DoT Estt. wing conveyed Cabinet approval for operation
of ITS posts in BSNL/MTNL mentioned that a special
reserve of 560 posts for posting of ITS officers to
BSNL/MTNL will be non-diminishing for five years (from
Jan, 2022 to Dec, 2026) and it will be diminished in a
phased manner thereafter as BSNL/MTNL will develop their

AIBSNLEA writes to the CMD BSNL for the immediate
issuance of Promotion order of SDE(T) to AGM(T) for all
who are present in current Seniority Lists No. 8, 9 &
10, 11, 12 & 13 without accepting any room for divisive
politics made by the so called Majority Association.
There is no Ambiguity in Foot-Note -2 below Schedule 1A
of MSRR, 2009 as interpreted by the so called Majority
Association in an Un-fair manner and divisive language
of revulsion from narrow minded vision. By the Letter
addressed to CMD BSNL, the so called Majority
Association wants to derail or delay the ongoing SDE/AO
to AGM/CAO and equivalent promotion process.
In this regard Speaking order has also been issued by
the BSNL Corporate Office, New Delhi vide the above
cited reference to the Hon’ble CAT, Chennai through CGM,
Chennai with a copy to the respondent Association
AIGETOA on 27.06.2018,
wherein it was clearly mentioned that “However the
Competent Authority i.e., BSNL Board could not remain
obvious to the fact that both through the absorption of
erstwhile DoT/DTS/DTO employees and through recruitment
under its own 2001 RRs for JTO, a homogeneous mix of
engineering graduates and other graduates were available
in its human resource in the JTO/SDE grades on the date
promulgation of BSNL MS RRs. Also, it could not ignore
the fact that at no point in the past were any of the
SDEs, where engineering graduate or otherwise, made in
eligible for promotion to DE/AGM grades.”Besides,
in the instructions/guidelines for making RR issued by
O.M.No.AB.14017/48/2010-Estt..(RR)dt.31.12.2010, it has
been very clearly stipulated that [3.1.3 Where the
eligible Service for promotion prescribed in the
existing rules is being enhanced (to be in conformity
with the guidelines issued by this Department) and the
change is likely to affect adversely some persons
holding the feeder grade posts on regular basis, a note
to that effect that the eligibility service shall
continue to be the same for persons holding the feeder
posts on regular basis on the date notification of the

Corporate Office and explained about the details of 2nd
Revival Package for BSNL and also extended greetings to
the Hon. Prime Minister, Shri Narendra Modiji, Hon. MOC
Shri Ashwini Vaishnavji and Hon. MoSC Shri Devusing
Chauhanji for granting huge Revival Package 2.0 of
Rs.1.64 Lakh Cr for BSNL & MTNL and shown the trust on
BSNL. CMD BSNL mentioned that Govt. of India has shown
full faith on BSNL and now it is the duty of its
Employees to be got ready to work hard and deliver their
best with much effort to fulfill the trust put forth by
the GoI on BSNL.

efforts done by CMD BSNL & his team to convince all the
officers in DoT, Secretary(T), MOC, MoSC and the
officers in PMO about the importance and need of BSNL in
Strategic Telecom Sector as a Market balancer & National
Service Provider resulting granting of 2nd Revival

PSUs, such package was never approved earlier. It is the

esteemed support and active participation of AIBSNLEA in
the Organization call given by AIGETOA for the
resolution of long pending HR Issues-
Revival Package 2.0 for BSNL amounting to Rs.1.64 lakh
Telecom is a strategic sector. Presence of BSNL in
telecom market acts as a market balancer. BSNL plays a
crucial role in expansion of telecom services in rural
areas, development of indigenous technology and disaster
relief. To make BSNL financially viable, the Union
Cabinet chaired by the Hon'ble Prime Minister Shri
Narendra Modi Ji today approved the revival package of
BSNL amounting to Rs 1.64 Lakh Crore.
Revival measures approved by the Union Cabinet focus on
infusing fresh capital for upgrading BSNL services,
allocating spectrum, de-stressing its balance sheet, and
augmenting its fiber network by merging Bharat Broadband
Nigam Limited (BBNL) with BSNL.
AIBSNLEA CHQ on behalf of all its esteem Members extends

AIBSNLEA is the only Association taken up the issue of
Viability Gap Funding for Rural Wire line to the tune of
Rs.13789 Crore from 2014-15 to 2019-20 with MOC,
Secretary(T), Member (Finance) and through Hon'ble MP
Shri. Shanmugam ji from 2019-20 onwards and written so
many letters in this regard for the past 3 years. Our
CHQ team led by the then GS Com. S.Sivakumar and Com.
Rajpal Sharma, present CHQ President met Secretary(T),
Member (Finance), DDG (PM), other Senior DOT Officers
and MPs several times and insisted to release the
Rs.13789 Cr. Our former GS Com. Sivakumar insisted in
the AUAB meeting on 01.07.2021 to include the demand as
a Prime demand and AUAB included also. Ex GS
presented the detailed report to the CMD and Board of
Directors on 02.07.2021 in the meeting with AUAB. Former
GS Com. Sivakumar, Present GS Com. Shaji and CHQ
President Shri Rajpal Sharma met Honble MP. Shri
Shanmugam in Delhi and handed over the letter addressed
to MOC in this regard on 23.03.2022...Pl go through

from the Govt to release the BSNL dues and requested the
Chief Guest Hon'ble MP to take up the issue with the MOC
& GoI. Now due to consistent and continuous
presentations by the CMD BSNL and the efforts of
AIBSNLEA the old outstanding dues of BSNL to the tune of
Rs.13789 Crore have been included in the revival package

