Sh. Alladi Harish , the 2nd son of Sri Alladi Koteswara Rao garu, DGM (Rted) (S&M) O/o CGMT AP VJ & Ex.CS of AIBSNLEA has lost his life in the fire accident occurred in Ruby Hotel, Secunderabad on 12.09.2022

22.09.2022    GS , President and Dy GS meet  GM(Pers) Sh. S N Gupta, Joint GM(Pers) Sh. O N Tiwari  , DGM( Pers-Legal) Sh. M Udaya Kumar & DGM(DPC) Sh. Sathish Kumar are shared the copy of the letter to CMD by GS explaining the views of AIBSNLEA on the recent Judgement of Hon’ble CAT Kolkata dated 13.09.2022 in OA No 350/01626/2022.

AIBSNLEA submitted all the facts and figures that all the available seniority Lists of SDEs from List 6 to 13 are finalized on the basis of the  Date Of Joining to the cadre of SDE . All these seniority lists had been well finalized after high-cost lengthy Legal process based on the Hon’ble Supreme Court Judgement. 

The inter-se Seniority between the 67% SCF quota and 33% LDCE quota (that is 2:1 Rotation will be applicable w.e.f 28.8.2015 only) was introduced as an addition / modification to the SDE(T) RR dated on 08.05.2018 , hence the ROTA-Quota & Inter-se-seniority between the Seniority Quota (SQ) and Competitive Quota (CQ) cannot be applicable  for those promotions happened before 28.08.2015  viz date of promotion orders for the Lists:  9 & 10 on 15.05.2009 , 11 on 30.03.2011 and 12 & 13 on 02.07.2013.

Since all the lists were finalised as per the direction of the Hon’ble Apex Court of India , BSNL management cannot initiate any reordering for changing seniority  on the direction from any lower court.

AIBSNLEA requested BSNL management to submit this fair views in Speaking Order to the CAT kolkatta bench for OA No 350/01626/2022 and go ahead with promotion process from SDE(T) to AGM(T)

Update on the Promotions Orders from SDE(E)to EE(E) and JTO(E) to SDE(E) subsequently:

GS , President and Dy GS meet  GM(Pers) and shared copy of the letter to CMD by GS for the immediate ordering of Promotion in Electrical Stream. AIBSNLEA requested to initiate promotion process for SDE to AGM in electrical stream as there is no court case against promotion . As per restructuring there are 88  vacancies in Electrical stream for EE and presently around 55 EE posts are vacant. The SDE(E) got regular from July 2000 are waiting for their EE promotion for the last 22 years.  Subsequent to the promotion of SDE(E) to EE(E) for 55 posts, JTO(E) of 1997 batch onwards who are waiting for their first promotion for the last 25 years can also be promoted.

Moreover , this would certainly  share the fact that BSNL management is not against any eligible promotions for employees while most expected promotion orders of other streams are caused to hit legal blockage. Understandably the DPC process for SDE(E) to AGM(E) is not happening now and stand halted. It is also informed that some issues are to be sorted out before conduction of the DPC for the promotion in Electrical Stream.

AIBSNLEA shared our concern on the unwanted delay in the promotion process  and requested GM (Pers) to sort out the issues, if any by , at the earliest to issue the promotion orders . GM(Pers) assured to take up the request to issue promotion orders in Electrical Stream with DIR(HR) . We thanked for the positivity from GM(Pers)  .

21.09.2022   GS Writes to the CMD BSNL for issue promotion orders in Electrical Stream.

Subject: Promotions Orders from SDE (E ) to EE ( E ) may be considered for release as there is no court cases against the promotion in electrical stream and to share the fact that BSNL management is not against any eligible promotions for employees while most expected promotion orders of other streams are caused to hit legal blockage - reg.

Respected Sir,

We would like to draw your kind attention to the above cited subject. This association was of the view that let all the pending promotions orders to happen together start with that in Telecom Stream, the vertical having the presence of the lion share of employees, so that the odd feelings would not be brewed up among executives that management extending preferential care to some verticals. However , an unhealthy practice has been seen widely in connection with the long pending promotions in Telecom Vertical especially from SDE(T) to AGM(T) that some of the executives resorting to jurisprudence with half cooked data against BSNL and earning favourable orders for derailing the eligible Promotion process is nothing but leg pulling of the eligible Senior Executives from achieving their long-cherished Promotion orders. This may be viewed seriously and reprimanded by management if the course of action demand so. This association is not against taking shelter to the Hon’ble court of law against injustice but the channel must not be seen for seeking knife to twist in the wounds of seniors desperately waiting for promotion. ..........  ............ ........

