BSNL CO issued guideline for Intra Circle Transfer of
executives :
In continuation of this office letter under reference
conveying the decision to OTP implement for Intra Circle
Transfer of executives ( JTO level & above, of all
streams) with effect from 1st January, 2022,
your kind attention is hereby invited to the clause 6
stipulating No that manual applications for request
transfer shall be considered" and it is once again
requested to ensure that no request based Intra-Circle
transfer are done on the basis of manual All
applications. the request based Intra-Circle transfers
must be based on online requests received in the OTP
only.

AIBSNLEA is the lone association that has taken up the
matter of issuing Promotion orders from SDE(E) to EE(E)
when the much-awaited SDE(T) to AGM(T) and AO to CAO
promotion process has been stuck in court. Through our
Letter dated 21/09/2022 and in the meeting of this
association with CMD BSNL on 23/09/2022, AIBSNLEA
requested the CMD BSNL to release all the pending
promotion orders other than all those Promotion
processes struck in court. <<<GS
Letter to CMD for SDE(E) to EE (E) on 21-09-2022 >>>
AIBSNLEA requested to CMD BSNL that the release of
possible promotion orders will 100% motivate all the
executives and would convey the message that BSNL
management is for giving eligible promotions to all
executives. CMD BSNL readily agreed to our submission
and initiated fruitful actions to release promotion
orders during the meeting itself.
Understandably, BSNL Management is sincerely working on
CPCs to release all pending promotion orders in all
streams that do not have court interventions against
promotion orders.

Update on SDE (E) to EE (E) Promotion:
Efforts of AIBSNLEA CHQ for the breakthrough in BSNL
Executives' Promotion by causing to release the SDE (E)
to EE (E) Promotion is reaching finality. All the
formalities for SDE (E) to EE (E) Promotions
including CPC Process have been Completed. Hopefully, by
next Wednesday the Promotion Orders will be released.
Today GS , President , Dy GS & Auditor
CHQ met GM(Pers) and discussed progress of the SDE (E)
to EE (E) Promotion and requested to release the
promotion orders by today itself . GM
assured to release the orders by next week in due of
some more office formalities .
AIBSNLEA requested to release all
pending promotion orders for executives in all
streams including that in Telecom factory . GM(Pers)
assured that after the release of SDE (E) to EE (E)
Promotions, CPC for all other pending promotions in all
streams will be carried out one.
AIBSNLEA requested for
the best efforts from BSNL management to vacate
Court interventions/Stay in the very long pending AO to
CAO & SDE to AGM Promotion Process . GM ( Pers) shared
that BSNL management is trying their level best to
vacate the stays from the CATs Chandigarh and Kolkatta.
GM ( Pers) assured to approach CAT Chandigarh with a
fresh MA as requested by GS, AIBSNLEA to the CMD BSNL in
the letter (No: AIBSNLEA/CHQ/CMD/2022 Date: 01.11.2022).
GM ( Pers) shared that the matter of the letter is
discussed with the CMD BSNL and CMD agreed to the same.
Further, the matter has been discussed with BSNL counsel
also. BSNL Management is waiting for the outcome of the
case
(OA No 1435/2018) on 14-11-2022, the next date of
hearing.

In the SDE to AGM
Promotion Process , the unfortunate situation is that
CAT Kolkatta has not decided yet on the future course of
action on the Review Application (RA 22/2022) filed by
BSNL on 27.09.2022 after the direction of Hon’ble CAT
Kolkata (OA No 350/01626/2022) on recasting the SDE
Seniority Lists.
AIBSNLEA expressed our serious concern about the
lingering process of SDE to AGM Promotion.....
04.11.2022 The
Hon'ble Supreme Court of India (a three-judge Bench led
by Chief Justice of India U.U. Lalit) Today on Friday,
the
November 4, 2022, upheld the Employees' Pension
(Amendment) Scheme, 2014 as "legal and valid" while
reading down certain provisions of the scheme concerning
current members.
The dispute primarily concerned the controversial
amendments made to paragraph 11 of the Employees Pension
Scheme (EPS) of 1995.
This judgement is
beneficial for those who are opting for EPF Pension

In the Hon'ble HC of Kerala
507 writ petitions filed by various organisations and
employees challenging the amendment Employees Pension
(Amendment) Scheme (GSR609(E)) effecting various changes
that have drastically reduced pension eligibility of
employees.

