30.1.2021: 7th Circle Conference of AIBSNLEA Uttarakhand has been successfully conducted on today 30-1-2021 (Saturday). GS ,AIBSNLEA, Com. S.Sivakumar Participated virtually and addressed the 7th Circle Conference.  The Conference was conducted under the Presidentship  of Com. L.P.Thapaliyal, CP  with physical presence of the Dehradun H/Q members, Delegates & virtual presence of the General Secretary, AIBSNLEA,  Com.S.Sivakumar.  Com.Brij Mohan Dhyani Circle Secretary and CHQ Advisor welcomed  one and all.

Com.S.Sivakumar, General Secretary at the outset thanked Com.Dhyani and other Circle Office bearers for inviting him for the 7th Circle Conference. He explained about the  the Pre/Post VRS scenarios of BSNL and explained the Road map of BSNL Revival/Restructuring/Man Power Plan. He narrated AIBSNLEA’s relentless efforts at CHQ level for the betterment of BSNL Services and to settle down HR issues very favourable to the Executives. He highlighted the fact that it is only AIBSNLEA which not only understands the actual issues of the Executives but also actively pursues the same with the Management for favourable results. He explained the Status on the various pending HR issues as detailed below, which the Association is pursuing with the Management

 

1. Regular Promotions in all the cadres in all the Streams and Career Progression up to the level of GM/ CGM/ Director and the Status of CPSU CH and AIBSNLEA stand in this regard.

2. Full 30% SAB i.e. remaining 5 Percent Superannuation Contribution as realistic contribution

3. Pay Anomaly issue /Loss of Young DR/LICE JTOs/JAOs for getting Rs.22820

4. E1+5 increments for post 2010 DR/LICE JTOs/JAOs

5. EPF full Pension

6. Standard Pay Scale of E2 and E3 replacing E1A and E2A for all Post 2007 DR/LICE JTOs/JAOs and for the future DRs

7. Formation of Trust/Fund for PRMB (Post Retired Medical Benefits) for BSNL Recruits

8. Pension Contribution on Actual Basic Pay instead of Maximum of the Pay Scale.

9. Scrapping of MTRR.

10.Stand of AIBSNLEA in respect of CPSU Cadre Hierarchy.       

  He further mentioned that due to consistent efforts of AIBNLEA only, 13,000 Promotion orders were issued for various disciplines and assured that AIBSNLEA will always safe guard the interest of the Executives.

  He further explained about the current financial condition and Cash Flow etc.,

He mentioned that for the last two years BSNL Unions and Associations conducted series of struggles individually and jointly demanding implementation of 3rd PRC and settlement of other issues. But in due course the main focus of the AUAB has turned in to Revival of BSNL, Immediate allotment of 4G Spectrum, Issuance of Sovereign Guarantee Bonds, Approval of Land Monetization, Bank Loans/Financial Assistance to BSNL.

1.   Govt. Of India /DoT has not kept up their words fully in implementation of Revival Package of BSNL except implementation of VRS-2019 and approval of Rs.8500 Sovereign Guarantee Bonds.

2.   Even after expiry of 15 months of assurance, 4 G is not allocated to BSNL.

3.    Due to non-allocation of 4G, BSNL is put into continuous losses and in the financial  year 2019-2020 BSNL in to a loss of Rs.15500 Cr and the current debt of BSNL is around 21,875 Cr.

   4.  To install 4G Towers at 57000 Sites, Tender has been floated by BSNL to the tune of Rs.8600 Cr.on 23.03.2020, but cancelled by DoT on the plea of  “Make in India”. AUAB requested Hon’ble PM to grant permission to upgrade 49300 - 2G &3G BTS to provide 4 G Services which will cost only Rs.1500 Cr.  But the Cabinet approved that the Procurement, Commissioning/Launching of 4G Services through EOI Tender from Indian Domestic Vendors and denying the level playing ground to BSNL. As per the approval of the Cabinet, EOI Tender notified by the BSNL inviting applications from the Domestic Vendors on 1.1.20201 which will take another 2 years to launch 4G Services by BSNL. AIBSNLEA and AUAB accepted the “Make in India” plan of the GoI, but the Private Telecom operators were allowed to purchase Equipments from Foreign Vendors like Samsung, Nokia, ZTE, Ericson, etc., Permission may also be granted to BSNL on the same lines without any discrimination

5.   He insisted the Govt. should pay compensation to BSNL for not  allocating 4 G Spectrum as assured @ Rs.5000 Crores per annum.