Attempts to sabotage the SDE(T) seniority lists , well finalized after high-cost lengthy Legal process went up to the Hon’ble Supreme Court of India may be viewed accordingly without leaving any room for opening another Pandora box by allowing anymore re-ordering of any of the SDE(T) Seniority Lists which would derail the much awaited SDE (T) to AGM(T) Promotion process indefinitely and would be ended up in a mess.      <<<GS Letter to CMD>>>

19.09.2022   BSNL CO issued  IPMS cards of Circle Heads of Tenitorial and Core Network Circles for Q3 (Oct-Dec) 2022 for perusal and necessary action.   <<< IPMS>>>
18.09.2022   Update on the Status of the Court Case filed by AIBSNLEA  against UOI (DOT) on Withdrawal of the Additional Increment in the same Scale on Functional Promotion under EPP: Writ Petition (C) No 9237 of 2018 & CM APPL . 30384/2022.

The Hon HC of New Delhi  directed to issue Notice to the Petitioner (DOT) in addition to counsel on the day of hearing , 31.08.2022. The case is coming for hearing next on 22.02.2023.  <<< HC Order>>>


DoT vide its letter dated 05.07.2017 withdraw additional Increment in the same Scale on Functional Promotion under EPP. Against this arbitrary action by DoT, AIBSNLEA immediately filed an OA in the Hon’ble PB CAT New Delhi for quashing the orders. Accordingly, Hon’ble PB CAT after some hearings quashed & set aside the said order of DoT dated 05.07.2017. Even after that DoT continued to reduce the pension of the BSNL retiree executives, against this AIBSNLEA filed a Contempt Petition in the Hon’ble PB CAT New Delhi. Thereafter DoT stopped reducing the Pension/revising the Pay fixation by obtaining an undertaking from the BSNL Executives; 

This negative effect of reduction in Pension calculation is common for executives absorbed in BSNL and for the DR executives.

DoT has filed Writ Petition in the Hon’ble High Court of Delhi wherein AIBSNLEA has filed a Caveat. 

AIBSNLEA Leaders have submitted its' views in the meeting held on 30.09.2019 between representative officers of DoT & BSNL and render justice by withdrawing the impugned order of DoT dated 05.07.2017.

The case in the Honb’le High Court, Delhi was listed on different dates but could not heard due to Covid situation during 2020 - 2021 and it was last heard on 28.03.2022. The case was further re-notified for   hearing on 31.08.2022.

In the mean time DoT directed BSNL on 07.02.2020, to withdraw the additional increment as per the DoT order dated 05.07.2017 which was quashed by Hon’ble PB CAT New Delhi on 21.12.2017 and pending with the Honb’le High Court, Delhi. As per the suggestions of AIBSNLEA in the meeting held on 30.09.2019, BSNL Management again written a letter to the Secretary (Telecom) on 22.07.2021 requesting to withdraw the DoT order dated 05.07.2017. But surprisingly DoT vide its letter dated 30.03.2022 once again directed to implement the order dated 05.07.2017 which is against Hon’ble PB CAT New Delhi order dated 21.12.2017 and it is Contempt of Court.

AAIBSNLEA CHQ promised and written on website on 23.06.2022 that AIBSNLEA is going to issue “Legal Notice” to DoT, and file the Application and Counter Affidavit in the Honb’le High Court, Delhi through our Sr. Counsel. Accordingly AIBSNLEA has filed an Application in Hon'ble HC of Delhi through our Senior Counsel immediately on the opening of the Court on 04.07.2022 after vacations.

This Case is listed for Yesterday i.e. 13-07-2022, but the Court could not sit on some reasons and posted further for hearing on 05-08-2022.  

AIBSNLEA is the only Association taken up this very prestigious case wherein all Executives both absorbed in BSNL and directly recruited by BSNL are affected financially, especially during Pension Calculation on Superannuation.

