31.05.2012: GS, President & CS Delhi Circle met CVO BSNL on 29.05.2012 in the presence of DY. CVO and discussed:-

(a)  With reference to our earlier communication to CMD BSNL & CVO regarding early settlement of long pending disciplinary cases. We expressed our concern against no settlement of the long pending disciplinary cases even after completion  of 9-10 years. Abnormal delay in settlement of disciplinary cases has caused problem to retiring executives. CVO informed that in response to our communications and other representations CMD BSNL has now directed to all the CGMs that they should review the status of pending disciplinary cases on monthly basis by discussing with DGM(Vig.) of the Circle and they should ensure that IOs/Pos are appointed and they complete inquiry proceeding in due time. He also mentioned that BSNL Corporate Office Vigilance cell  is also monitoring the progress in this regard. It has resulted in speeding up of the settlement of the long pending cases.

(b) Inter Circle transfer of executives whose names are visible in the ODI list: We requested to take up the matter with DoT to modify the direction of inter Circle transfer of executives whose names are visible in ODI list. Inter Circle transfer are giving financial loss to individuals as well as BSNL. CVO clarified that it is an administrative order of DoT which can be taken up by CMD/Director(HR) only  with DoT for modification i.e. transfer from sensitive post in same Circle.

(c) Delay in imposing penalty on retired employees: CVO mentioned that on their persuasion DoT/CVC has clarified the procedure for imposing penalty on BSNL pensioners after completion of disciplinary proceedings and most of the pending cases are now being settled.

31.05.2012:   MASSIVE DEMONSTRATION AND DHARNA ON 31st May'2012: FORUM of BSNL Unions/Associations agitation call for demanding 78.2% IDA fitment benefit and revision of allowances as recommended by 2nd PRC implementation has been very successfully implemented through out the country except few Circles/Stations where it could not be conducted due to political parties "Bharat Bandh" agitation call. These Circles/ stations will hold demonstration  tomorrow on 01.06.2012.

DHARANA PROGRAMAME at BSNL Corporate Office has also been successfully implemented whole day. All the General/Circle Secretaries of BSNL Unions/Associations addressed the members. They resented against indifferent and discriminatory attitude of the ITS dominated Management, who is giving undue benefits to the non optee ITS officers but denied the legitimate benefits as per the recommendations of 2nd PRC and DPE orders. They categorically told that FORUM will continue its agitational programme till the time 78.2% IDA fitment in pay and revision of allowances as per 2nd PRC recommendations are implemented in full. They called upon all BSNL employees to make grand success  of one day DHARANA on  6th June 2012 and indefinite strike with effect from 13th June 2012. BSNL Management will be holding meeting with the leaders of Forum on 01.06.2012 at 1030 hrs. But, the indications are there that BSNL management is not at all inclined to implement FORUM demands. Hence, we are to continue to prepare for making indefinite strike a complete success. After issuance of 25th May 2012 BSNL CO order regarding payment of Allowances as per the recommendations of 6th CPC to Group- 'A' officers on deemed deputation in BSNL. There is no justification to deny implementation of DPE order on the recommendations of 2nd PRC for BSNL employees. Let us, make this agitation call is successful and memorable one. It is the struggle of justice against long exploitation and humiliation.

31.05.2012 : CEC MEETING OF KARNATAKA CIRCLE ON 26.05.2012: A memorable and very mammoth gathered CEC Meeting was held at Bangalore on 26/05/2012. All the 26 Districts except  Gulburga, Bidar, Shimoga and Mobiles were attended.  CEC meeting started at 1000 AM with welcome remarks by Com. M R Nagaraj Pres. after paying respect to the departed comrades. Com S K Hiremath DS, BGTD welcomed gathering. Com R B Athani AGS(Engg),CHQ and Com B S Reddy OS(South),CHQ attended and addressed. They spoke on the Viability of BSNL, Organisational issues and Field problems etc. Com. 30.05.2012: Hon'ble High Court Kerla at Ernakulam  interim order on 147 SDEs (LDCE Quota) case:  Hon'ble High Court Kerala at Ernakulam delivered  interim order on 147 SDEs of LDCE seniority case vacating the stay of promotions. It has paved the way for promotion from DE to DGM. Hon'ble High Court Kerala has not  reverted the judgement of Hon'ble CAT Ernakulam on 147 SDEs(LDCE Quota) wherein the retrospective  date of seniority given to 147 SDEs LDCE Quota was quashed.

28.05.2012: Forum of BSNL Unions/Associations meeting held today : In response to BSNL's order no. 15-01/2012-PAT(BSNL) dated 25^th May'2012, the Forum of BSNL Unions/Associations met today and strongly resented against the discriminatory attitude of BSNL Management wherein deputationists are being given all 6^th CPC benefits but BSNL absorbees are being denied implementation of DPE orders dated 26th Nov'2008 and 2nd April'2009 of pay & allowances. Forum strongly demanded immediate implementation of DPE OMs and decided to resort the following Trade Union Action Programmes:-

(i)              Massive Demonstrations at all Circle/SSA HQs and day long DHARNA at BSNL Corporate Office on 31^st May'2012

(ii)            MASS DHARNA at BSNL CO/Circle/SSA HQs on 6^th June'2012

(iii)          Indefinite Strike w.e.f 13^th June'2012

Forum strongly demanded for immediate implementation of DPE OM dated 26^th Nov'2008 and 2^nd April'2009 on the following issues

The Forum will issue Trade Union Action notice tomorrow. The earlier programmes of Trade Union Actions decided with JAC Charter of demands is temporarily suspended in view of the present situation.