6.    He insisted the DOT for the immediate release the Claims Payable to BSNL to the tune of Rs.30,000 Cr  viz., Compensation to BSNL for serving in Rural / Tribal/ Naxalite prone Areas, Compensation for carrying out Govt. Projects, Excess payment of Pension Contribution, Reimbursement of Leave encashment paid to the absorbed employees for the DoT period , Interest on Wi-Max Spectrum etc., which will definitely useful to BSNL in the Financial Crunch period for improving its services.

7.  Hon’ble Telecom Minister has given the Press statement that BSNL has become EBITDA positive due to Revival Package but actually BSNL is facing loss in the current F.Year also, if we taken in to account Depreciation, License Fee and Spectrum Charges  and Revenue earned comparing to last December 2019.

      He also mentioned that AUAB is planning to organise Agitational programme for the settlement of the following Issues/Demands:

1. Immediate allotment of 4 G Spectrum to BSNL as already assured on 23.10.2019 and immediate permission of the Govt.of India  to upgrade 49300 - 2G &3G BTS to provide 4 G service.

2. To pay compensation to BSNL @ Rs.5000 Crores per annum.for not allocating 4 G Spectrum as assured

3. Timely payment of Salary to the staff – i.e ., on the last day of the month.

4. Immediate Regular Promotion in all the cadres of Executives and Non-Executives.

5. Immediate payment of Compensation to BSNL for serving in Rural / Tribal/Naxalite prone Areas, Compensation for carrying out Govt. Projects, Excess payment of Pension Contribution, Reimbursement of Leave encashment paid to the absorbed employees for the DoT period , Interest on Wi-Max Spectrum etc., to the tune of Rs.27,275- Cr.

6. Deterioration in Quality of Service and more fault rates due to Cluster Tender and Outsourcing of Works/Massive retrenchment of Contract Workers.

And he appealed all the Unions and Associations to come together under one Umbrella “AUAB” to get the due financial support from the Govt so as to make the BSNL Viable and to regain its original pristine Glory.

He has made it clear that AIBSNLEA will keep up its separate identity and to continue to work to safeguard the interests of all the Executives and requested the Executives to  work hard to face the challenges and make BSNL viable and profitable and uphold the banner of BSNL and AIBSNLEA  so high.

BSNL Diary-2019 amount is outstanding from most of the Circle/SSAs. Very few SSAs/Circles are remitting the Diary amount to AIBSNLEA CHQ account, through AO(CSC). Hence all the Circle Secretaries and District Secretaries are requested to coordinate with the SDE(Admin)/AO Concerned / AO(CSC) for immediate release of O/s amount of Diary.

The Circle Secretaries purchased the 2019 Diary directly from CHQ are requested to remit the O/S amount to AIBSNLEA CHQ directly. In this regard details of POs placed by the SSA/DS/CS along with O/S amount is emailed to the concerned CS.

All the CSs /DSs are once again requested to coordinate with the SSA Administration for the clearance of O/S Diary amount of 2019.

28.01.2021: 7th Circle Conference of AIBSNLEA Tamilnadu Circle  has been successfully conducted on 23-1-2021 at Cuddalore. GS AIBSNLEA Com. S.Sivakumar and OS (South) Com C.Duraiarasan Participated  and addressed the 7th Circle Conference. In the Open Session CGM TN Circle participated as Chief Guest. Circle Secretaries from Sister Associations and Unions also participated and felicitated the Conference.

7th Circle Conference of AIBSNLEA Tamilnadu Circle was held at Cuddalore on 23.01.2021. The Conference was organised in a grand manner by the erstwhile Circle Office bearers and the Adhoc Committee Members jointly. Conference started at 0930 hours with Flag hoisting; National Flag was hoisted by Com.S.Anand, Ex-DS Cuddalore and Association Flag was hoisted by Com.C.Duraiarasan, Organising Secretary (South-CHQ).