 

15.09.2022  Update on the Court Case at Hon'ble CAT Jabalpur intervention on SDE(T) to AGM(T) Promotion:

The case (OA No: 746/2022) was listed  for the hearing today (15-09-2022)  in the Hon'ble CAT Jabalpur. The Case is not heard today due to the unavailability of the Bench.

14.09.2022  Update on the Court Case at Hon'ble CAT Jabalpur intervention on SDE(T) to AGM(T) Promotion:

The case (OA No: 746/2022) was listed  for the hearing today (14-09-2022)  in the Hon'ble CAT Jabalpur. The Case is not heard today due to the unavailability of the Bench.

14.09.2022   Update on the Court Case at Hon'ble PCAT New Delhi: O.A./1657/2022 (DELHI-CAT): Demanding 4% reservation for the Persons with Benchmark Disabilities (PwBDs) in the ongoing DPC for SDE(T) to AGM(T):

AIBSNLEA discussed the case in detail with the GM(Pers) and DGM(Pers-Legal). As any Order Sheet hasn’t been received from the Hon. PCAT Delhi, the Management was not in a position to asses the outcome of the O.A./1657/2022.

In the released order sheet dated 07/09/2022 and received belatedly , Hon. PCAT ordered that the DPC shall independently evaluate the eligibility and the merit of the applicants, however, the recommendations in the DPC with respect to the applicants shall not be given effect to till the disposal of the present Original Application.

The case is listed for final hearing on 10.11.2022.

Hence, BSNL Management will be in a position to release the SDE(T) to AGM(T) promotion orders as soon as the stay by Hon'ble CAT Jabalpur (OA No: 746/2022) is vacated.  

13.09.2022  GS, President, Dy.GS and Auditor CHQ met GM (Pers) and discussed the following-

Pending SDE(T) to AGM(T) Promotion: We enquired on the latest status of releasing the long Pending and most awaited Promotion orders.  We requested to release the promotion orders by tomorrow itself, if the stay would be vacated by tomorrow in the  Hon'ble CAT Jabalpur. GM(Pers) mentioned that Management is  ready after completing all the formalities and waiting for the outcome of the CAT Jabalpur. We requested to consider all the eligible SDEs for the AGM promotion  and to post all the SDEs to their respective parent circles during their promotion to AGM(T). We further requested the GM (Pers) to make all smooth arrangements for joining to the promoted cadre on the same day for all the officers especially for the officers if at all they would be posted out of their parent circles. GM (Pers) assured to take care of the matter in true spirit.

AO to CAO Promotion Status Quo case: We submitted the inordinate delay in vacating the “Status Quo” case pending in the Hon’ble CAT Chandigarh in respect of AO to CAO promotions. The Court case pending since last 4 years in the Hon’ble CAT Chandigarh is again postponed the case to 28-09-2022 due to the non – availability of bench on the last date of hearing. The case is adjourned for 28 times during these 4 years spell by the Hon'ble CAT. We strongly submitted that AIBSNLEA cannot just swing with the adjournments of the case on the long-lasting case.  

GM(Pers) shared our concern and suggested that BSNL Management is very much keen on the case and expecting the stay get vacated soon. AIBSNLEA submitted a solution to the Management for issuing the AO to CAO promotion orders without much delay and sought support of Management for the same. GM (Pers) responded positively and mentioned that AIBSNLEA suggestion is much appreciated and assured to take all out steps for the early resolution of the court case accordingly.

Pending SDE(E) to AGM(E) Promotions: We submitted to release the pending promotion orders in Electrical wing also as there is no court intervention in the Promotion process for SDE(E) to AGM (E)  . The executives in Electrical vertical absorbed to BSNL as regular SDEs in 2000 are desperately waiting for their eligible promotion for more than  22 years is a matter of big concern, worry and de-motivation to all. GM (Pers) informed that the promotion process is almost finalised and mentioned that subsequent to the release of the promotion orders from SDE(T) to AGM(T), Management will release the SDE(E) to AGM(E) promotion orders . Also the pending promotions in TF wing, Arch wing & CSS Cadre have no blockage for issuing  promotion . In Civil wing  understandably some court intervention is there . BSNL management is hopeful of vacating the hurdle  for the promotion in Civil wing also . We appreciate  GM(Pers) for the very positive response.

Bug in the APAR software package which is affecting the careers of the Executives: we requested to settle down the APAR issue of the affected executives as they are denied with Financial Upgradation and this may be affecting their coming up promotion process also for the reason no way related to them. GM(Pers) assured that the case will be settled without delay.

