.08.2021GS discussed with the concerned Officers in the BSNL  CO regarding:

(1)  AO /JAOs (under Rule 9) request Transfers: The request Transfers of AO/JAOs (under Rule 9) applied through online Portal (1^st quarter) are under process. After the approval of the Competent Authority orders will be issued shortly.

(2) Regular Promotion in the Cadre of

a) JTO (E) to SDE (E):  APAR Evaluation sheet & VCs have already been received for JTO (E) to SDE (E) Promotions for the vacancy period from 1.4.2018 to 31.12.2018. 56 JTOs are come in the zone of consideration for Promotion. Roaster Point and Vacancy particulars are being checked by the Pers.DPC Branch of the BSNL CO and CPC will be conducted shortly.

b) JTO (TF) to SDE (TF): The queries raised by the Pers.Branch regarding Roaster point in the eligibility list prepared by the TF Wing of BSNL CO has since been corrected and already submitted to the Pers. Branch by the TF Wing of the BSNL CO. It is being scrutinised by the DPC Pers Branch of the BSNL CO. After getting approval from the Competent Authority APAR Evaluation sheet & VCs will be called for.

c) JTO(C) to SDE(C): APARs & VCs have already been received for JTO(C) to SDE(C) Promotions and the scrutiny work is under process. However  DPC Section of Per.Branch returned the file to the CGM(BW) with some queries. After the receipt of the reply, it will be approved by the Competent Authority for conducting CPC

(3)Status of JAO 2016 Batch Seniority/ Gradation list: The preparatory work of Seniority/ Gradation list of JAO 2016 Batch is under process. Some more data regarding Date of Appointment/Joining is awaited from some Circles. All the Circle Secretaries are requested to co-ordinate with the concerned GM (F)/DGM (F) and Finance wing of the Circle and ensure timely dispatch of wanting details so as to release the Seniority/Gradation List of JAO 2016 Batch within 15.9.2021.

(4) All India Eligibility List No 3 of JTO (T): The preparatory work of AIEL No 3 of JTOs(T) recruited against the RY 2009 to 2012 is nearly completed. AIELNo.3  is expected to be issued very shortly.

(5) Conduction of CPC for E4 to E5 Financial Upgradation due on 1.10.2021 (37 Executives) & 1.12.2021 in respect of Telecom Eng,Wing Executives of BSNL CO: We requested the DGM(DPC-Pers) for the early issuance of the Financial upgradation orders. DGM mentioned that the DPC work is under process and after obtaining the VC the orders will be issued.

16.08.2021  Regional Outreach Bureau is inaugurating their office today in Carrier bldg MHS Compound Pune space of 15000 sqft carpet area. From 1st Aug rent started Rs 10 lakhs per month.
BBNL also occupied space at Baner rent of Rs 30000/- started from 1st Aug,21.

From July 21 Pune SSA leased out revenue increased by 1.55 cr per year including NVS leased out space at Bhavani Peth T E 2.5 lakh per month from 1st July.

13.08.2021  Release of Circle Quota by AIBSNEA CHQ regarding:

All the Circle Secretaries/Finance Secretaries are requested to prefer their claims to the  Finance Secretary CHQ at E-mail:  fschqaibsnlea@gmail.com (Comrade R N Chhabra, 7982168986/9416646742/9868231711)  for releasing their Circle Quota  up to June 2021. The month wise membership data along with amount  remitted to CHQ and Transaction ID number duly verified and certified by the AO CSC/DDO may also be furnished along with the claim.

As and when the claims are received from Circles with the above said data, their Quota will be released  by the CHQ.

.08.2021  GS, AGS (Fin) & Auditor met concerned officers in the BSNL CO on 11.08.2021 and discussed regarding-

It is reliably learnt that the corrected Eligibility list as per the directions of Pers. Branch will be sent by the TF wing today 12.8.2021 to Pers. Branch. After concurred by the Pers. Branch, the APARs & VCs will be called for.