28.05.2012: Com. GS, President, AGS(HQ), FS, Circle Secretaries of AIBSNLEA BSNL CO and Delhi Circle along with all  BSNL Unions/Associations representatives met Director (Finance) BSNL and strongly resented against the indifferent and discriminatory attitude of BSNL Management towards BSNL employees wherein the DPE OM's dated 26^th Nov'2008 and 2^nd April'2009 regarding revision of scales of pay and allowances w.e.f. 01.01.2007 have not been implemented in full whereas the 6^th CPC recommendations for payment of allowances to ITS Officers on deemed deputation in BSNL have been implemented in full vide BSNL order no. 15-01/2012-PAT(BSNL) dated 25^th May'2012 i.e.

We condemned Director (Finance)'s undue support to ITS dominated management who gives all BSNL's benefits to non-opttee officers as cadre fertanity and denies the legitimate benefits to BSNL employees.

Forum categorically told that  against the non-implementation of the DPE OMs on 2^nd PRC recommendations related to Pay & Allowances of BSNL Employees, BSNL Unions/Associations will resort harder Trade Unions Action  Programmes. Director (Finance) assured to study the matter  & to apprise our feelings to  CMD, BSNL who is on tour upto 30^th May'2012.

25.05.2012: GS, President and FS met ED(NB) and discussed regarding

(a) Posting on promotion from SDE(TF) to AGM(TF): We requested ED(NB) for issuance of posting order on promotion from SDE(TF) to AGM(TF) since the DPC has been completed two months before. ED(NB) mentioned that the proposal for posting on promotion was sent to Pers. Cell for clearance. But pers cell has withheld the proposal in view of the Hon'ble Chandigarh Court direction for ensuring proper implementation of SC/ST roaster. However, he assured on early action in this regard.

(b) Filling of SE(E) vacant posts: We requested to fill up vacant SEs(E) vacant posts by giving one time relaxation in the eligibility condition to EEs(E) as per BSNL MSRRs. ED(NB) assured to further take up the matter with the competent authority for relaxation.

(c) Consideration of request/tenure transfer of SDEs/EEs(E) wing:We requested to consider pending request /tenure transfer cases of SDEs/EEs(E) wing. ED(NB) assured to look into the matter.

25.05.2012: Meeting of all Unions & Associations of BSNL decide to launch struggle : An all Unions and Associations of BSNL meeting was held at New Delhi on 23.05.2012. BSNLEU, NFTE, SNEA, AIBSNLEA, SEWA BSNL, BSNL MS, WRU, ATM, BTEU etc. participated in the meeting. The meeting expressed it's deep dissatisfaction over the non-settlement of ITS repatriation. Even after the lapse of one year, management has not shown any interest to procure mobile equipments, telephone instruments, modems, cable, OFC and other maintenance materials which has seriously affected the financial recovery of BSNL. The UPA government is showing total indifference to settle the demands of the Unions & Associations, connected with BSNL's viability. GS and President attended the meeing.

Hence to compel the management and government to settle the issues, the following agitational programme will be launched.

25.05.2012: GS, President met Sr. GM(Pers.) and discussed regarding

(a) DPC from DE to DGM: We requested to get early clearance from BSNL MC to fill up vacant DGM Posts by giving one time relaxation in the eligible condition to DEs. Sr. GM(Pers.) informed that as per the direction of MC the case has been sent to Finance Wing for vetting and on finance clearance, it will be sent to MC for approval.

(b) Immediate holding of DPC to fill up vacant TES Group-'B' Seniority cum fitness quota posts: We expressed our resentment for non holding DPC to fill up vacant SDE(T) posts of seniority quota since more than 3000 SDEs posts are lying vacant. We also pleaded that LDCE unfilled SDEs posts are to be strictly filled up as per the DoP&T guidelines in this regard. GM(Pers.) assured to look into the matter.

25.05.2012: GS, President met ED(Fin.)  and requested her to give early financial concurrence to the Pers. Cell proposal of filling up of vacant DGM posts. ED(Fin.) assured to clear the case today and will sent to Director (EB). And now it is learnt that the case has been cleared from Finance Wing and sent to Director (EB) for consideration.

24.05.2012: GS, FS, AGS(HQ) met Director(EB), BSNL and discussed

(a) DPC from DE to DGM(Engg.): We requested Director(EB) to fill up  414 DGMs(Engg.)  posts from MC by giving one time relaxation in the eligibility criteria  to DEs as per BSNL MSRRs. Director(EB)  assured an early  action in this regard.

(b) Generalization of Judgment dated 26/04/2011 of Hon'ble CAT Bangalore in OA No. 181/2009 filed by Shri K S Premkumar and 123 others- Extending the benefit of notional date of promotion and fixation of pay w.e.f. 23.01.2002 and actual benefits from 01.04.2008 to similarly placed other candidates: We requested Director (EB) to generalize the above mentioned judgement to similarly placed other candidates. Director(EB) mentioned that financial implications are being examined in this matter and he  assured an early decision.

25.05.2012:GS, President and FS met GM (Estt) and discussed regarding

(a) Removal of pay anomaly of Departmental JAOs./JTOs appointed after 07.05.2010: We requested GM(Estt) to resolve the pay anomaly by allowing option to all the candidates who were appointed JAO/JTO after 07.05.2010 as one time measure. GM(Estt) informed that the Committee headed by PGM(SR) has already discuss the matter in its first meeting on 18.05.2012 and shortly the next meeting will take place wherein the final decision in this regard will be taken  shortly.

(b) Antidating of DNI case: GM(Estt) informed that case been sent to EF Cell for examination and shortly some solution will be taken in this regard.