Detailed discussion on the Promotions in all other cadres including Civil, PS-PPS, DGM Telecom/Finance (Adhoc) to DGM(Regular) & CAO (Adhoc) to CAO (Regular) Promotions:  Detailed discussion on these topics could not be completed today as GM(Pers) is busy with finalisation some promotion process. GM (Pers) submitted to AIBSNLEA to permit him to discuss all the pending matters after tomorrow.

07.09.2022   Update on the Court Case at Hon'ble CAT Chandigarh regarding AO to CAO promotions filed by Anupam Yadav Vs BSNL:-

The case (OA No 1435/2018 with MA 168/2019) was fixed for the hearing on 07.09.2022 in the Hon'ble CAT Chandigarh. The Order Dated 07.09.2022 of the Tribunal is......<<<Order Copy>>> ......and further posted for 28.09.2022.

07.09.2022   Update on the Court Case at Hon'ble CAT Jabalpur intervention on SDE(T) to AGM(T) Promotion:

The case (OA No: 746/2022) came up for hearing today due to the MA filed by BSNL (the respondent) for early hearing and vacation of the stay on the promotion till  23/09/2022 . As the arguments are not completed fully , the case is posted for next hearing on Wednesday, the 14/09/2022.

06.09.2022   BSNL Corporate Office issued orders regarding:-

1) Online IPMS 2.0 for Executives for the month of Aug-Sep- 2022 about the extension of date from 05.09.2022 to 12.09.2022.  <<<CO Order>>>

06.09.2022   Meeting with Sr. Officers in Corporate Office:

CHQ President and CHQ Auditor AIBSNLEA met DGM (Pers-Legal) CO BSNL and discussed regarding the status of various Court Cases on vital issue of Promotions in respect of SDET to AGMT, AO to CAO and Reservation in Promotion of Jarnail Singh Vs Lachhami Narain Gupta case:-

A) Promotion from SDE(T) to DE(T)/AGM(T): We enquired about the status of Court case and the preparation of BSNL for the hearing in Hon’ble CAT Jabalpur wherein the date of next hearing has been fixed for 07.09.2022. DGM (Pers-Legal) informed that BSNL has taken all necessary steps for the vacation of stay by the Hon’ble CAT Jabalpur. Earlier the GS AIBSNLEA, GS SNEA and GS SEWA had called & discussed with the Applicant and explained him about the issue in depth. All the GSs have made attempts and successfully conveyed him about the unrest among the AGM aspirant Executives. Further the leaders met with the Authorities at different levels at BSNL Corporate Office and informed about the developments and progress in the Court Case. BSNL CO is very much hopeful for the vacation of Stay by the Hon’ble CAT Jabalpur.

B) Jarnail Singh Vs Lachhami Narain Gupta court case pending in Hon’ble Supreme Court of India: The court case regarding the Reservation in Promotion issue wherein Jarnail Singh Vs Lachhami Narain Gupta case is pending in Hon’ble Supreme Court, was listed for today i.e. on 06.09.2022, the same is adjourned to 22.09.2022… further details awaited…..    

C) Promotion from AO to CAO: Anupam Yadav Vs BSNL Court case regarding AO to CAO promotion issue has been listed for 07.09.2022 in the Hon’ble CAT Chandigarh. Few days back, the Hon’ble Member Judicial was retired from Hon’ble CAT Chandigarh, however it is learnt that the new Hon’ble Judicial Member has joined in the CAT Chandigarh. Meanwhile the Hon’ble Member Admin was also on leave and likely to be joining on tomorrow.

AIBSNLEA CHQ is closely monitoring all the developments in this regard and very much hopeful that soon we will be able to vacate the stay/ status quo and the promotion orders will be issued for all the eligible executives including all those who are going to be eligible as on 1st of January, 2023

D) Promotion from CAO to DGM-F and DGM(Adhoc) to DGM(Regular): DGM (Pers-Legal) mentioned that the CAOs promoted in 2018 will be eligible for DGM Promotion as on 01.01.2023 and firmly opined that we will be able to promote all the eligible CAOs on the post of DGM(Fin). Further all these vacated posts of CAOs will be used for the new promotions of AO to CAO to accommodate and promote the maximum numbers of the executives. Similarly, DGM(Adhoc) to DGM(Regular) promotion orders are also be expected in the due course. AIBSNLEA conveyed its sincere thanks to the officer for his much affirmative response.