(3)Status of JAO 2016 Batch Seniority/ Gradation list: The preparatory work of Seniority/ Gradation list of JAO 2016 Batch is under process. Some more data regarding Date of Appointment/Joining is awaited from some Circles. All the Circle Secretaries are requested to co-ordinate with the concerned GM (F)/DGM (F) and Finance wing of the Circle and ensure timely dispatch of wanting details so as to release the Seniority/Gradation List of JAO 2016 Batch in time.

(i) Shri Ashwini Vaishnaw ji, Hon’ble Minister of Communications & IT, Govt. of India, New Delhi regarding financial Revival of BSNL, Permission for Up-gradation of existing 2G&3G Equipments and immediate release of long pending outstanding dues to the tune of Rs.38,500 Crore from DoT to BSNL – <<<Click here for letter>>>

(ii) Shri. Anshu Prakash Ji, Chairman (DCC) & Secretary (T), DoT, Govt. of India, New Delhi regarding request for immediate release of long pending outstanding dues amounting to Rs.29,540/- crore to BSNL- <<<Click here for letter>>>

10.08.2021 Meeting with Shri P.K.Sinha, Member(Fin), DoT :

Com.S.Sivakumar,GS AIBSNLEA and AGS (Fin) met Shri P.K.Sinha ji, Member(Fin), DoT  and discussed regarding:

1) Immediate release of long pending outstanding dues to BSNL: We requested the Member (F)  for the immediate release of long pending outstanding dues from DoT to BSNL viz. Reimbursement of deficit in Rural wireline operations, Refund of Excess Pension Contribution, Reimbursement of Leave Encashment etc., so as to solve the financial Crisis of BSNL to the great extent, disbursement of  the Salary of BSNL Employees in time, payment of other pending bills by BSNL due to the present pandemic situation  and finally accelerate the Growth of BSNL.

Member (F) opined that the dues within the ambit of DoT can be processed and reimbursed/paid to BSNL. At the same time, refund of Excess Pension Contribution to be received from the Department of Expenditure is doubtful and further mentioned that the proposal for refund of Excess Pension Contribution has been returned by the Department of Expenditure with the dissent Note.

We further appraised the Member (F) that BSNL received last support for its Rural Wire line operations installed before the introduction of USO funded Schemes, for a period up to July 2013. The Rural wire line Network Infrastructure and Exchanges continue to be maintained by BSNL, and the existence of this Infrastructure has enabled Government in realizing the objectives of providing affordable access to Broadband services to Rural India/Gram Panchayats (GPs), through BharatNet Project. Whereas the deficit on account of maintenance of this infrastructure being borne by BSNL is not only draining its financial resources, the quantum of loss in its books of accounts is also impairing its capacity to raise fresh Capital from Banks and Financial institutions. The viability Gap Funding for Rural Telephony since 2014-15 to 2019-20 is Rs.13,789 Crores.

Member (F) mentioned that there are around 20,000 Rural Telephone Exchanges and if the BSNL Management identify the Services of the Rural Exchanges to be surrendered including VSAT Towers, then DoT will decide in consultation with Govt. of India, the non remunerative Services to be continued in Rural/LWE Areas/Border Areas/NE-I & II Areas/Hilly/Far flung Areas with the subsidy to be reimbursed from USO Fund with the approval of TRAI.

We requested the Member(F) to consider the same and immediate release of the viability Gap Funding for Rural Telephony, since  BSNL Management has requested the Secretary(Telecom) from September’2020 onwards to consider 80% of the fund requested as reimbursement of deficit in rural wireline operations on adhoc basis subject to further reconciliations.

After patient hearing and detailed discussions, Member(F) assured to consider the same with the approval of TRAI.

2) Borrowings and Letter of Comfort: We enquired about the status of Presidential approval for borrowings of Rs.13,787 Cr (Capex ₹ 5,000 Cr and Opex Rs 8,787 Cr) for the Financial Year 2021-22 up to a limit of Rs.41,213 Cr  for  the FY 2020-21 after Board approval has been sent to DOT during March 2021 and the Query on this matter was raised by DoT also replied by BSNL on 15.06.2021. Member(F) assured that the Presidential approval will be issued shortly.