Shri P. K. Purwar Ji,the
CMD, BSNL ,
on the Kind intervention sought to the inordinate delay
in vacating the ‘Status Quo’ on AO to CAO promotion from
the Hon’ble CAT Chandigarh due to non-constitution of
the double bench in the CAT and requested to cause to
file a fresh MA at CAT Chandigarh to vacate the ‘Status
Quo’ - regarding
We would like to draw your kind attention to the
above-cited subject. The Promotions in the Grade of AO
to CAO are held up due to the “Status Quo” in the
Hon’ble CAT Chandigarh issued on 30.11.2018 and is
pending for the last 4 years resulting stuck the
promotions from AO to CAO for the last 4 years despite
the fact that ample vacancies are available. BSNL has
filed a Writ Petition in the Hon’ble High Court of
Punjab and Haryana Chandigarh challenging the Interim
Order passed by Hon’ble CAT Chandigarh in OA No
60/1435/2018 titled Anupam Yadav Vs BSNL on the above
subject. The Hon’ble High Court has delivered the
judgment dated 28.01.2020 in the CWP-9614-2019 (O&M)
that: “We deemed it appropriate to dispose of the
present WP with the direction to the learned CAT to
decide at least the application moved by BSNL for
Vacation/Modification of the initial impugned order
within 15 days of the next hearing. The learned CAT is
also requested to make an Endeavour to dispose of the
main OA at the earliest…” however no disposal has
been done by Hon’ble CAT Chandigarh even after the lapse
of more than two years from the direction given by the
Hon’ble HC of Punjab and Haryana in Jan 2020.
The case was posted for 27.10.2022 and is again
postponed for the next hearing on 14.11.2022 due to the
non-constitution/non-availability of the double bench at
CAT Chandigarh. The case has already been postponed 30
times due to one or the other reason in the Hon’ble CAT
Chandigarh.
In view of the above unfortunate conditions, it is
requested to kindly cause to ensure to get the ‘Status
Quo’ is vacated by filling a fresh Misc. Application at
CAT Chandigarh by bringing up the fact of non-commitment
of the Hon’ble High Court’s directions pronounced on
28-01-2020 to the learned CAT Chandigarh to decide at
least the application moved by BSNL for
Vacation/Modification of the initial impugned order
within 15 days of the next date of hearing and even
after lapses of around three years nothing has happened.
This is the right time to approach Hon’ble CAT
Chandigarh by filling a fresh MA for lifting the ‘Status
Quo’, especially on the fairground that even after a
lapse of around three years of pronouncement of the BSNL
favorable direction from the Hon’ble High Court to the
CAT. This association is damn sure that the ‘Status Quo’
from the Hon’ble CAT can be vacated without delay,
particularly by bringing genuine facts for consideration
of CAT Chandigarh that around 54 CAOs are only working
across the Country in BSNL against the Sanctioned
Strength of 672 posts of CAOs and there is an acute
shortage of officers in the Cadre of CAO and
difficulties have been faced by the BSNL Management to
run the organization with these lesser number of CAOs
working against the Sanctioned Strength. Moreover, it is
kindly mentioned here that the petitioner of this case
has already retired from BSNL services.
Hence, once again we would request your good self to
kindly intervene in the matter and cause to issue
necessary instructions to the officers concerned for
filling a fresh MA at CAT Chandigarh for lifting the
‘Status Quo’ called by the Hon’ble CAT Chandigarh so
that all vacant posts of CAOs in BSNL can be filled up
on priority basis. Thus the young DR-AOs of BSNL may get
the much-dreamed CAO Regular promotion since they have
been deprived of their due promotions for years together
and they will serve the Company with better Zeal
and Enthusiasm.
Sir, as you are well aware of the truth that the long
pending promotions in all streams, whatever the reasons,
turned thousands of heartened and motivated BSNL
executives to disheartened and demotivated. No way this
is entertaining a conducive atmosphere for the better
interest of BSNL. Out of the three Ps (Pay , Promotion,
and Perks) , granting eligible promotions to executives
not leaving any monetary burden on BSNL in most cases.
On the other hand, this will leverage more monitory
additions to BSNL through motivated employees through
promotions. In this pretext, this association requests
your performing office to devise a mechanism to issue
promotion orders in all streams across all cadres on
yearly basis through the ERP platform in line with the
granting of annual financial increments, Completion of
APARs, Completion of IPMS etc. This will certainly
enhance the performance efficiency level of BSNL and
this is the high demand of the time. Your attention is
kindly solicited to this proposal for auto issue of
Promotion Orders in BSNL on yearly basis for a better
BSNL.

at the Jai Prakash Narayan Airport at Patna in a
befitting way during his visit to Bihar .

that DIR (FIN) (Selected) discussed about the future
vision of BSNL and how it can be achieved through team
works. AIBSNLEA Bihar Circle apprised DIR (FIN)
(Selected) about various difficulties faced at
field level. DIR (FIN) (Selected) had a patient
listening to AIBSNLEA and shared that the CMD BSNL
and BSNL management are very keen on solving all these
difficulties and trying the level best to steer back
BSNL to its pristine Glory .

20.10.2022 Today the Leaders of AIBSNLEA CHQ met Member (Service) ,
Member (Finance) and other Senior Officers
in DOT at Sanchar Bhavan New Delhi . AIBSNLEA CHQ
Leaders extended Diwali Wishes and had a brief
discussion on the prevailing matters with BSNL including the
pending 3rd PRC for BSNL Employees.