29.08.2022    Update on the SDE(T) to AGM (T) Promotion issue:

BSNL Corporate Office was almost ready to issue the promotion orders from SDET to DET by 29.08.2022 evening. The process for the proposal for promotion was initiated in e-office and the same was approved by the CMD BSNL during the late evening on 27-08-2022, Saturday, and it was ready for further processing to get the final approval to release the promotion orders by the evening on 29.08.2022. Unfortunately, the direction came from the Hon’ble CAT Jabalpur to refrain BSNL from issuing of the promotion orders till the next date of hearing on 23-09-2022 on the case in OA No: 746/2022 .This Court Order stalled the process of the promotion and Corporate Office could not issue the orders, as the process of promotion was started in e-office.

To seek all the possible legal efforts to release the much awaited and long pending the SDE to AGM Promotion orders, which will certainly pave ways to release all other pending promotion orders of the Executives in different Streams including the very long pending AO to CAO promotion from 2018, GS AIBSNLEA, AIGETOA and SNEA sought and succeeded for an emergency meeting with Shri. Arvind Vadnerkar, Director HR BSNL Board in his Chamber on the late evening on Monday wherein GM (Pers) was also available during the meeting. The matter was discussed in detail and the GSs requested to issue the Promotion Orders today (29.08.22) itself since signed copy has not been received to BSNL from the CAT Jabalpur. But, it was categorically informed that the signed copy has been received in Corporate Office through email and BSNL cannot release the promotion orders after receiving the Court directions. Then GSs requested DIR HR to instruct CGM MP Circle and GM in charge of Jabalpur to arrange an able & Sr.Advocate in the Hon’ble HC Jabalpur to get the Stay vacated. Accordingly, the DIR (HR) telephonically instructed the concerned GM to take all out measures for the same on very next day itself. The meeting with DIR (HR) concluded around 8.00 Night.

After the meeting with the DIR (HR), all the three GSs requested for a meeting with Shri. P.K. Purwar ji, the CMD BSNL. The CMD BSNL was very much busy with the MOC for full day and then meeting with the Directors of BSNL Board. After the meeting with the Board of Directors, all the GSs got meeting with the CMD BSNL around 9.45 night. CMD BSNL was very unhappy with the development of the Court intervention in the Promotion order. However, CMD shared his hopes that promotion orders would be released as soon as the permission granted from Hon’ble Court of Law.

A special meeting has been convened by AIBSNLEA Jharkhand Circle on 27.08.2022 in Hotel Raj residency at Ranchi . GS Com Shaji .V , Dy GS Com. J K Patel and Org Sec (E) Com. Avijit Khamrui attended  the meeting. All the members of the Circle Executive Committee have participate in the meeting .

The meeting started with silent prayer . Circle Secretary Com R. Viswakarma has welcomed all the CHQ OBs and members . CS elaborated the organisational activities of AIBSNLEA in the Circle . CS reported that  Jharkhand Circle could add many members to AIBSNLEA during the last window opening for membership addition . CS explained that all the issues of members are regularly being taken up with circle management for favourable solutions and no pending issues are there in the Circle .

OS East Shri A.  Khamrui in his speech congratulate CS and  all the members for their best efforts they are taking for strengthening AIBSNLEA and requested to  add more new members into AIBSNLEA .  Org Sec (E) extended full support to the Circle .

Dy GS Shri J. K. Patel in his speech explained in detail how the AIBSNLEA is working for entire executive fraternity without any discrimination. Dy GS elaborate how CHQ team is working day and night in favour of Association and for the benefits of all our members. Dy GS discussed on the revival packages of BSNL and expressed his belief that BSNL would be turning into a profitable PSU by 2025-26 as projected by management .  

