recommendation with 15% fitment benefit in BSNL: We requested CMD BSNL for bringing up in the agenda of Management Committee of BSNL Board tomorrow. CMD assured to look into the matter. it is understood that 3^rd PRC issue may be discussed in tomorrow BSNL Management Committee meeting on the basis of internal committee report of BSNL. it seems that the committee has recommended 3^rd PRC implementation with 15% fitment benefit. After the approval of BSNL Management Committee it will be discussed in the Nomination and Remuneration Committee of BSNL Board, and thereafter in the BSNL Board for its approval. We have to continuously pursue the matter in BSNL and DOT.

b) DR JAO recruitment in BSNL: We extended our sincere thanks for the notification of DR JAO recruitment in BSNL. We explained that DR JAO recruitment and LICE(Departmental) quota  candidates recruitment has to take place 50:50 as per DOP&T guidelines  accordingly BSNL CO has notified the DR JAO recruitment which is the urgent need and requirement of BSNL in view of Corporate accounts, GST implementation, ERP & acute shortage of JAO about 3500 JAO post are laying vacant  . CMD appreciated our concern and assured to look into the matter.

19.09.2017  Candle March on 04^th October 2017 at New Delhi:

Com GS contacted most of the General Secretaries of BSNL Unions and Associations and requested them for their active participation and support the Programme of Candle March on 4^th October 2017 at 17:30 hrs from BSNL CO Janpath to Jantar Mantar New Delhi demanding implementation of 3^rd PRC report with 15% fitment benefit in BSNL.  Also requested to decide future course of actions to get implemented 3^rd PRC report with 15% fitment Benefit in BSNL. All the General Secretaries has assured their active participation in the candle march on 4^th October 2017.

All the Circle and District Secretaries are requested to coordinate immediately with their counterpart circle and district secretaries of all the BSNL Unions and Associations for their active participation in the demonstration and signing the memorandum to be submitted to the Hon'ble MOSC (I/C) through His-Excellency Governors of the States/ Lt. Governor of UTs and their respective Member of Parliaments Lok Sabha and Rajya Sabha.

19.09.2017  Meeting with GM (FP) BSNL CO:

a) CPC from CAO to DGM (F): We requested to expedite CPC from CAO to DGM (F) to fill up 66 vacant DGM (F) posts .GM (FP) informed that CPC have been completed and the minutes of the CPC have been sent to competent authority for approval. He assured that as soon as the approval on CPC minutes is received immediacy posting on promotion orders will be issued.  Promotion orders are expected within this week itself.

b) Consideration of request / tenure transfers cases of JAO / AO / CAO/ DGM (F). We requested for the consideration of the request / tenure transfers of the JAO / AO / CAO/ DGM (F) who has completed more than 2 years of service in the Circle. GM(FP ) assured to consider all the pending request ./ tenure transfers of  JAO / AO / CAO/ DGM(F) who has completed more than 2 years of service in the Circle.

c) Relieving of AOs from Chhattisgarh circle in ERP: We requested GM (FP) to relieve all the AOs who were under transfer to their home Circles in ERP. GM (FP) assured to look into the matter.

18.09.2017  Non-payment of GPF advance / payments in Himachal Pradesh Circle:

AIBSNLEA's consistent efforts yielded results in getting the funds released for the payment of GPF advance / payments in Himachal Pradesh. Now, the needy officers / officials will get their GPF advance / payments in Himachal Pradesh within a couple of days.

AIBSNLEA vide its letter dated 13.09.2017 had raised the issue regarding Non-payment of GPF advance / payments in Himachal Pradesh Circle with CMD BSNL, Member (Finance) Telecom Commission, Director (Finance) BSNL Board and other concerned officers of DoT / BSNL.  AIBSNLEA is thankful to CMD BSNL, Member (Finance) Telecom Commission, Director (Finance) BSNL Board and other concerned officers of DoT / BSNL.

18.09.2017  High Court of Kerala uphold FR 22.1.a.1 fixation for  O-JTOs .....

On 15-9-2017 Hon.High Court of Kerala  dismissed  WPC 23407/10 & 23850/10 filed by BSNL against the CAT Ernakulam order granting legitimate  fixation under  FR 22 1(a) 1 to officiating JTOs  .