The Conference was presided over jointly by Com.P.Tamilselvan, CP & Com.A.Aravazhi, Adhoc Committee CP. Com.P.Venkatesan, Circle Advisor welcomed the gathering. The Martyrs were remembered by Com.P.Mohan, CVP. Circle Secretary Com.Duraiarasan & Adhoc Committee CS, Com.S.Prabhakaran submitted the Circle Secretary Report. The Delegate Session started with opening remarks of Com.S.Karuppaiah, Organising Secretary. The District Secretaries, Presidents Delegates and Circle Office bearers have effectively participated in the deliberations.

The House whole heartedly appreciated the CHQ for settling the case of JAO Phase-III on-line training from Home and also the postponement of off-line training of JTO Phase-II.

In the Open Session CGM TN Circle participated as Chief Guest. Circle Secretaries from Sister Associations and Unions also participated and felicitated the Conference.

Com.K.Valanarasu, CS, SNEA has addressed the Conference. He appreciated the Circle Association for having smooth relationship with them and also requested to continue the same spirit in the ensuing period. He appealed AIGETOA to form a United Forum of Executives to settle the long pending issues of Promotions in all the cadres and CPSU Cadre Hierarchy.

Com.A.Babu Radhakrishnan, CS, BSNLEU and Com.K.Natarajan CS, NFTE (BSNL) have felicitated the Conference. Both in the same tone, have appreciated the key role played by our GS AIBSNLEA Com.S.Sivakumar in AUAB at CHQ Level and also the Circle Association especially former CS Com.C.Duraiarasan, in conducting the meetings and struggles conducted by AUAB in TN Circle. They also appreciated AIBSNLEA TN Circle  for standing united in the continuous movements relating to the Telecom. Co-operative Society issues. They assured the same spirit will continue in future also.

Com.Saravanakumar,CS, AIGETOA has explained that we have to concentrate to maintain guided/unguided Medium and Network assurance to retain the Customers and to focus on Battery Back-up and Outsourcing Tenders.

Com.S.Prabhakaran CS delivered Key Note Address. He emphasized that the Circle Management has to look in to the issues of Battery, Power Plant Maintenance and Tower Maintenance. He also mentioned that Cluster Outsourcing Contractors are not doing any Fault Maintenance but bills are being paid at 85 % of the bill amount due to the clauses in the EOI and payment of penalty to the TANGEDCO due to late payment etc.,

Com.C.Duraiarasan, OS (South) has appreciated the Circle Adhoc Committee for conducting the regular conference within the specified time without getting any extension of time limit. He requested the CGM to look into the following issues:

1. Restoration of Pension Cell with Finance and Admn. Staff for addressing the grievances of Retired Officers especially  on VRS-2019.

2. Refund of recovery of bulk amount from Ex-gratia from Officiating JTOs against the orders of Honourable Supreme Court and BSNL HQ - Coimbatore SSA.

3. Pay fixation case of AAOs - reduction in Pension - Coimbatore SSA.

4. Payment of Leftout Medical claims of pensioners up-to the period of Mar-2019.

5. Restoration of Opinion Leaders Meeting to discuss about the improvement of Services.

Shri.Jagadeesan,ITS, CGM, TN Circle has graced the occasion as Chief Guest. He mentioned that IN Revenue is increased by 10 % in TN Circle. We are able to provide 10,000 FTTH physical connections per month by which we have achieved the Target. In EB Segment also we achieved the target. But SIM sales as well as CFA revenue is coming down. He appreciated the Executives and Non-Executives who have contributed to achieve the Target. He also assured to settle the staff issues at Circle level.

Shri.Subratha Chatterjee, Sr.GM (HR & Admn) TN Circle has felicitated the conference as Guest of Honour. He mentioned that  the Executives as his colleagues and thanked them for giving excellent cop-operation in the past. He assured that he will take utmost care in settling HR issues of the Executives and thanked AIBNLEA for invited him for the Circle Conference.