(c) Regularization of Offtg. JTOs: In accordance with our letter No. AIBSNLEA/CHQ/CMD/2012-13 Dated:15.05.2012, we requested to examine the case and take necessary steps to settle the problems of Offtg. JTOs. GM (Estt) assured to look into the matter.

22.05.2012 : GS, President, AGS(HQ) met Sr. GM(Pers.) and discussed

(a) DPC from DE to DGM(Engg.): We enquired about the outcome of the last MC Meeting wherein some query has been made on promotion DE to DGM(Engg.) [ 414 DGMs posts] by giving one time relaxation in the eligibility criteria  as per BSNL MSRRs. Sr. GM(Pers.) mentioned that MC has asked the financial implication to promote 414 DEs to DGMs(Engg.) and the case has been sent to EF Cell for examination of financial implications. He spoke with Director(Fin) & GM(EF) for sending comments early so that the same may be again sent to next MC for approval. We expressed our unhappiness against the delay tactics being adopted.

(b) DPC from JTO to SDE(T): We requested to expedite DPC from JTO to SDE(T). Sr. GM(Pers.) mentioned that the Circles have been asked to sent JTOs corrected Circle gradation list at the earliest to finalize the JTOs seniority list on All India basis and thereafter DPC will be completed.

(c) Consideration of pending request / tenure transfers of SDEs/DEs: We requested  that lot of requests(Own Cost) of SDEs/DEs are not considered on the pretext that their names are available in the tenure transfer list taken from Circles.  Sr. GM(Pers.) asked AGM(Pers.) to examine those cases.

(d) DPC from SDE to DE: We requested to expedite DPC to fill up vacant DEs posts on Adhoc/Regular basis. Sr. GM(Pers.) mentioned that DPC process has been initiated but due to pending court cases in Hon'ble Courts Jabalpur, Mumbai, Chandigarh and APEX Court on TES Group-'B' seniority lists, DPC is being delayed. However, he opined that after summer vacation in the month of July'2012 some court cases may be disposed off. Thereafter only the promotion order can be issued.

(e) DPC from CAO to DGM(F): We requested to give early clearance to fill up the vacant DGM(F) posts by giving one time relaxation to CAOs in the 4 years regular service  in STS as per BSNL MSRRs. Sr. GM(Pers.) immediately asked AGM(Pers.) to process the case for early clearance. AGM(Pers.) mentioned that the proposal sent by SEA Section is being examined and comments will be given soon.

(f) Filling up of SE(E) vacant posts: We requested to give clearance to PGM(E) for filling up of vacant SE(E) posts by giving one time relaxation in the eligibility criteria to EEs(E) as per BSNL MSRRs. Sr. GM(Pers.) assured to examine the case.

(g) Posting on promotion to AGM(TF) Posts: We requested to give clearance for posting on promotion to AGM(TF) posts as the DPC completed  two months before. Sr. GM(Pers.) informed that due to Hon'ble Court Chandigarh direction on improper SC/ST roster implementation. He also mentioned that the roster is being properly examined and thereafter only promotion order will be issued.

(a)   DPC from CAO to DGM(F): We requested to initiate DPC to fill up vacant DGM(F) posts. GM(TP&RA) informed that the left out DPC to DGM(F) was completed long before but due to stay given by SC/ST Commission Lucknow Bench the promotion order could not be issued. However, efforts arebeing made to get clearance in this regard. He also informed that the proposal to fill up vacant DGM(F) posts has been sent to Pers. Cell for clearance to put MC for approval. The clearance is awaited.

(b)   DPC from AO to CAO on adhoc/regular basis: GM(TP&RA)  informed that after the MC approval to fill up vacant CAOs posts, the DPC process is in progress and efforts are being made to issue early promotion order.

(c)   DPC from JAO to AO: We requested to expedite DPC from JAO to AO. GM(TP&RA)  assured an early action in this regard.

(d)   Consideration of request/tenure transfer cases of AOs/CAOs/DGM(F): GM(TP&RA)  assured to examine the pending cases for an early action.

PS of Kerla Circle Petitioners attended personal hearing on 15.05.2012 with CMD BSNL as per the Hon'ble CAT Ernakulam direction to BSNL in the WP no. 142/2011. During personal hearing we pleaded for implementation of BSNL's EPP and orders issued based on Shri Pradeep Nagpal, Sr. GM, BSNL CO Committee report and Sh. K.C.G.K. Pillai, PGM (FP) Committee Report in true spirit in Kerala Circle to avoid further litigations. CMD directed concern officers of Pers. Cell to reply brief of Meeting within a period of 30 days. He assured that BSNL's Policy will not be violated in this regard. Director (EB), Sr. GM (Pers.), Addl. GM (Pers.) and AGM (Pers.) were also present in the meeting.

18.05.2012: STATUS OF ITS OFFICERS ABSORPTION ISSUE:  Hon'ble High Court,  Delhi outrightly dismissed the modification application filed by BSNL seeking 25 months time for repatriation of unabsorbed ITS officers working in BSNL.Even desperate plea made by the BSNL counsel to give time upto 31st December, 2012 was rejected by the Hon'ble Court. Hon'ble HC while dismissing the application of BSNL directed it to complete repatriation process by 30th Sept, 2012.

Intervention application was filed by AIBSNLEA, BSNLEU and SNEA(I). Even though the intervention application was also dismissed, yet counsel appearing for these Associations/unions strongly opposed the move of ITS controlled BSNL Management for extension of time. Intervention application was not admitted on technical grounds since we are not party in the original application.

Further course of legal action is being discussed with our counsel.  