BSNL filed 14 writ petitions in HONBLE Kerala High court against the FR 22 1(a) 1 pay fixation of officiating JTOs . From  year 2010 onwards these cases are pending with this court . During this period officiating JTOs   of other circles filed for fr22 1(a)1 protection cases . For all these cases favourable judgment were received from PCAT  New Delhi. However, BSNL  filed appeal in high court of  New Delhi .  New Delhi  high court dismissed this appeal with remarks that it  is  subject to the outcome of  pending cases in high court of kerala . BSNL  again went to supreme court . Supreme court also dismissed this SLP and  made same remarks that   the outcome of  the case is subjected to the verdict of  kerala Highcourt. Finally 15/09/2017 Honble kerala high court dismissed all 14 petitions with FR 22 1 (a) 1 . Now all officiating JTOS are  eligible for   FR 22 1(a) 1  and no Recovery will happen further on this fixation already done .

Through this verdict Officiating service protection is also to  be extended to the officiated services along with pending 78.2% fixation to all the erstwhile O-JTO comrades .

14.09.2017:Meeting with Director (HR) BSNL Board:-

GS, President, AGS (HQ) and AGS (Finance) met Dir (HR) BSNL Board and discussed regarding implementation of 3rd PRC recommendation in BSNL with 15% fitment benefit. Director (HR) mentioned that Committee Report on 3rd PRC report in BSNL CO is being finalized and efforts will be made to put in next week to the Management Committee of BSNL Board. Dir (HR) also informed that today Member (Finance) DOT has also called her to discuss the matter on 3rd PRC implementation in BSNL and she will pleaded in favor of its implementation with 15% fitment benefit only otherwise BSNL employees will be put in great financial loss. Similarly BSNL Pensioners will also put in loss. Dir (HR) appreciated our concern and assured to plead in support of 15% fitment benefit.

14.09.2017Meeting with Member (Services) DOT:-

GS, President met Member (S) DOT and discussed regarding clearance of DOT recommendations to DOE on payment of Pension Contribution on actual basis instead of maximum of the IDA Pay Scale. Member (S) informed that till now the matter has not been put up to him. However, as soon as he receives the BSNL's proposal from internal finance of DOT he will clear the file.

b) Implementation of 3rd PRC report in BSNL- We requested to support 3rd PRC recommendations implementation in BSNL with 15% fitment benefit. Member (S) mentioned that earlier he was dealing the matter but now Secy. (T) is looking into the matter. Now the matter has to be taken-up by CMD BSNL with Secy. (T), MOSC (I/C) and DOP&T with justification.

13.09.2017: Meeting of CHQ Office Bearers and Circle Secretaries stationed at New Delhi

Today, a meeting of the CHQ Office Bearers and Circle Secretaries stationed at New Delhi was held at New Delhi to discuss and finalize the strategies regarding successful implementation of the proposed Organizational Action Program by AIBSNLEA on 04.10.2017. Also decided to invite nearby circles to participate in the "Candle March" on 04.10.2017. All the General Secretaries of BSNL Unions and Associations have been requested to participate and support the Organizational Action program.

All the Circle / District Secretaries are  requested to hold their CEC / General Body meetings to mobilize the members, holding of press conference, press release, releasing posters, hand bills, banners etc  for successful implementation of the Organizational Action program.

a) 3rd PRC implementation with 15% fitment benefit in BSNL:- We requested CMD BSNL for getting an early approval of BSNL Board on 3rd PRC implementation with 15% fitment benefit in BSNL. CMD mentioned that matter is under active consideration and shortly it will be discussed in BSNL MC and thereafter in the BSNL Board for its approval. We requested to use his good office to convince DOT officers and Hon'ble MOSC (I/C) for its implementation. CMD BSNL further mentioned that he has discussed the matter with Hon'ble MOSC(IC) and he is in favor on 3rd PRC implementation in BSNL. He also appraised to Hon'ble MOSC(IC) that BSNL has already send a proposal to DOT of 3rd PRC report implementation with 15% fitment benefit even before the Cabinet Secretary meeting. CMD assured to continue his efforts in this regard.

b) Creation of BSNL's Tower Subsidiary:- We expressed our concern against creation of BSNL's Tower subsidiary by fragmenting the BSNL's assets. CMD mentioned that let him see the cabinet decision and its repercussions. AIBSNLEA is not in favor of Tower subsidiary.

a) CPC from CAO to DGM (Finance):- We requested to expedite CPC from CAO to DGM (Finance) to fill up about 66 DGM (Finance) posts. GM (FP) informed that CPC date has been fixed-up on 15/09/2017. He assured for early issuance of promotion order.

b) Relieving of AOs/CAOs under transfer from Chhattisgarh Circle to their choice circles even the transfer order were issued in Aril-2017. GM (FP) assured to relieve the officers through ERP shortly.