We also enquired about the request of the BSNL Management  to provide Sovereign Guarantee for raising Rs. 10,000 Crores in the FY 2021 -22 and tenor co-terminus with existing loans and the renewal of Letter of Comfort to BSNL. Member(F) mentioned that it is under process.

3) Mortgage: BSNL requested for withdrawal of DoT letter No 10-12/2014-U.I dated 24.12.2014, so that BSNL can mortgage specified Land parcel & Building other than those offered to DIPAM as Security for availing Term Loan from Banks(***). Articles of Association of BSNL permits mortgage of Land & Buildings for raising funds.

Member(F) mentioned that BSNL is facing heavy Financial crunch, Debts and Debt Services are increasing in manifold whereas the Revenue is decreasing drastically in comparison to other TSPs. However to come out from the present financial crisis, the BSNL request will be considered favourably.

4) Immediate Steps to Off-set BSNL’s Debt through the Monetization of Land Assets:

We enquired about the Monetization of BSNL’s Surplus Land Parcels so as to clear the Rs.20,000 Cr Loan of BSNL in pursuance to the Union Cabinet decision dated 23.10.2019 since BSNL is having a Debt of Rs.30,000 Cr. The OPEX, CAPEX, Statutory and other Liabilities are also pending for more than Rs.13,800 Crores and it is likely to increase in the months to come. The Company is in the verge of getting into debt trap, which threatens its very future of BSNL.

Member(F) mentioned that the Monetization is getting badly delayed and opined that for Speedy Monetization of BSNL’s Surplus Land Parcels, BSNL Management has to take steps for getting the approval for Monetization of small parcel of lands through Re-Delegation of Financial Powers/Decentralisation of the same to the CGM Level Officers.

10.08.2021  Meeting with  Senior Officers of DoT:

We also met Senior Officers of DoT and discussed regarding:

1) Immediate release of long pending outstanding dues to BSNL : It is reliably learnt that the proposal for immediate release of the viability Gap Funding for Rural Telphony, on adhoc basis from USO Fund as requested by the BSNL Management is under consideration of DoT with the approval of the TRAI. During discussion it is mentioned that the full reimbursement of Rs.13,789 Crores from USO Fund is not at all considered, however an amount to the tune of several thousand crores can be considered.

2) Second VRS in BSNL: We enquired about the Media News regarding any possibility for implementation of Second VRS in BSNL. It is replied that no such proposal is under the consideration of DoT or Govt. of India since Financial condition of the Govt. is not up to the mark due to unforeseen expenditure during Covid-19 Pandemic situation.

3) Launching of 4G Services through upgradation: It is commented by the Senior DoT Officers that it is quite unfortunate that the proposal for upgradation of 18,000 BTSs supplied by M/s Nokia for West and South Zones with an Estimated cost of Rs.550 Cr has not been approved by the BSNL Board Meeting held on 23.07.2021. It is second time that the upgradation proposal was turned down by the the BSNL Board. It is a major setback for BSNL Revival plan and the 4G launching is unduly delayed even though the Union Cabinet given approval for 4G spectrum to BSNL from the Budgetary Support on 23.10.2019.

10.08.2021 GS AIBSNLEA writes to the Director (HR), BSNL Board regarding the Removal of the names of those LDCE 2007 SDEs, whose names are appearing in the Promotion order dated 08.07.2021 erroneously and One Time Settlement of LDCE 2007 SDE Reversion Case.

The reversion orders dated 06.9.2019 of 39 SDEs who have been promoted through LDCE -2007 has been continuously discussed with the Management, Director (HR), the then PGM(Pers) BSNL CO by the AIBSNLEA CHQ Team from Sep’2019 to May’2020 .  Finally,as requested by AIBSNLEA, a Committee has been formed with the then CGM(Legal) as Committee Chairman, PGM(Pers), Sr.GM(Estt) and Sr.GM(SR) as members  to look in to the issues regarding Reversion of 2007- LDCE SDEs (2001 DR Batch) during the month of May’2020.