17.05.2012: GS, AGS(HQ) met Sr. GM(Pers.) and extended sincere thanks for getting the approval of BSNL MC to fill up 414 DGMs posts by DEs, giving one time relaxation in the eligibility criteria  as per BSNL MSRRs and requested to expedite DPC. Sr. GM(Pers.) appreciated our concern and informed that shortly Pers. Cell is submitting application for clarification to Hon'ble High Court Ernakulam Kerala for 147 SDEs (of LDCE quota) inclusion or deletion as per the Hon'ble CAT Ernakulam judgement. The case is coming for hearing on 22^nd May'2012.

(b) DPC from JTO to SDE(T): We requested to expedite DPC from JTO to SDE. Sr. GM(Pers.) mentioned that the Circles have been asked to sent JTOs corrected Circle gradation list at the earliest to finalize the JTOs seniority list on All India basis and thereafter DPC will be completed.

17.05.2012: JAC meeting with CLC: GS, President along with JAC Members attended the meeting with Chief Labour Commissioner (CLC) in his office and discussed the demands of JAC raised during 15^th December'2011 Strike. In the presence of PGM(SR), GM(Estt.), DGM(SR), AGM(SR) and other senior officers of CLC the JAC demands on VRS and repatriation of ITS Officers were discussed in detail. Remaining demands will be discussed on 30.05.2012 in CLC Office. However, CLC directed BSNL Management that on VRS issue BSNL Management should discuss BSNL Unions/Associations on realistic basis and try to convenience them with their decision and also directed BSNL Management to explain that how the vacant posts of DGM are going to be filled up etc. <<Click Here for the reply given by the management>>

16.05.2012:GS, President & GS, President SNEA(I) met Director (EB), BSNL & extended sincere thanks for getting approval from BSNL Management Committee held on 15.04.2012 to fill up 414 DGM(Engg.) posts  from DE (Regular/Adhoc) by granting one time relaxation in eligibility criteria as per BSNL MSRRs. It has paved the way to complete the DPC Process for DGM(Engg.) promotion.

(b) We expressed our serious resentment against mass transfers of DEs by CGMT Bihar Circle & his un-helping attitude. Director (EB) immediately spoke to CGMT, BH, who happens to be available in BSNL Corporate  & called him to discuss the matter. CGMT, Bihar in the presence of Director (EB) assured to discuss the matter by tomorrow again after reaching Patna with the Executives Associations' to resolve the issue.

(C) ITS Officers absorption issue: We expressed our serious concern against filing a modification/Clarification application by BSNL in the Hon'ble High Court Delhi in the W.P. (Civil) no. 22515/2005 and order dated 17.04.2012 in the matter of ITSA Verses Union of India & Ors praying to grant 25 months time to BSNL to relieve the ITS Officers back to DoT in phased manner. We pleaded that further continuation of ITS Officers in the present status (since they have opted DoT) will adversely affect the viability of BSNL. Relieving of non-optee ITS Officers will not affect much to BSNL, if BSNL Management gives responsibility to its absorbed Executives and in case, some SAG/HAG level officers are required, BSNL may immediately recruit from Open Market. Director (EB) mentioned that it is DoT to complete the absorption process of ITS Officers but the fact remains that bulk release of ITS Officers will affect the functioning of BSNL. In view of this, BSNL Management has filed modification/clarification application in the Hon'ble High Court Delhi and during these 25 months period alternative arrangement will be made. We further explained that more than 63 absorbed ITS Officers of JAG/SAG/HAG rank, about 200 JAG/SAG/HAG level officers of  other disciplines and about 1000 regular STS level Group-'A' officers absorbed in BSNL are available to own the responsibility immediately. Even than if, some SAG/HAG level officers are further required may be recruited from Open Market. Hence, BSNL Management should not run behind non-optee ITS Officers to retain them in BSNL. Their further retention will adversely affect the Viability of BSNL.

(b)  Posting on promotion from SDE(TF) to AGM(TF): We expressed our concern against non-issuance of posting order of AGM(TF) on promotion since DPC was completed two months before. ED(NB) informed that after DPC completion, the posting on promotion proposal has been sent to the competent authority  for approval. However, he assured an early action in this regard.

15.05.2012: GS, AGS(HQ), Sh. K. Sebastin, GS SNEA(I) and Sh. Ravi Shil Verma, VP, AIGETOA met Sr. GM(Pers.) to hold early meetings of Committee headed by PGM(FP) on the demands of United Forum i.e. CPSU Cadre hierarchy, E1A & E2A Pay Scales and re-diversion of 600 Sr. DGM Posts. Sr. GM(Pers.) mentioned that shortly separate Committee meetings are being conducted on CPSU Cadre Hierarchy and E1A& E2A IDA Pay Scales convened by restructuring & PAT Sections. The Sr. DGM recruitment process is held up, hence re-diversion of 600 DGMs Posts is no issue now.

11.05.2012:GS, President & GS, President SNEA(I) met Director (EB), BSNL and discussed

(a) Mass transfer of executives in Bihar Circle- our protest against: We strongly protested against the mass transfers(36 out of 108) of DEs (including Officiating promotions), which is involving huge wasteful expenditure. CGMT Bihar Circle has told that BSNL have sufficient fund to meet the expenditure incurred in mass transfers whereas large number of employees claims are pending in Bihar Circle due to non-availability of funds. United Forum is on agitation programme since 9th May'2012 against these mass transfers & indifferent & harassing attitude of CGMT, Bihar Circle. Director (EB) after detailed discussions assured to look into the matter.