Shri.S.P.Singh Nimrana, Sr.CE Electricals & Shri.Jayakumar Jayavelu, GM, BSNL, Cuddalore & Puduchery have also felicitated the Conference as Guests of Honour.

The Guests were  presented with Shawl and beautiful memento. After the felicitation session is over, a delicious lunch was provided to the Guests and delegates.

In the afternoon session, Delegates Session continued. About 1600 hours, Press Meet was held. Com.General Secretary has given a detailed note about the current financial status of BSNL and pending demand of AUAB and replied  the queries of the Press and Media Persons. Wide coverage was given in the local newspapers and Media in the next day.

In the evening, the Retired Circle Office bearers were honored with shawl and Special Memento. All the retired AIBSNLEA members those who attended the conference were presented with shawl and Memento.

General Secretary felicitated the Retired Circle Office bearers and comrades and explained the HR issues in detail. He has mentioned that our CHQ is functioning with more vigor and enthusiasm which is being appreciated by all the Executives of BSNL. He pledged to work to regain the recognition status of our Association in future. He requested the delegates to attract more members from the younger comrades to the fold of our Association by explaining our achievements in the past and present.

New set of Circle Office have been elected unanimously for the Next Term of 2021-2024. Com.I.Saravanan, CAO, Com.S.Anand, AGM & Com.K.Dhanasekar, AO have been unanimously elected as CP,CS and FS.

Com.K.G.Sasikumar SDE & Com.K.Tamilmaran, JAO have been elected as CWC members.

After taking oath by the newly elected office bearers, the conference ended with vote of thanks by the newly elected CS Com.S.Anand. 20.01.2021 GS writes to Director (HR) regarding conduction of JTO Ph-II Training on Online Mode scheduled in Jan./Feb., 2021.

Com. GS, AIBSNLEA today discussed with Sr.GM (Training) CO BSNL to convert the JTO Phase-II Training scheduled to be started from 15.02.2021 on Physical Mode to Online Mode due to COVID-19 Pandemic.  In this regard, GS AIBSNLEA already written a letter to Director (HR) and discussed the issue on 23.12.2020 itself. Sr GM (Training) assured to issue the orders for JTO Ph-II training on Online Mode.

08.01.2021 GS AIBSNLEA, AGS and CHQ-Auditor met Shri P.K. Purwar CMD, BSNL and discussed regarding:

 

a) E-Tender for Planning, Engineering, Supply, Installation, Testing, Commissioning and AMC of 4G Mobile Net Work : We enquired the CMD BSNL about the recent Detailed Notice Inviting E-Tender issued on 01.01.2021, sought proposal through the (EOI) Expression Of Interest from the Indian Companies for Planning, Engineering, Supply, Installation, Testing, Commissioning and AMC of 4G Mobile Net Work.

 

CMD, BSNL mentioned that as per the approval of DoT on 29.12.2020, BSNL Board has approved the proposal immediately and issued Tender Notification inviting proposal through EOI for the procurement of Equipments, AMC etc., for the tentative 57,000 4G Sites with prior Registration and Proof of Concept (POC) from the Indian Companies interested in participating the upcoming 4G Tender as per the initiative of GOI ÁTAMNIRBHAR BHARAT’ to promote Indigenous Manufacturing in Telecom Sector on 01.01.2021. CMD further mentioned that the Bidder or its Consortium Member(s) should fulfill the Technical Proven-ness requirement i.e, experience of Planning, Engineering, Supply, Installation and Commissioning. The Bidder not fulfilling Technical Proven-ness requirement shall be eligible for upcoming 4G Tender if they complete the POC successfully against this EOI.

 

CMD further told that through this E-tender Notification by Mass Media the message has gone to the nook and corner of India “that BSNL is going to launch 4G services shortly” and hopes that things will be changed in the positive direction very soon.

 

b) BSNL has to manage MTNL Mobile Net work on outsourcing basis: We enquired about the financial assistance, if any, will be given to BSNL by the Govt. to maintain MTNL Mobile Net Work in Delhi & Mumbai.  We told CMD that we have to invest very huge amount (CAPEX) to put back the MTNL Net Work in order and we have to insist Financial Assistance from the Govt., since BSNL itself is struggling for maintaining its own Mobile Net Work due to heavy financial crunch. CMD, BSNL informed that we have to wait for another one month for completing the formalities and then only we will assess the situation and our Targets.