Meeting with Sr. Officers in Corporate Office:
CHQ President and Dy.GS AIBSNLEA met various Senior
Officers in BSNL Corporate Office in HR/ Pers, Estt., SR
& Rectt and discussed on vital issues in depth. Outcome
on the basis of the discussions on various issues is as
A) Promotion from SDE(T) to DE(T)/AGM(T):
We enquired about the latest status of the Promotion
process in SDE(T) to AGM(T). It is mentioned that the
CPC/ Promotion process is already started and promotion
order would be released after some due formalities.
AIBSNLEA has reaffirm it’s earlier view that all
eligible SDE(T)s who have completed the qualifying
service of 7 years (list 8 to 13) may be considered for
the AGM(T) promotions in one go to avoid any displeasure
among the eligible executives. Our concern was
appreciated by the Sr. Officers and shared our views
that all eligible executives will be promoted without
any prejudice and legal complicity. CMD BSNL has already
directed to go through the DoT & DoPT promotion orders
and depute the officers or call for the details/
clarifications to follow the same principle in BSNL in
respect of the reservation in promotions.
It is further enlightened, on our query, that the BSNL
Management is getting ready for SDET to AGMT promotion
and no further written consent is required and the
promotion will be happened as per the DoP&T OM dated
12.04.2022 read with OM dt 1997 regarding roaster issue.
If any clarification is required from DoT/DOPT in this
regard, it will be called for very quickly. AIBSNLEA
again reiterated & suggested that all eligible SDEs may
be promoted in a single go so that no future legal
hurdle/litigation would be there.
However it is opined that as per the Management
perspective, the promotions can be given to only
available vacancies. AIBSNLEA strongly protested against
it and exerted pressure that if the Promotions for SDEs
is given, please promote all the eligible candidates
from the list No 8 to 13 who have completed the eligible
7 years of service in SDE cadre as an one time measure.
It is mentioned that BSNL Management is trying its level
best to execute the promotion orders as early as
possible without any legal complexities. We emphasized
that promotion orders may be released without any
further delay since it is already delayed right from the
implementation of VRS 2019. It is again assured for the
early issuance of the same.
B) Promotion from AO to CAO:
We submitted that in the Hon’ble CAT Chandigarh, nothing
has happened on the latest date (14.07.2022) of hearing
also and this Association has been continuously getting
the appraisal from the members of Accounts fraternity
that the AO to CAO promotion has struck unfortunately
since 2018 in the Court of Law after calling “Status
Quo” from CAT Chandigarh. It is uncalled for that the
Status Quo is continued for the years together. Though
the Management is continuously trying to vacate the
“Status Quo”, but nothing has fruitfully happened since
29.11.2018 and all the eligible executives are very much
annoyed. This is a great concern for AIBSNLEA and hence
much more sincere efforts are expected from the BSNL
Management to release the AO to CAO promotion
immediately is quite natural. During the last discussion
with AIBSNLEA it was assured that if the Status Quo will
not be removed on the next date i.e. 14.07.2022, the
BSNL Management will move to the Higher Court for
further course of action. Now this is the high time to
approach to the Higher Court to get vacate the Status
Quo from the Hon’ble CAT Chandigarh.
This delay very badly affecting the working morale of
the affected Accounts Officers since the very unlucky
turn in their carrier happened in 2018 after the
issuance of the AO to CAO promotion and consequential
“Status Quo” called for by Hon’ble Court resulted some
of the AOs could not join on their CAO posts even after
issuance of their promotion orders and before the status
quo is ordered some juniors to them had fortunately
joined as CAO. The unluckily seniors faced handicap in
joining their CAO posts due to their inter Circle
transfer, not relieved and “Status Quo” ordered by the
Hon’ble Court. In turn, the AOs who are Seniors but AOs
even now and falling four years loss in CAO service
compared to their juniors when counted for next CAO to
DGM(F) promotion. This is a very big anomaly in the
History of the BSNL.
It is unfortunate that the JAOs appointed since 1996
onwards are waiting for their due CAO promotion for the
past 26 years. The eligible executives for CAO promotion
are very less, hence in the interest of the BSNL and
manning the CAOs/IFAs positions in the Corporate, Circle
HQs & Business Areas offices in an efficient manner
necessary relaxation for 15 - 16 days may also be
considered in the very interest of BSNL Services for the
promotions from AO to CAO in BSNL.
Concerned Sr. Officers totally shared our concern
empathetically and informed that Management is doing
their level best to vacate the “Status Quo” from the
Hon’ble CAT Chandigarh by engaging Sr. Counsel/ASG. This
time unfortunately Division Bench was not available and
the case was not heard and listed for 23.08.2022. On
query to approach to the Higher Court, it is shared that
at this stage if BSNL will approach to the Higher Court,
it may issue further notices to the related parties
resulted may take further more time and we may lose the
opportunity from the Hon’ble CAT on the next date of
hearing so it is not advisable at this stage and we may
wait for the next date of hearing for final disposal/
vacation of the Status Quo etc. Management side assured
once again that Management will take extra efforts to
get vacate the unfortunate hurdle in AO to CAO promotion
at the earliest and BSNL will be able to issue AO to CAO
promotion also since BSNL is incurring huge expenditure
in this case in the Court of Law.
C) Promotion for all other equivalent Cadres of SDE/AO
in all other Streams and further from AGM(T)/CAO to
DGM(Tel./Fin.), DGM (Adhoc) to DGM (Regular) and
We requested for the issuance of all pending promotion
orders in all other Cadres than Telecom/Accounts viz:
Civil, Elect, TF, Arch., PA/PS/PPS, CSS/CSSS etc. It is
mentioned that let the ongoing process for the promotion
from SDE to AGM be completed. Similar action will
immediately be initiated for the issuance of the
promotion orders for all the equivalent cadres also.
In respect of AGM/CAO equivalent to DGM equivalent and
also for Adhoc to Regular promotions, it has been
mentioned that presently the officers promoted in 2018
are not eligible for next higher promotion. As and when
any executive will be eligible and the vacancies are
available they will be promoted to the respective
regular DGM posts without any legal hurdles and any
relaxation cannot be considered at this stage. The
Management is very much keen to give the promotions for
all Cadres but any legal hurdle will badly delay the
process of promotions.
D) Huge reduction/cut in Accounts Officers’ Sanctioned
strength in Chennai TD and Kolkatta TD after BSNL
AIBSNLEA requested for the enhancement of the Sanctioned
strength of Executives in Accounts Cadre as proposed by
the concerned CGMTs of CHTD and Kol TD. We pleaded for
the enhancement of Sanctioned Posts of Accounts
Executives in these Circles on the performance basis at
par with Major Circles
In this regard it is replied that the Management is
analyzing and reviewing the situations once again and
the Strength of the Executives in Chennai TD and Kolkata
TD would be enhanced further as requested by AIBSNLEA.