(b) Modifications in BSNL Executives transfer policy- our protest against:  We expressed our serious concern against increasing the tenure of transfer period of soft tenure station from two years to three years which contradicts to the Govt.'s transfer policy provisions as well as against Para II (d) i.e. "the Executives being posted in Soft Tenure from within the Circle may not be allowed to revert to the same SSA from where they were transferred, at least for one post tenure" which has defeated the very purpose of dealing with soft tenure stations. Director (EB) after discussions assured to re-examine the issue.

(c) DPC to fill up vacant DGM(Engg.), DE(T), SDE(T) & DGM(Fin) posts: We requested Director(EB) to get approval of MC for filling up of DGM(Engg.) & DGM(Fin) vacant posts as well as to hold DPC to fill up vacant DEs posts on regular/adhoc basis. Similarly to fill up all vacant SDEs posts. Director(EB) assured to look into the matter.

10.05.2012:GS, President & AGS (HQ) met GM(Estt.) and discussed

a) Finalization of JTOs gradation list for TES Group -'B' Promotion: We requested that after delivering of the court judgement by Hon'ble CAT Chennai on finalizing the JTOs gradation list on the basis of year of recruitment. The necessary direction is to be issued to all Circles for preparing the JTOs Circle gradation lists and to sent to BSNL CO Pers. Cell for preparing the JTOs eligibility list and to hold DPC to fill up about 3500 vacant SDEs(T) posts. GM(Estt.) appreciated our concern and assured that by tomorrow the Court direction will be uploaded on BSNL CO site and it will be sent to Sr. GM(Pers.) for further necessary action. 

b) Pay anomaly case of Departmental JAOs: We requested to clear the pay anomaly case of departmental JAOs processed by PAT Cell. GM(Estt.) informed that a committee has been formed headed by PGMSR), Sr. GM(Pers.), GM(Estt.), GM(EF) and GM(FP) are the  members for the same and the meeting of the said committee will be held on 18^th May'2012. He assured that soon the Committee will reach to some conclusion to resolve the issue.

c) Regularization of Officiating JTOs:  We enquired about today's proceedings of Hon'ble High Court Chandigarh in JTOs case.  GM(Estt.)   informed that the case is now posted for hearing on 30^th July'2012 in lieu of demanding Hon'ble High Court Ernakulam  Judgement copy on this issue.

d) Court Case against creation of super-numeric posts of JTOs and allowing these JTOs in LDCE-2012: Com. GS briefed about the court case filed by some executives in the Hon'ble High Court Chandigarh against creation of 3500 super-numeric posts of JTOs and allowing them to appear in the TES Group-'B' LDCE-2012, wherein applicants have requested that  since creation of 3500 super-numeric posts are under litigation so  the LDCE conducted is illegal, hence it should be cancelled and LDCE result should be stayed. Hon'ble Court has admitted the case and the next date of hearing is posted on 17^th May'2012. GM(Estt.) immediately discussed the matter with Addl. GM(Estt.) and AGM for filing immediate reply and assured to look the matter personally.

e)  Restructuring of AD(O/L) Cadre:- We requested to speed up the Committee work looking on  Restructuring of AD(O/L) Cadre. GM (Estt.) informed that today meeting of the Committee headed by Addl. GM(Estt.) was held. He assured to discuss the matter with Addl. GM(Estt.).

f)    Anti-dating of DNI wherein seniors are drawing less pay then juniors: We requested to settle long pending issue of anti-dating of DNI wherein seniors are drawing less pay then juniors. GM(Estt.) mentioned that yesterday only he has discussed the matter with AGM(PAT) and assured an early decision on this issue.    

g) Conciliation Proceedings by CLC: The conciliation proceedings will be started by the Chief Labour Commissioner (CLC) on the December 15 strike w.e.f  17^th May'2012 with JAC.    

10.05.2012:GS, President & AGS (HQ) met Sr. GM(Pers.) and discussed

(a)   DPCs to fill up vacant DGM, DE and SDE(T) Posts: We requested to expedite DPCs to fill up vacant DGM, DE and SDE(T) posts.  Sr. GM(Pers.) mentioned that Pers. Cell is doing its best to get resolve all the Court Cases of TES Group-'B' seniority related. In some cases i.e. JTO to SDE(T) DPC can now be conducted since court case is cleared, DE to DGM DPC is held up due to 147 SDEscase and the judgement from Hon'ble High Court, Ernakulam  is awaited on 22^nd May'2012 but SDE to DE promotion   some court cases are still creating hurdles for that any way out, if any, can be suggested by the associations so that an early action can be taken to hold DPC.

 (b) Consideration of pending request / tenure transfers of SDEs/DEs: We informed that in most of the Circles transfer request register is maintained and if such practice is started at BSNL Corporate Office and same is uploaded on the website for transparency, the transfer / posting issue will be smoothened.  Sr. GM(Pers.) discussed the matter with AGM(Pers.) to smoothen the process. However, he assured that issue will be examined to start such practice in near future.

(c) Modifications in BSNL Executives transfer policy- our protest against:  We expressed our protest against increasing the tenure of transfer period of soft tenure station from two years to three years which contradicts to the Govt.'s transfer policy provisions as well as against Para II (d) i.e. "the Executives being posted in Soft Tenure from within the Circle may not be allowed to revert to the same SSA from where they were transferred, at least for one post tenure" which has defeated the very purpose of dealing with soft tenure stations. As per the revised policy one executive will have to be away from his parent station for the next six years thereafter only he will be exempted from inter-Circle transfer liability. With these provisions no executive will like to serve these soft tenure stations from the same Circle, rather he will prefer to go to some nearby Circle on Inter-circle transfer basis and will come back to his parent station after three years (Govt. Cost). In this manner these soft tenure  stations will continue to suffer with shortage of executives/staff. Hence, this order need immediate modification. Sr. GM(Pers.) after detail discussions assured to look into the matter.