GS Shri V. Shaji in his speech elaborate about the 2nd Revival package announced by the Central Govt. for BSNL in detail and also told that employees need not to be worried about the future of BSNL. BSNL will be starting the operation of 4G services from the indigenous 4G under Atmanirbhar Bharat. AIBSNLEA is in favour of Promotion of all eligible executives for upcoming SDE to AGM Promotion instead for piecemeal promotions . GS explained that only AIBSNLEA is demanding for the promotion for all eligible SDE(T)s . Had MA and SA supported our demand , the promotion orders could have been given for all eligible executives. For the AO to CAO promotions,  only AIBSNLEA is worried  and AIBSNLEA only taking up the matter with management  for vacating  the Status-Quo called by CAT Chandigarh. GS further discussed on all other pending points including all pending promotions in all cadres and feasibility of 3rd PRC to BSNL employees . The meeting concluded with National anthem followed by Dinner

Before starting the meeting Team CHQ along with CS had a meeting with the CGMT Jharkhand Circle and greeted CGMT with bouquet. CHQ team discussed all the BSNL related matters of Jharkhand Circle  with CGMT . CGMT pointed out all the real issues being faced by Jharkhand Circle in field units and expressed confidence that with the second revival package, the scenarios around BSNL would be changed in the favour of BSNL .

GS, President & Dy.GS met the CMD BSNL on 24.08.2022.  AIBSNLEA Leaders greeted CMD BSNL with shawl and Memento for the envious achievement of CMD BSNL in arranging the 2 back-to-back Revival Packages for BSNL.  The second revival Package of Rs. 1.64 Lakh Cr. was announced for BSNL & MTNL by Central Cabinet on 27-07-2022 subsequent to the first revival package worth Rs.69000 Cr in 2019. CMD BSNL shared that we all must be very much thankful to the Government in sanctioning the very big financial packages for the revival of BSNL. We have to reciprocate to the Government Financial Support by extending our best services to the BSNL Customers. Customer care must be the most important motive of all the BSNL employees. Then only the revival package will be worth to the expectations.

 CMD BSNL mentioned that in the post VRS scenario everybody is thinking that BSNL network and our systems including customer care will be deteriorated. But somehow, we all the Post VRS BSNL Employees, are able to manage our system. This is not the contribution of A or B or C, this is by the collective contribution of each & every employee of BSNL. We are able to maintain the revenue amidst of all kinds of constraints viz not having the latest Technologies like 4G, not having the capability to invest further etc. We have brought good discipline in our Organisation in some manner so far as the cost part is concerned. But some imbalance in the performance is noticed among circles. Some Circles are earning a good revenue portion of BSNL and some other circles are not able to coming up to the performance mark. Now the customer is ruling the market. Even PMO is of the same concern that technology upgradation can be done anytime but attitude to work is required to be more developed by the less contributing circles.

CMD BSNL added that Government is supporting BSNL in all aspects by awarding many projects like LWE , Chardham, Kochi-Lekshadweep (KLI), Mission 500, O&M of Bharat Net etc. The following discussions are happened.

 Induction of Indigenes 4G Technology in BSNL under “Admanirbhar Bharat”:  

 Indian 4G/5G Technology under “Atmanirbhar Bharat” is getting developed. The development is in very advanced stage. The Indian Companies viz CDOT, Tejas, ITI, TCS etc., are on the Job. More than 80% of the Specifications are achieved by the OEM both in Core System, RAN, Interoperability with other Live Mobile Systems etc. A commendable data throughput also achieved by the Indian Companies, as reported.

 AIBSNLEA shared its concern with CMD BSNL that BSNL is a mere onlooker in the development of Indian 4G. Till the time of the commercial production of Indian 4G system, the whole BSNL is simply reserved indefinitely as a testing bed for the Indian 4G/5G services is a matter of concern.  BSNL may be permitted carry out 4G/5G Services in some Urban Areas through Foreign Vendor Equipment at par with other TSPs to earn more revenue through Mobile Data sector to sustain BSNL afloat. 

CMD BSNL responded that the indigenous 4G project is going directly under the supervision of the PMO and shared the hope that the 4G would be inducted in BSNL without much delay.

Pending SDE(T) to AGM(T) Promotion: We request to release the long Pending SDE(T) to AGM (T) Promotion in single go without hitting any legal hurdles by considering promotions for all the eligible SDEs from the SDET Seniority List No. 8 to 13. CMD BSNL responded that the file is received today and will be seen on deserved merit and due care without delay.  