17.10.2022 BSNL CO Modified the inter Circle Transfer of AGMs(T)/SDES
(T) of QA & INSP Circle:
The AGMs(T)/SDEs(T) of QA & INSP Circle in the attached
Order are retained in their present circle till
31-03-2023 on administrative ground with immediate
effect and until further orders .
On expiry of the retention period, the concerned
executive(s) will automatically get relieved to join
transferred circle(s), without waiting for any
correspondence from this office

hence not repeating once again here and the progress on
some of the points follows :
Update on SDE (E) to EE (E) Promotion:
Efforts of AIBSNLEA for the breakthrough in BSNL
Executives' Promotion by releasing the
SDE (E) to EE (E) Promotion
will be materialized hopefully by next week since the
clarity sought by BSNL from DoPT on the PwBD reservation
in promotion issue have been received .
The
SDE (E) to EE (E)
Promotion Process is solely initiated through the
directions by Hon. CMD BSNL on the letter
of AIBSNLEA and due to
the subsequent request of AIBSNLEA to CMD BSNL that
CPC
for Promotions from SDE (E ) to EE ( E ) may be
considered as there is no court case against the
promotion in Electrical
Stream and to share the
massage from Management that
BSNL Management is not against
any eligible promotions for the
employees while most expected promotion orders
in other streams are caused to
hit legal blockage
Promotion from AO to CAO Cadre:
BSNL Management has initiated the
preliminary work for CPC process for the promotion from
AO to CAO also solely after the relentless efforts by
AIBSNLEA only.
The
updation of Entry/verification of off-line APAR data in
respect of Accounts Officers for the period from 2010-11
onwards in SAP/ERP Portal is pending since long in many
circles. In this regard AIBSNLEA has submitted a request
letter to the GM(Pers). GM(Pers) assured to follow up
the same with all defaulted circles so that this issue
will not be hurdle in the finalization of CPC for AO to
CAO promotions.

Clear anomaly of protecting and
rewarding the executives, in the inter-Circle long Stay
transfer orders for executives having more than 26 years
of stay in a circle, who have disobeyed & challenged the
BSNL CO’s transfer orders but were permitted to continue
in their parent Circles. This has already created deep
division among BSNL executives and pushed down the
morale of the disciplined executives who have obeyed the
transfer orders and joined the transferred Circle; the
sample case of Transfer and Posting from J&K Circle ....
Respected Sir,
It is heavily constrained to bring to your kind notice
with immense respect that some mystifying transfer
cancellation/retention/ extension orders are getting
released from BSNL Corporate Office on the transfer
orders of executives under the inter-Circle long Stay
for more than 26 years, even after more than five months
of the release of the long stay transfer orders. This
association honour and share our sincere gratitude to
BSNL management, if the cancellation/retention/
extension of orders is released from BSNL Corporate
Office on genuine medical grounds. But, after
understanding the large quantum of
cancellation/retention/ extension of the transfer orders
and after receiving feedback from almost all of our
circle secretaries, we also feel that large numbers of
ineligible executives are also protected to continue in
their Parent Circle disobeying the inter-circle long
stay transfer orders. This kind of protection and reward
to those executives who have disobeyed & challenged the
BSNL CO’s transfer orders is extremely painful,
demoting, disbelief in the HR System of BSNL etc to all
those executives who have regarded the transfer orders
in great respect and joined to their newly transferred
circles in the interest of BSNL service. Moreover, this
would pave an unhealthy way for excuses for all future
transfer orders.
This association is in receipt of
resentment letters in this regard from many circle
secretaries. One of the complaint letters, from CS, J&K
is attached herewith for your kind ready reference
wherein the anomaly with respect to the inter-Circle
long Stay for more than 26 years elaborated as, Eighteen
(18) executives had been transferred out from J&K and
only Five(5) executives got relieved off and remaining
Thirteen (13) executives are still working in J&K
itself.

CS ( J&K) continued that out of 18 executive
transferred by BSNL corporate office , retention orders
issued for 07 executives , the transfer order has been
modified for one executive, the transfer order has been
cancelled for one executive , One executive is
transferred back to J&K & remaining three (3)
executives are not relieved yet even after 5 months of
issuing the orders. Many Circles are having the same
situation after release of the long stay transfer orders
from 02-05-2022. This is an embarrassing, unhealthy and
unbalancing situation in many ways and this situation
(pampering the dissidents and tampering with the
conformists) may not be permitted to sustain in BSNL for
the better interest of BSNL
Hence, with enormous respect, we
request your able office that the Circle Secretary (
J&K) of this association, Sh Puran Chand Thappa, DE ,
HRNo (99503858) having Sl No: 68 in the BSNL CO Order
Number No. BSNLCO-PETS/11(11)/1/2020-PERS1 Dated:
02-05-2022 got transferred to CNTXN (ExceptJ&K) and
joined as DE(Satellite) Sikandrabad at Satellite Earth
station in UP on 24-06-2022 may kindly be arranged to
transfer back to J&K in the ground of natural justice
and as a token of appreciation to honour the BSNL CO
transfer orders. If not, this shall send a negative wave
down the line to all executives that those who are
obeying BSNL CO orders would be betrayed especially when
the lion’s share (>72%) of dissident executives who
dishonoured BSNL CO transfer orders have been rewarded
to Stay Back in Parent Circle.
Sir, this scenario happened in J&K
with the inter-Circle long Stay transfers for executives
having more than 26 years of stay in a circle is almost
a cross-section of what happened in all other circles of
BSNL in respect of the long Stay transfer.