(d) Restructuring of AD(O/L) Cadre: Sr. GM(Pers.) informed that today the Committee on this issue is meeting. He assured to discuss the matter with Addl. GM(Estt.), Chairman Committee for an early action.

AAOs / JTOs(LA) and Sr. AOs / Sr. SDEs as per clarification under the EPP vide letter No. 400-175/2007-Pers.I dt 19.02.2002 and the issue of pay anomaly of certain seniors drawing less pay than juniors due to implementation of IDA pay up gradations under the EPP.

07.05.2012:Special General Body Meeting at Nagarcoil, Tamilnadu Circle on 3^rd May'2012: Com. GS, AGS(Engg.)  attended and addressed the Special General Body Meeting of AIBSNLEA, Nagarcoil Branch, Tamilnadu Circle. Com. V. Rajgopal, President, Com. Rajamani, DGM(F) and Com. Selvelraj, Br. Secy NagarCoil Branch in the welcome address discussed local issues, Circle level issues and All India level issues mainly ITS absorption, Procurement of Materials and financial Viability of BSNL.

Com. GS inaugurated the AIBSNLEA flag hoisting Mast infront of the Nagaecoil Telephone Exchange.  Com. GS in his address appreciated the functioning of the branch and its members contribution wherein the Nagarcoil SSA is one of the best SSA of Tamilnadu Circle and earning profit for BSNL. He explained in details regarding AIBSNLEA and JAC efforts for the Procurement of Stores i.e. Cables, Telephone Instruments, BB Modems, Drop Wires etc for day to day maintenance and 15 million GSM lines equipment alongwith IN equipment etc. He also explained that due to untiring efforts of AIBSNLEA the important HR issues of executives i.e. EPP, Perks, Transparent Transfer Policy, BSNL MSRRs, 2^nd PRC implementation with 30% fitment benefit, filling up of the vacant JAG/STS/STS/Group-'B' level vacant posts and many more issues were got settled. Again, sincere efforts are being made for filling up of all vacant JAG/STS/Group-'B' level vacant posts in all disciplines. He  further explained upon that efforts are being made through JAC to get settled the ITS absorption issue, 78.2% IDA fitment fixation benefit, stopping VRS, disinvestment and unbundling of last mile copper conductor etc.

Com. GS appealed to provide best Telecom Services to our valued customers in the available resources to make a success of "Customer Delight Year-2012-13".

Com. R.B. Athani, AGS(Engg.) in his address appreciated the growth of AIBSNLEA in Tamilnadu Circle and the functioning of its Branches. He also mentioned that in true sense AIBSNLEA is safeguarding the interest of BSNL Executives of all disciplines irrespective of major or minor cadres.  He assured that he is always available to any help to TN Circles as AGS(Engg.)

(a)    DPCs to fill up vacant DGM, DE and SDE(T) Posts: We requested to expedite DPCs to fill up vacant DGM, DE and SDE(T) posts. We requested to take early clarifications from courts to consider the executives for promotion whose seniority is not disputed and the disputed seniority of SDEs may be considered subject to the outcome of the court cases keeping sufficient vacant posts for them. Sr. GM(Pers.) assured to look into the matter.

(b) Consideration of pending request / tenure transfers of SDEs/DEs: Sr. GM(Pers.) informed that all the pending request / tenure transfer cases are being examined and shortly transfer orders will be issued.

(a)    DPCs to fill up vacant DGM, CAO and AO posts: We requested to expedite DPCs from JAO to AO and AO to CAO. Similarly to initiate DPC from CAO to DGM (Fin). Director(Fin) mentioned that the DPCs from JAO to AO and AO to CAO are in progress but some missing ACRs are yet to be received by BSNL Corporate Office. He also assured to get the approval of Management Committee to fill up vacant DGM (Fin) posts. However, he assured for an early action to fill up all vacant DGM, CAO and AO posts.

(b)   Consideration of request/tenure transfers of AOs/CAOs/DGMs (Fin): We requested for consideration of request/tenure transfers of AOs/CAOs/DGMs (Fin). Director(Fin) assured an early action in this regard.

(c)    Affairs of TN Circle, wherein GM(F) is indifferent to the executives: We expressed our serious concern against the indifferent attitude of GM(F) towards BSNL executives. Director(Fin) assured to look into the matter.

(d)   Local officiating promotions to fill up AO/CAO/DGM(Fin) vacant posts of Kerla Telecom circle: We expressed our concern against Kerla Telecom Circle wherein, the local officiating promotions to fill up AO/CAO/DGM(Fin) is not being given which is causing problem in exercising statuary powers. Director(Fin) immediately spoke to Sr. GM(Fin) Kerla Circle to fill up the vacant posts of  AO/CAO/DGM(Fin) on local officiating basis without issuing mass transfers.

04.05.2012: ITS absorption issue:  It is understood that BSNL/MTNL Managements with ITS Cadre affinity  are approaching to Hon'ble High Court Delhi for allowing ITS Officers continuation in BSNL/MTNL till the alternative arrangement. It will allow to continue uncertainty in BSNL/MTNL, which will adversely affect the viability of BSNL/MTNL.