The SDE(T) to AGM(T) promotion is the hottest topic of the season. Enormous versions of the outcome are available in social media. Almost all of these messages are not having any stuff and may be viewed accordingly. One fact is that on this promotion issue BSNL Management right from the CMD sir to Personal Section of BSNL CO has been engaging their level best for the early possible release of the Promotion Orders. AIBSNLEA extend our earnest gratitude to the CMD BSNL, the DIR(HR), the GM(Pers) and all the officers in the personal section at BSNL CO for their relentless efforts for the materialisation of the promotion orders.  Now the file is with our CMD. AIBSNLEA is damn sure that our CMD BSNL will take a final call on the case which will only be favouring the executives waiting for their eligible promotion for years and years.

Once the SDE(T) to AGM(T) promotion is happened, subsequently all the pending and due promotions in all other cadres and all other verticals including Accounts, Civil, Electrical, TF, PS/PPS, CSS etc., will be in light. Hence, all the executives are requested to wait for the finalisation of the SDE(T) to AGM(T) promotion process  and leave no room for speculation on it.

AO to CAO Promotion Status Quo case: We submitted the GS Letter dated 23-08-2022 on this matter addressed to the CMD BSNL regarding the inordinate delay in getting vacate the “Status Quo” case pending in the Hon’ble CAT Chandigarh in respect of AO to CAO promotions. The Court case pending since last 4 years in the Hon’ble CAT Chandigarh is again postponed to next month. The Promotions in the Grade of AO to CAO are held up due to the “Status Quo” call by the Hon’ble CAT Chandigarh since 29.11.2018. We surprised to note that the full details of the case, what happened on the last hearing and even the date of next hearing of the case is readily known to the CMD sir.

CMD went through our letter very patiently and assured to do the needful to vacate the stay so that the pending AO to CAO promotion from 2018 can also be issued. We further requested the CMD BSNL to instruct the concerned officers to cause to issue necessary instructions on the matter to get the stay vacated preferably by the date of next hearing on 07-09-2022.

Promotions in all other cadres including DGM Telecom/Finance (Adhoc) to DGM(Regular) & CAO (Adhoc) to CAO (Regular) Promotions: We requested CMD BSNL for the early consideration of all the adhoc to Regular promotions. CMD responded positively and ready to issue all the regular promotions to the deserved officers. It is mentioned that in Finance side it can be issued but for telecom, some legal hurdle is noticed to me like wise CAO adhoc to Regular also “Status Quo” is there on the last DPC and also some individual court cases are dragging the promotion process. However, all the legal hurdles will be removed one by one very soon and accordingly all pending promotions will be considered after the SDE(T) to AGM(T) promotion order.

BSNL Transfer Policy: Unfair Operation of the Policy by some CGMs/BA heads.

We submitted CMD BSNL that some CGMs and BA heads are wrongdoing with the BSNL transfer policy. In some cases for more than 24 years, executives are selectively permitted to work in a single building in field offices other than PGM/GM offices and  some other executives are randomly transferred from place to place frequently. This discrimination of higher-ups demoted many field officers. This preferential treatment must be called off for the betterment of BSNL by avoiding the creation of rank and files.  

These discriminations that happened in some Circles/BAs are in contravention to all the great efforts being taken up by the CMD BSNL & Board of Directors to turn around BSNL into profitable by arranging back-to-back Revival Packages and all. Already CMD BSNL stated that the Motivated staff can contribute excellently to the betterment of the Organization. On one side the CMD BSNL striving hard for the profitability of BSNL through several measures in unparallel ways, which is being greatly appreciated by all sectors. On the other side, some Circles/BA heads playing the card of partisanship may be restricted. CMD suggested to submit the details and AIBSNLEA will submit the details shortly in writing to the Management.   

All other pending HR matters like 3rd PRC/IDA Merger, MT, E2–E3, E1+5 Increments and Pay Parity etc., are discussed with CMD BSNL. CMD mentioned that all the remaining issues can be discussed in next meeting .

Due to the very hectic schedules of CMD BSNL , this meeting  started very late around 8.30 Night  and extended over 9.00 PM. AIBSNLEA CHQ extended our full support and cooperation to the CMD BSNL for his all-out efforts for early turnaround of BSNL.