07.09.2017: GS, President met GM(SR) and discussed regarding  

a) Payment of pension contribution on actual basic pay instead of maximum of the pay scale: GM (SR) informed that matter is under consideration to DOT to reply DOE queries on BSNL proposal. The establishment cell of DOT yet to process the BSNLs reply on DOE queries for financial concurrence to the internal finance of DOT. GM (SR) mentioned that he is closely monitoring the developments and pursuing in DOT for positive reply to DOE. He further mentioned that in case BSNL request for payment of pension contribution on actual basic is considered by Govt. than BSNL will be saving 1600-1700 crores per annum and it will pave the way in getting implemented 3rd PRC in BSNL.

b) Special C/L to the Circle/ District level office bearers of AIBSNLEA. We further requested to allow special C/L to the Circle/ District level office bearers of AIBSNLEA. GM (SR) again assured an early action in this regard.

07.09.2017: Meeting with CGM (Legal) BSNL CO.

GS, President and AGS (Finance) met CGM (Legal) BSNL CO,  the member of the Committee on 3rd PRC and discussed regarding finalization of 3rd PRC report for submission to the Management Committee of BSNL Board for approval. CGM (Legal) informed that the committee report has been submitted to the GM (Estt.) for further necessary action. He expected that the next week the 3rd PRC recommendations will be put up in the Management Committee of BSNL Board and thereafter to the Nomination and remuneration committee having 4 members i.e. 2 independent Board of Director, 1 Govt. Nominee (DOT) Director and Director (HR) BSNL Board will discuss and after its approval it will be placed in the BSNL Board meeting with its agenda approval from DOT probably in the last week of September, 2017.

b) Legal opinion on SC/ST roster implementation on promotions in BSNL: CGM (Legal) mentioned that the PGM (Pers) BSNL CO has discussed the matter in detail wherein it has been advised to file one miscellaneous application in the Hon'ble Supreme Court seeking liberty to issue promotion orders on the basis of DOP&T guidelines subject to outcome of pending SLPs in the Hon'ble Supreme Court. Now PGM (Pers) has to deal the matter accordingly.

07.09.2017: Meeting with GM (FP), BSNL CO.

GS, President and AGS (Finance) met GM (FP), BSNL CO and discussed regarding.

a) CPC from CAO to DGM (Finance): We requested GM (FP) to expedite CPC from CAO to DGM (Finance) to fill up 66 DGM (Finance) vacant posts. GM (FP) mentioned that the CPC work is in progress, the VCRs of the eligible CAOs have been received. About 12 ACRs are yet to be received. He assured to expedite CPC before 15th September, 2017.

b) CPC from JAO to AO and AO to CAO: We requested to initiate CPCs from JAO to AO and AO to CAO. GM (FP) mentioned that the CPCs were initiated but could not be expedited due to the pending court cases on SC/ST roster implementation. Pers Cell BSNL CO is dealing the matter in consultation with CGM (Legal) and BSNL Sr. Advocate. After the clearance from the Pers Cell the CPCs can be expedited

c) Consideration of some request/ tenure transfers of AOs/CAOs/DGM (Finance): Also requested for relieving some AOs/ CAOs from Chhattisgarh Circle to their Parent Circles. GM (FP) assured to consider the pending cases and early issuance of the transfer orders.

GS, President met PGM (PF), BSNL CO and Chairman Committee on 3rd PRC and discussed regarding finalization of 3rd PRC report for submission to the Management Committee of BSNL Board for approval. PGM (PF) informed that today she has submitted the committee report to GM (Estt.) for further necessary action.

It is understood that committee has recommended 15% fitment benefit with some conditions wherein the main emphasis may be on 3rd PRC implementation in BSNL. With this BSNL will incurred additional Rs.272 Crores financial burden for executives and about Rs.725 Crores for non-executives wage revision wherein Basic +DA will be merged in new pay scale band which will increase the pension, commutation value and remove the stagnation in the existing scales. 15% fitment benefit the financial impact will be about Rs. 2500 Crores.