04.05.2012: GS & President met Sh. K.R. Tiwari, GM(TP&RA) & L/A PGM(FP) and discussed

(a) DPC from AO to CAO (Adhoc/Regular): We requested to expedite DPC from AO to CAO (Adhoc/Regular) to fill up about 500 vacant CAOs posts. GM(TP&RA) confirmed that clearance to fill up vacant CAOs posts has been received from Pers. Cell & efforts are being made to expedite DPC. He advised to contact Circles for early sending of missing ACRs.

(b) Consideration of tenure/request transfers of AOs/CAOs: We expressed our concern against non issuing of tenure transfers of AOs/CAOs, who have completed tenure in NE-I/NE-II & AS Circle in the month of July/Aug'2011. GM(TP&RA) assured an early action in this regard. Regarding retention/Cancellation of some genuine transfer cases, he assured to look into.

(c) Affair of TN Circle, wherein GM(F) is indifferent towards executives: We expressed our resentment against the indifferent attitude of GM(F), TN Circle towards executives. She is transferring account personnel's on pick & choose method arbitrarily without the approval of CGM, TN Circle, which is clear cut violation of BSNL CO letter no. 3-1/2002-Restrg. dated 03.04.2003 (Click Here for order) of HR integration wherein all Group-'A' & 'B' level executives of all the disciplines i.e. Telecom Engineering, Telecom Finance and Accounts, Civil/Electrical/Arch etc transfers  in Circle can be issued with the approval of CGM only. GM assured to discuss the matter with Director (F) to short out the problem.

04.05.2012: GS discussed with PGM(BW) regarding

(a) Issuance of Promotion Order from JTO(C) to SDE(C): PGM(BW) further mentioned that DPC minutes has been sent to the Competent Authority for approval & same is still awaited.

(b) Consideration of request & modification of transfer orders: We requested for modification of some SDEs/EEs transfer order on genuine   grounds & issuing request transfer of SDEs/EEs. PGM(BW) informed that some cases has been considered & sent to Competent authority for approval. He assured an early action in this regard.

04.05.2012:  Hon'ble CAT Chennai dismissed OA filed by AIGETOA challenging JTOs eligibility list for the promotion to TES Group-'B' on the basis of year of recruitment. It will pave the way to fill up the about 2000 vacant TES Group-'B' posts for which the internal DPC work exercise is already going on. But, the Court case on SC/ST roster implementation in Hon'ble Chennai High Court clearance will also require for issuing the promotion order. BSNL Management  successed to convey Hon'ble Court in favor of DoT order on the basis of year of recruitment to prepare JTOs eligibility lists. AIBSNLEA appreciated the marvelous efforts of Pers. Cell.

03.05.2012:ITS absorption issue: It is reliably learnt that legal opinion from ASG has been received by DoT on the judgment delivered by Hon'ble High Court, Delhi on ITS absorption issue. Accordingly, an early action on this issue is expected from DoT.

In connection with this special CEC an open session was arranged in the seminar hall of RTTC,Trivandrum from 3.00PM onwards. The seminar hall was jam packed with more than 300 members.   Shri.  S. Jyothi Sankar ITS,  G.M.T. Trivandrum SSA was the guest of Honour, in this particular occasion.

Com. Mangalanadan, Circle Secretary, Kerala Circle welcomed all the dignitaries on the Dias and felicitated them. Circle Secretary, Kerala Circle in his welcome speech thanked Shri Jyothi Sankar ITS, Sr. G.M. Trivandrum SSA for his full support in settling the issues related to the Executives and for his inspirational and unique decision in opting BSNL in the first option date itself. He also extended his sincere gratitude to the District Secretaries and Circle Executive Committee for their support.

Com. Babyrani All India Vice President, AIBSNLEA CHQ, addressed the gathering and explained the legal issues pertaining to BSNL executives and strongly criticized the irresponsible and indifferent attitude of ITS officers.

Com. Athani AGS AIBSNLEA CHQ motivated the gathering, through his informative speech. He focused on how the management is creating problems and troubling the employees without real HR concern.

GS AIBSNLEA, Shri Prahlad Rai, congratulated the comrades of Kerala Circle for this special CEC and thanked the comrades for inviting him and giving an opportunity to address the gathering. In his detailed address Com GS explained the actions taken by the AIBSNLEA in the financial viability of BSNL. He mentioned the efforts taken by AIBSNLEA in issuing orders regarding EPP, Grant of Perks, Transparent Transfer Policy, 2nd PRC Implementation, Finalization of BSNL MSRRs etc.  He mentioned that BSNL with its existing employees have earned profit in past and due to the non-co-operative and step motherly attitude of Govt. towards the BSNL in comparison with the other service providers by way of charging unjustified payment of spectrum charges (3G & BWA) of Rs. 18,500 and allotting inferior quality spectrum which cannot cater the requirement of 4G at a higher rate without allowing BSNL to participate in the bidding, non-reimbursement of licenses fee, USO Charges, Non-Payment of OPEX Charges, withdrawal of ADC, Payment of AGR (which is levied only from BSNL and not from any other operators),  Interest @ 14.5% on payment of notional loan Rs. 7500 Crores. All these are affecting the viability of BSNL in an adverse manner.  He informed that BSNL is incurring more than 9000 Crores in Rural areas services but No ADC charges is being given by the Govt.  He stated that, non-procurement of GSM equipment, cables, telephone instruments; MLLN Modem, Broadband Modem, Drop wires etc have affected the quality & growth of services.   He also spoke about the non-refund of spectrum charges by DoT, MOU between DoT and BSNL, willingness of DoT to allot 15000 crores soft loan to BSNL, repeated cancellation of tenders etc. He explained that how the AIBSNLEA is continuously pursuing these viability related issues with the BSNL Management and DoT. Com GS. Further explained the burning issues of the Headquarters level like ITS Repatriation process and its status after issue of the clarification by the Dept. of Pension and Pensioners Welfare, negative actions and inactions of DoT and the stand of AIBSNLEA and JAC on this issue. He explained the stand of AIBSNLEA and JAC on the issues like VRS, 30% disinvestment and unbundling of last mile copper. He apprised the status of HR issues related to mainly DPCs of various disciplines viz. JTO to SDE, SDE to DE (Adhoc/Regular), DE to DGM, DGM to GM, JAO to AO, AO to CAO & CAO to DGM (F) and DGM (F) to GM (F) etc., Pay anomaly- Sr. are drawing less salary than their juniors, Pay revision of AD (OL), Creation of PPS for the Personal Secretaries in the field units, post based promotions to PSs in the field units, etc. He also stated that AIBSNLEA has settled many burning issues like restoration of ACP to Civil / Electrical, restoration of residency benefits to PA/PS in the field units, issue of adhoc promotion orders of DEs.  GS has specially mentioned the issues of the officiating JTOs and assured the sincere effort from the side of association to tackle the issues. He has also replied to all the queries raised by the audience during the question answer session.