 

24.08.2022    GS, CHQ President and Dy.GS met the GM (Pers) and discussed on the latest status on the pending promotions including the SDE (T) to AGM (T). GM (pers) informed that as shared on 22.08.2022, the promotion process is going on in the right direction and the case has been submitted to the higher authorities for final discussion and approval . PGM (Pers) shared that the process of promotion from SDE(T) to DE(T)/AGM is on and will happen very soon with all due care and factors to fill up all the vacant posts of the DE(T) in BSNL . Promotions in all other cadres are also in the pipeline and the promotion orders will be issued subsequently.

AO to CAO Promotion case: We expressed our strong resentment on the  inordinate delay in getting vacate the “Status Quo” case pending in the Hon’ble CAT Chandigarh in respect of AO to CAO promotions. The Court case pending since last 4 years in the Hon’ble CAT Chandigarh is again postponed to next month. The Promotions in the Grade of AO to CAO are held up due to the “Status Quo” call by the Hon’ble CAT Chandigarh since 29.11.2018.

We submitted that the assurance given to this Association has not been materialized and the case has now been further postponed to 07.09.2022. The case is being dealt by Haryana Circle as per the directions of BSNL Corporate Office. But AIBSNLEA feels that this case has been handled by Haryana Circle authorities in a casual way despite the efforts being put by the BSNL Corporate Office. The general feeling is that the continues postponement episodes happening in the Court of Law is due to the mishandling of the case in an easy going way by the Haryana Circle authorities. As observed by our representative, sometimes neither the concerned officer from the Haryana Circle nor the Sr.Counsel of BSNL was present in the court when the case came up for hearing on some occasions. This only resulted the unfortunate postponement of the case date on date. The case came up for argument on 14.07.2022 was postponed to 23-08-2022 and further to 07-09-2022. Now the time comes up that BSNL Management shall directly intervene in the matter and approach to the Hon. High Court of Punjab and Haryana  or try to shift the case to PB CAT New Delhi so that Corporate Office can directly handle the case and get vacate the Status Quo at the earliest. GM (Pers) assured to do the best to resolve the crisis.

GS , CHQ President and Dy GS met GM ( pers) and discussed on the progress of pending promotion orders including the SDE (T) to AGM ( T) . Understandably the BSNL management is taking all out efforts to release all the pending promotions starting with SDE(T) to AGM(T) without delay.

AIBSNLEA CHQ also discussed all the pending genuine transfer & relieving matters  of executives . GM (Pers) assured to look into the  matter in due care .      <<< Letter to GM>>>

The case of executives worked in NATFM, Hyderabad and Tranafered to ALTTC was also discussed in detail.  Upon the merger/relocation of the NATFM Hyderabad to ALTTC , Ghaziabad , the official were also transferred fromHyderabad to ALTTC Ghaziabad without extending option for choice Circle for their posting. Whereas options were called from executives working in RTTC Rajpura /Jaipur /Lucknow fortheir posting in territorial circle when those Training Centers have been closed.

Though the BSNL Management is admitting it was happened erroneously, the justice is not granted to the executives. We requested the GM (Pers) to cause to issue their transfers orders without further humiliation to the affected officers and without delay.  GM assured to issue orders .

BSNL CO issued instructions regarding Migration of BSNL GPF subscribers from COMPACT Module to GPF Module of PFMS by DoT .

All concerned employees shall check / update their Increment Data , Aadhaar Number , Mail ID , Mobile Number etc in ESS portal before the prescribed cut off date to avoid the difficulties would be  faced subsequently including the handicap in withdrawing GPF from the new system.

GS and CHQ President meet PGM ( SR) and lodge our protest in the misusing of the BSNL Transfer Policy by some Circles and BAs for the purpose of Nepotism. AIBSNLEA CHQ received many complaints on the issue from Many Circles including UP ( E ) , Karnataka, Punjab ( Ludhiyana ), etc through our Circle Secretaries.

We categorically submitted to PGM(SR) case by case wherein the CGMs /GMs are wrongdoing with the transfer policy. On the other side, some Circles/BA heads playing the card of partisanship cannot be tolerated. Moreover, this attitude of the CGMs nullifies the exceptional efforts of the CMD BSNL to its pristine glory.

AIBSNLEA requested PGM(SR) to cause the transfer policy to be implemented in true spirit all along Circles/BAs for the betterment of the organization without Nepotism if the policy is to be operated. The PGM(SR) totally shared our views after a patient hearing. PGM (SR) assured to take up the matter in the fair interest of BSNL.