We have been pleading that 15% fitment benefit recommendations should go from BSNL to DOT to keep the BSNL employees motivated and for its growth. Now after the BSNL management committee approval the 3rd PRC proposal will be placed before the nomination committee of BSNL Board wherein independent and Govt. nominee Board of Directors will examine and approve, thereafter the agenda on 3rd PRC proposal with the clearance of DOT will be put up in the BSNL Board for its approval and it will be sent to DOT for approval and issuance of presidential directives. This whole process has to be closely monitored to ensure that the things are in positive direction.

06.09.2017: Meeting with GM (Estt.) BSNL CO:

GS, President met GM (Estt.) and discussed regarding implementation of 3rd PRC recommendations with 15% fitment benefit in BSNL by getting an early approval from BSNL MC and BSNL Board. GM (Estt.) confirmed that the committee report has been received in establishment cell and a MC note is being prepared to put up in the next Management Committee of BSNL Board.

06.09.2017: Meeting with PGM (Pers) BSNL CO:

GS, President and AGS (HQ) met PGM (Pers) and discussed regarding:-

a) CPC from JTO to SDE(T): We requested to get vacated the stay order on promotion from JTO to SDE(T) seniority quota from the Hon'ble High Court Kerala. PGM(Pers) mentioned that one complaint petition is being filed to the Hon'ble Chief Justice Bench of Kerala High Court for early pronouncement of the judgement. He assured an early action in this regard.

b) Posting on promotion of the JTO to SDE (T) LDCE quota: We requested to issue posting orders on promotion of the JTO to SDE (T) LDCE quota. PGM (Pers) mentioned that the SLP in the Hon'ble Supreme Court has been filed and simultaneously as suggested by legal cell BSNL CO the legal opinion of a Senior Advocate is being taken shortly to resolve the issue.

c) CPCs from SDE to DE and AO to CAO: We requested to resolve the SC/ST roster implementation issue on the basis of DOP&T guidelines and Court Judgements. PGM (Pers) mentioned that the SLP in the Hon'ble Supreme Court has been filed and simultaneously as suggested by legal cell BSNL CO the legal opinion of a Senior Advocate is being taken shortly to resolve the issue. PGM (Pers) estimated that this process may take minimum 2months time to resolve the issue.

d) CPC from DE to DGM (Engg.) left out cases: PGM (Pers) mentioned that due to the stay order granted by Hon'ble CAT Chandigarh on Catch-up Rule on SC/ST roster as held up the promotions. The matter has been referred to DOT /DOP&T for guidelines in this regard.

e) Consideration of request/ tenure transfer cases of SDEs/DEs/DGMs: We requested for consideration of request/ tenure transfer cases of SDEs/DEs/DGMs. PGM(Pers) assured to look into the matter.

06.09.2017: Meeting with GM(FP) BSNL CO. :

GS, President and AGS (Finance) met GM(FP) and requested for consideration of some request/ tenure transfers of AOs/CAOs/DGM (Finance). Also requested for relieving some AOs/ CAOs from Chhattisgarh Circle to their Parent Circles. GM(FP) assured to examine the cases and for an early action in this regard.

05.09.2017: Meeting with CMD BSNL:

GS, President and AGS (F) met CMD, BSNL and discussed regarding:

(i) Implementation of 3rd PRC report in BSNL: We requested to implement 3rd PRC recommendations with 15% fitment benefit in BSNL by getting an early approval from BSNL MC and BSNL Board. Also requested to use his good office in DOT to get approved 3rd PRC recommendations with 15% fitment benefit in BSNL. CMD, BSNL mentioned that shortly the matter will be discussed in the Management Committee of BSNL Board and thereafter in BSNL Board for its approval. He further mentioned that first DOT should allow implementation of 3rd PRC in BSNL. The fitment benefit 5%, 10% or 15% may be left with BSNL Board to implement in 2nd phase. We requested that BSNL Board should recommend 15% fitment benefit in its approval. It should not be left pending for 2nd phase. But CMD remained non-committal on this issue and mentioned that let us wait and watch the approval of BSNL MC/ BSNL Board.