GS specially congratulated Shri. Jyothi Sanker GM, Trivandrum SSA, for his right decision to join BSNL and whole heartedly appreciated for all the out efforts taken by the GM to strengthen BSNL.

GS finally informed that AIBSNLEA is taking care of all the executives irrespective of their cadres / disciplines and size.  He also assured that CHQ of AIBSNLEA will take care of all the HR issues, but the executives in the field should raise to the occasion and make the BSNL to grow further to make its original position in the market.

Shri S. Jyothi Sankar, Sr. G.M. Trivandrum SSA, in his inspirational speech emphasized that this is the right time to discharge the dedicated work by all to prove the metal of BSNL. He thanked the association for inviting him as the guest of honour of the day and whole-heartedly appreciated the earnest efforts taken by AIBSNLEA to safe guard the interest of the Executives of BSNL belonging to different cadres.  On this occasion he also appreciated all the members of AIBSNLEA Trivandrum SSA for their efficient performance. He also expressed his happiness that the AIBSNLEA is representing all the cadres / disciplines of the executives.  He also stressed the importance of dedication to work and there by extending maximum customer satisfaction.  It is the duty of the executives to work hard to retain the faith of the customers on the BSNL, as majority of the people always prefer our services than to any other private operator.  He also stated that Trivandrum SSA is number one in introducing many services in Kerala Circle. He narrated the problems in executing the work faced by him due to the indifferent and reluctant attitude of the non-opted ITS officers. He conveyed the message that 'we should see that what is required from us for the betterment and growth of our organization'.  GM also expressed his anxieties towards operational issues like the non-availability of recharge coupons, stores etc.  which are adversely affecting the viability of BSNL.

01.05.2012: GS, President along with GS, President, SNEA(I) & AIGETOA representatives met Director (Finance), BSNL and requested for early nomination of Chairman Committee dealing with United Forum of BSNL Executives Associations demands i.e. implementation of CPSU Cadre hierarchy, Finalization of E-2 & E-3 standard IDA pay scales for JTO and SDE equivalent executives and withdrawal of Sr. DGM BSNL SLD RRs-2011 since he has resume the high office of Director (Finance), BSNL. Director (Finance) assured to process the case for changing the Chairman Committee at the earliest to the competent authority.  We also requested to get resolve these issues in the BSNL Management Committee (MC) / BSNL Board Meetings. He responded positively.

01.05.2012:GS, President, FS & AGS (HQ) met Sr. GM(Pers) and discussed

(A) DPCs from DE to DGM, SDE (T) to DE (Adhoc) and DE (Regular): We expressed our serious resentment against non-filling up of DGMs and DEs vacant posts on Regular/Adhoc basis on the pretext of pending court cases. Sr. GM(Pers) called Addl. GM(Pers.), AGM(Pers), AGM(DPC) and DM(Legal) to discuss the matter. We explained that in some courts the applications can be immediately filed for clarification and holding DPC from SDEs to DEs whose seniority is not disputed and in some cases the seniority is quashed or disputed may be dealt as per court direction. But in the interest of BSNL's growth and its executives,  stalemate should be broken and promotion to eligible executives should immediately be given. Sr. GM(Pers.) after detail discussions directed concern officers to immediately seek the clarifications from the Hon'ble courts as well as legal opinion so that DPCs can be held to fill up vacant DGM/DE posts. However, he suggested that Association should also give its clear view to resolve the problem in writing.

(B) DPC from JTO to SDE(T): We requested to start the process of DPC to fill up vacant SDEs(T) posts of seniority cum-fitness quota. Sr. GM(Pers.) apprised the status of Hon'ble Chennai CAT & High Court direction in this regard. However, he mentioned that matter is under discussion with GM(Estt.) for finalizing  the JTOs gradation list and  as soon as the court case position is clear, the DPC will be conducted.

(C) DPC from SDE(TF) to AGM(TF): Sr. GM(Pers.) informed that the DPC was over to fill up Nine Posts of AGM(TF) and the transfer & posting orders might have been finalized by ED(NB) Office.

(D) Generalization of Judgment dated 26/04/2011 of Hon'ble CAT Bangalore in OA No. 181/2009 filed by Shri K S Premkumar and 123 others- Extending the benefit of notional date of promotion and fixation of pay w.e.f. 23.01.2002 and actual benefits from 01.04.2008 to similarly placed other candidates: We requested to generalize the above mentioned court judgment to similarly placed candidate. Sr. GM(Pers.) informed that the case is under examination.