 

c) Free Corona Vaccine to BSNL Employees treating them as Frontline workers: CMD BSNL mentioned that he has already gone through the letter given by AIBSNLEA in this regard and appreciated our concern for writing such a letter in the interest of BSNL Workers with a copy to Hon’ble Minister for Health and Family Welfare. He assured that he will take up the issue with the Secretary (H&FW) through Secretary (T).

d) Compensation and Financial Assistance to the family members of deceased BSNL Employees due to Covid-19: We requested CMD BSNL to consider the Compensation and Financial Assistance to the family members of deceased BSNL Employees due to Covid-19, AIBSNLEA has taken up and requesting for the past 6 months. CMD BSNL mentioned that the proposal was discussed in the BSNL Board Meeting in length but not considered due to heavy financial crunch.

 

e) Non remittance of SAB recovered from monthly Salary of  Apr’ 2020 to Nov’ 2020: We brought to the notice of CMD that SAB benefits in respect of DRs of BSNL recovered from the monthly Salary of Apr’2020 to Nov’2020 has not been remitted to the Concern Authorities, resulting in non receipt of Pensionery benefits by the Retired Officials. CMD assured to look in to the matter.

 

f) Restructuring and Regular Promotion in all the Cadres: GS appraised the CMD BSNL that thousands of Executives already drawing Higher Scales are working in the entry level grade of JTO equivalent and waiting for their 1st Promotion for the years together. Likewise SDE(T)/ SDE(C/E/TF/Arch)/ AOs/ CCS/ PS cadres are waiting for their regular promotions since long. The Promotions are held up by the Management in the name of Restructuring and various Court Cases on Reservation & Seniority issues. AIBSNLEA has continuously pursuing and requesting the BSNL Management for the issuance of Regular Promotion” Orders in all Cadres of all the Streams. We categorically told that AIBSNLEA strongly oppose any look-after arrangement in higher grade but we demand immediate promotions on ‘Regular Basis’.

 

CMD mentioned that restructuring proposal is likely to be finalized shortly and presented to the BSNL Board for Approval. CMD further told that Management is ready to consider the Promotions in all the Cadres but due to Hurdles created by filing cases in various Courts, Management is facing problems and not in a position to issue Promotion orders in a timely manner and dead lock is continued.

 

g) Discrimination in consideration of request transfers of Accounts Personnel: We brought to the kind attention of CMD that request transfers in respect of Accounts Personnel has not been considered  by the Management for the past 7 months in the name of Restructuring,  whereas request transfers have been considered in all other cadres. We also explained CMD BSNL about the problems being faced by the Accounts Personnel without family in other Circles for more than 3 years due to Covid-19 and requested him to consider the cases on Humanitarian grounds and issue necessary instructions to the concerned Authorities for issuance of transfer orders. CMD after patient hearing advised us to take up the issue with Director (Fin)/Director (HR) and also assured to looked into.

 

h) Compassionate Appointment to the family members of deceased BSNL Employees due to Covid-19: CMD BSNL mentioned that the proposal was discussed in the BSNL Board Meeting but not considered due to heavy financial crunch.

 

 i) Financial Status of the Company and benefits of Tower Company: CMD BSNL mentioned that the Company is earning Operating Profit (EBITDA positive) in the first half of the F.Y 2020-21 i.e., after 5 years and revenue is slightly increasing. We requested CMD for the disbursement of monthly Salary on the last day of the month. CMD told that our day to day Cash flow is not sufficient for our Operation and Maintenance and this year 2021 also BSNL will face severe financial crunch, since in addition to monthly/quarterly expenditure of Salary, O&M expenditure, Bank Interest, GST,TDS, L.Fee and Spectrum Charges etc., also BSNL is having Liability to pay Rs.3000 Cr to DoT Vendors in respect of Advance received for Bharat Net Projects. In addition to that BSNL is not yet getting any Loan from Banks for CAPEX on the basis of Sovereign Guarantee Bonds or fledging of Monetized Assets till date.