AIBSNLEA submitted its views before the Committee Chairman and Members on 19.5.2020 as per the Directions of the Director (HR) and we had a detailed  discussion with the Committee Members. We appraised the Committee   that the reversion of the 2001 JTOs could have avoided as all of them are eligible as per the Schedule 12, Note 5 of the SDE RR 2002 read with the clarifications issued by BSNLCO dated 16.04.2007 and 10.07.2007 and the Management  allowed them to appear for LDCE 2007 –SDE(T) after scrutiny of their eligibility and also promoted them in SDE Grade. Considering the merit of the case, we requested the Committee that their Service in SDE Grade since 2008 will remain intact and they may not be reverted and the issue will be settled as one time measure and render justice to these executives.  <<<AIBSNLEA VIEWS submitted to the Committee on 19.5.2020>>>

Finally, Due to consistent  & continuous efforts and persuasion of AIBSNLEA,  the reversion orders dated 06.9.2019 of 39 SDEs who have been promoted through LDCE -2007 has kept in abeyance after the Committee Recommendation and as per the approval of Competent Authority on 12.10.2020 and it was ordered that they will continue to act as SDEs till the disposal of Review Petitions (WMP.Nos. 30392, 30942, 30943 &30936 of 2019) pending before Hon’ble Madras High Court.

But, we are surprised to notice that  Ten Executives who have  already been working as SDEs from 12.11.2008 onwards  as per the LDCE Promotion order dated 03.11.2008 were erroneously included in the recent JTO(T) to SDE(T) Promotion order issued on 8.7.2021 by the BSNL CO. The affected Executives have submitted  representations to the Pers.Branch, BSNL Corporate Office, New Delhi requesting removal of their names from the Promotion List since they have already been working as SDE from 12.11.2008 onwards. But till date their names  have not been removed from the Promotion List.

Hence GS AIBSNLEA requested the Director (HR) through Letter to kindly intervenue in the matter and cause to issue necessary instructions to the Officer concerned to remove/cancel the above said 10 names of the SDEs appeared in the Promotion order dated 8.7.2021 and settle the LDCE 2007 SDE Reversion case as one time measure so as to mitigate their  sufferings and render justice. <<<Click here for letter>>>

09.08.2021 Merger of  IDA with Basic Pay (Full 119.5% DA Neutralization) as on 01.01.2017 in respect of BSNL Employees

Com.S.Sivakumar,GS, AIBSNLEA writes to Shri Dr.Mahendra Nath Pandey, ji, Hon’ble Minister of Heavy Industries and Public Enterprises,  Govt. of India,

New Delhi Requesting  for consideration merger of IDA with Basic Pay (Full 119.5% DA Neutralization) as on 01.01.2017 in respect of BSNL Employees since 3rd PRC due w.e.f. 01.01.2017, has not been implemented for BSNL Employees.

After the release of 3rd PRC recommendations, Pay revision and Pension revision took place in all other PSUs in accordance with the guidelines of DPE. The affordability clause and the guidelines on Profit-oriented Pay rise have disallowed any Pay as well as Pension revision in BSNL. Though Pension is the commitment of DOT, they categorically clarified that the Pension revision will only follow Pay revision and the revision of IDA Pension will not be done automatically. The DPE guidelines on 3rd Pay Revision disallows Pay revision in BSNL on the plea of not earning Profit for the last three consecutive years. We put the demand that BSNL as a PSU under the control of Central Government and being the Strategic Sector purely a Service- oriented Organization should not be brought under the DPE Guidelines in respect of Profitability clause which permits Pay Revision. We are waiting for a long time for the revision of Pay since it is due from 01.01.2017. 

Hence in view of the above facts, We hereby submit the justification and suggestions for the favorable consideration of Hon’ble Minister towards the  merger of IDA with Basic Pay (Full 119.5% DA Neutralization) as on 01.01.2017 in respect of BSNL Employees since 3rd PRC due w.e.f. 01.01.2017, has not been implemented for BSNL Employees.

Hence in view of the above facts, We hereby submit the justification and suggestions for the favorable consideration of Hon’ble Minister towards the  merger of IDA with Basic Pay (Full 119.5% DA Neutralization) as on 01.01.2017 in respect of BSNL Employees since 3rd PRC due w.e.f. 01.01.2017, has not been implemented for BSNL Employees.