It is understood that the BSNL Management is refraining to recommend 15% fitment benefit. In view of this all BSNL Unions/Associations should immediately mount pressure on BSNL Management for implementation of 3rd PRC with 15% fitment benefit only.

(ii) Extension of Night Free Calls to Gr. A officers to concessional residential telephone also: We requested for extension of Night Free Calls on the concessional telephones of Gr. "A" officers also. CMD BSNL mentioned that Group-A officers should sacrifice this facility and set the example. We pleaded that normally even the free calls are not being exhausted but this facility will allow Group-"A" officers to use night free calling facility in the interest of BSNL only.

05.09.2017:  Meeting with Director (HR), BSNL Board, New Delhi

GS, President and AGS (F) met Director (HR) and discussed regarding:

A. implementation of 3^rd PRC report in BSNL: We requested to get approved 3^rd PRC recommendations with 15% fitment benefit from BSNL MC and BSNL Board for its implementation in BSNL.  Director (HR) mentioned that the internal committee is finalizing its report. Just thereafter it will be put up to the BSNL MC and BSNL Board for approval.

B. Extension of Night Free Calls to Gr. "A" officers also: We requested for extension of Night Free Calls on the concessional telephones of Gr. "A" officers also. Director (HR) assured to discuss the matter with CMD (BSNL).

C. Settlement of some pending issues of BSNL pensioners viz. Non-payment of medical reimbursement (Without Voucher), Abnormal delay in payment of medical reimbursement (With Voucher), Tracking of Medical bills and formation of Pensioners Relation (PR) Cell: We requested for the settlement of above issues. Director (HR) assured to discuss the matter with GM (Admn) and also advised us to have a meeting with GM (Admn) to discuss these issues immediately. She also mentioned to open PR Cell under the control of GM (EF), BSNL Corporate Office.

05.09.2017: Meeting with GM (SR) BSNL CO, New Delhi

GS, President and AGS (F) met GM (SR), BSNL CO and discussed regarding:

a) Payment of pension contribution on actual basic pay instead of maximum of the pay scale: GM (SR) informed that matter is under consideration to DOT to reply DOE queries on BSNL proposal. The establishment cell of DOT has processed the reply for financial concurrence to the internal finance of DOT. GM (SR) mentioned that he is closely monitoring the developments and pursuing in DOT for positive reply to DOE. He further mentioned that in case BSNL request for payment of pension contribution on actual basic is considered by Govt. than BSNL will be saving 1600-1700 crores per annum and it will pave the way in getting implemented 3rd PRC in BSNL.

b) Special C/L to the Circle/ District level office bearers of AIBSNLEA. We requested to allow special C/L to the Circle/ District level office bearers of AIBSNLEA. GM (SR) assured an early action in this regard.

05.09.2017: Meeting with GM (Admn) BSNL CO, New Delhi

GS, President and AGS (Finance) met GM (Admn.) and discussed regarding settlement of some pending issues of BSNL pensioner's viz. Non-payment of medical reimbursement (Without Voucher), Abnormal delay in payment of medical reimbursement (With Voucher), Tracking of Medical bills and formation of Pensioners Relation (PR) Cell. GM (Admn) after detailed discussions assured to take early steps for the settlement of above issues of BSNL pensioner's.

05.09.2017:  Stay on implementation of DOT order dated 05.07.2017 for withdrawal of additional increment by fixation in same scale on post based promotion under EPP - Orders from BSNL CO:

Consistent efforts of AIBSNLEA yielded results in getting released the orders from BSNL Corporate Office for keeping the implementation of DoT order number 40-12/2004-Pen(T)(Pt) dated 05.07.2107 in abeyance till further order both in case of serving as well as retiring employees. <<<Click here for the order>>>

It may be recalled that AIBSNLEA had filed an OA vide O.A./100/2649/2017 in Hon'ble Principal Bench CAT New Delhi against the DOT order dated 05.07.2017 for withdrawal of additional increment by fixation in same scale on post based promotion under EPP. Similarly, Com. Karan Singh, Advisor (North), CHQ, AIBSNLEA along with 27 applicants also filed case in the Hon'ble CAT Jaipur & Hon'ble High Court, Jaipur against the DoT Order dated 05.07.2017. Hon'ble CAT Jaipur has granted stay order on re-fixation of pay & recoveries as per above said order.