 

Regarding Tower Company CMD mentioned that BSNL earn several hundred Crores due to non remittance of L.Fee w.r.t. AGR but BSNL is getting very good revenue from the External Projects of Civil & Electrical Wing from Odisha, H.P and other Circles for which separate Escrow Account is being maintained.

CMD requested that each and every employee should work hard to increase our day to day collection/Revenue and follow the Austerity measures instructions issued by BSNL CO scrupulously to control over the Expenditure. We assure CMD BSNL that AIBSNLEA is always support the Management for the betterment of BSNL and finally requested the CMD BSNL to consider the Promotions in all the Cadres so as to boost the morale of the Young Executives in BSNL.

08.01.2021 Today GS AIBSNLEA, AGS (Fin) and CHQ-Auditor met with Shri R.K. Goyal, PGM (Pers) CO BSNL and discussed regarding:

(a) JTO to SDE (T) Promotions:  We enquired about the status of JTO (T) to SDE promotion. PGM (Pers) mentioned that the DPC work is going on in full swing. Required data is being/have been collected from the Circles. Personnel branch is trying its best to issue JTO (T) to SDE (T) promotion orders shortly but due to Court case pending in Jabalpur CAT, it is held up.

(b) Request for consideration of immediate Regular Promotions in all the Cadres: GS appraised the PGM (Pers) that thousands of Executives already drawing Higher Scales are working in the entry level grade of JTO equivalent and waiting for their 1st Promotion for the years together. We also brought to the notice of PGM (Pers) that recently, SCT Cell of DoT has issued an OM dated 13th October, 2020 (regarding Clarifications on the issues relating to Reservation in Promotion for SCs/STs.) after gathering the valuable Legal opinion/Advice and in consultation with the ‘Ministry of Law & Justice’’, ‘DoP&T’ and the ‘Attorney General of India’ on the specific clarification sought by the Parliamentary Committee on welfare of SCs & STs and requested PGM(Pers) to consider all the long awaited regular promotions in all the Cadres in the light of the recent Clarifications contained in DoT OM dated 13.10.2020.

PGM (Pers) mentioned that the Regular Promotion issue is under consideration with the BSNL Management but due to various Court Cases it is not immediately possible. However, Management is trying to sort out the regular promotion issue with a workable solution acceptable to all through discussions.

(c) Discrepancies in the Provisional Seniority list No.9 of SDE(T) for the Promotion to DE(T): We appraised the PGM (Pers.) about the discrepancies observed in the Provisional Seniority list No.9 of SDE(T) for the promotion to DE(T) issued by the Pers branch on 10.08.2020 and we categorically mentioned that the Provisional Seniority List No. 9 is not prepared purely on the basis of the date of joining in accordance with the judgment pronounced by Hon’ble Supreme Court, but it is prepared on the basis of Date of Joining within the vacancy Year. Any RR amendment is applicable from that date (that is Prospective in nature) but not on retrospectively. GS explained that AIBSNLEA CHQ has received more than 400 representations which have already been forwarded to Pers. Branch. We requested PGM (Pers) that the matter should be discussed with AIBSNLEA and the views of AIBSNLEA should be taken into consideration before finalization of the Seniority list No.9 of SDE(T) and to finalise the list without any deviation from the Hon’ble Court Orders so as to avoid any further Litigation. 

PGM (Pers.) mentioned that it is going to be finalized immediately and assured that the issue will be discussed with AIBSNLEA also and discrepancies will be removed and the list will be finalized purely as per Rules & Court Orders.

(d) Consideration of request transfers in the Cadre of Accounts Officer:- We requested PGM(Pers.) to consider the long pending request transfers in the Cadre of AO. We informed PGM (Pers.) that Accounts Personals are waiting for their request transfers since long whereas the transfer orders in other cadres are being issued regularly. PGM (Pers) mentioned that all pending genuine request transfers will be considered after the discussion with Director (Finance) and it will be issued shortly after getting the due approval from the competent authority.