1.  1.We have not asked any Pay hike from 01-01-2017, we simply demand that the IDA of 119.5% (Full Neutralization) as on 01.01.2017 may be merged with the existing Basic Pay on 01-01- 2017, till the Pay Revision takes place, since it has already crossed 50%.

2.  In March, 2004 the Cabinet took the decision to merge 50% DA of Central Government Employees under the guidance of the then Hon'ble Prime Minister Shri A.B. Vajpayee ji

3.  The Merger of DA/ IDA with the existing Basic Pay is a routine practice whenever it crossed 50%.

4.  The merger of 78.2% IDA (Full Neutralization) was also ordered to take effect from 01-01-2007 for all the PSUs and it was implemented for the BSNL Employees and Pensioners also.

5.  The Union Cabinet under the Chairmanship of Hon’ble Prime Minister, Shri Narender Modi Ji has also approved the Merger of 125% CDA with the existing Basic Pay from 01-01-2016 i.e. before 7th Central Pay Revision.

6.  Since, BSNL Employees are not eligible for Pay Revision due w.e.f. 01.01.2017, as per the DoT version, we demand just to merge the IDA of 119.5% as on 01.01.2017 (full Neutralization) with the existing Basic Pay and extend the benefits as done in the past.

7.  If there is a Profit and weightage to the extent of 5%, 10% or 15% as the case may be, the BSNL has to allocate huge fund towards Pay Revision. But while there is no profit, we demand only merger of the IDA with the existing Basic Pay as done in the past which includes a very meager amount only to be borne by the BSNL.

8.  As long as there may not be a Pay Revision for BSNL Employees, in future, the BSNL Pensioners can get revise their Pension by simply merging IDA on due date independent of any Pay Hike. As and when the revision in Pay for BSNL employees, it will also be reflected in the Pension Revision.

9.  Through the merger of IDA with the existing Basic Pay, the BSNL Pensioners will also get some relief without further delay as they are waiting for their Pension Revision for more than Four and half years..

Hon’ble Sir, We would also like to bring to your kind notice that our suggestions regarding the issue of Merger of IDA of 119.5% (Full Neutralization) as on 01-01-2017 with the existing basic pay and extension of the benefit is as done in the past but without any increase/weightage to our present Pay Scales

In view of the foregoing, our changed but justified demand which is not a violation of any rules or guidelines but according to permissible rules may kindly be considered sympathetically and we would earnestly urge upon your kind Honor to kindly intervene in this matter and issue necessary directions to do the needful for the early settlement please……………..<<<Click here for letter >>>

AO to CAO "Status quo" Case- OA /1435/2018  has listed for hearing on  06.08.2021 is not heard  to day in Hon'ble Chandigarh CAT and  listed for next Hearing on 21.09.2021

04.08.2021 GS AIBSNLEA Com. S.Sivakumar discussed with DGM(Pers-Legal &SEA)  BSNL CO  regarding:

(1) Promotion from AO to CAO ‘Status Quo Case’- AO to CAO promotion Status Quo Case in respect of O.A.No.60/1435/2018 ANUPAM YADAV & OTHERS Vs BSNL is pending in Hon’ble CAT Chandigarh, which was listed on 08.07.2021. The Case was Adjourned with Directions and listed for next date on 06.08.2021. We already requested Director(F) PGM (Pers) and GM(FC&EF) to take up the case with BSNL Senior Counsel and CGM Punjab for early disposal of the OA in the Hon’ble CAT Chandigarh as per the directions of Hon’ble HC of Punjab and Haryana so that all Vacant Posts of CAOs in BSNL can be filled up on priority basis through promotion and the young AOs of BSNL may get CAO promotion since there is an acute shortage in the Cadre of CAO in BSNL. Only 38 CAOs are presently working in BSNL and BSNL is not moving further for promotions from among the available AOs due to the “Status Quo” ordered by the Hon’ble CAT Chandigarh. DGM (Pers) mentioned  that  Pers.Branch has already issued the instructions to the CGMT Punjab Circle and coordinated with ASG to follow up the Court Case on 06.08.2021.