AIBSNLEA submitted the bad fate of Executives of
Accounts Vertical in NATFAM Hyderabad. Along with the
merger of NATFAM Hyderabad to ALTTC Ghaziabad, the
Accounts Executives have also been transferred from
Hyderabad to ALTTC Ghaziabad without extending the
chance to exercise Options for the other Circles/BAs
etc., whereas options were called from the Executives
working in other RTTCs Rajpura /Jaipur /Lucknow for
their posting in Territorial Circles when those Training
Centers have been merged. Similarly, in Telecom side
also options have been called for when QA & Inspection
Circle is merged and we are thank-full to the BSNL
management that almost all the executives have been
retained in the same Circle as per their options. This
is an embarrassing situation for the Executives in
NATFAM only. It is re-assured to take remedial actions
in favor of the transferred Executives to ALTTC.
AIBSNLEA hoping that the orders for the NETFAM
executives also will be issued shortly.
F) Victimized transfer of DS Ludhiana to Patiala:
AIBSNLEA discussed the matter in detail. After patient
hearing it is mentioned that the request of AIBSNLEA has
already been taken up and the detailed report in this
regard is being called for from the CGMT Punjab Circle.
Accordingly the corrective action will be taken; is
assured by the Authority concern.
G) Bug in the APAR software package:
We have already written to the BSNL Management on the
issue to debug the malicious trap in the APAR software
package and save the future of several dedicated
officers already trapped, for the reason no way related
to them, through the avoidable bug in the ERP system. We
have reiterated that the inadvertent error while
reporting/ reviewing eAPAR has been reported by our
Circle Secretary, CHTD Circle causing non-consideration
of the Financial Up gradation/ promotion to the
executives and it is a highly regrettable matter. This
is not the lone case of Chennai TD. Understandably, in
some cases, the Reporting & Reviewing authorities giving
notes also in writing in favour of the affected officers
stating that the wrong option selected against
“Integrity” column under para 4 of eAPAR which has been
happened inadvertently and could not be corrected since
there is no option to revert it further after some time
line. These noting of the Reporting & Reviewing
authorities may be treated as “Beyond Doubt”. After
patient hearing it is informed that the matter reported
by AIBSNLEA is genuine and it has been taken up with the
concerned authorities in Corporate Office. Some
concerned officers are on leave and on their return;
after discussion necessary modification will be arranged
in the eAPAR software to avoid future recurrences.
Necessary guidelines/instructions will also be issued in
respect of the existing cases where it is happened
inadvertently and the affected executives are facing
hardship etc., It is assured to AIBSNLEA that no
executive will be left behind from their due
up-gradation/ promotion due to the inadvertent error for
the reason no way related to them. AIBSNLEA extended
since thanks to the BSNL Management.
Many individual genuine transfer cases like Chronic
Medical Ground, Couple Cases, Education Ground since the
Children studding in Higher Classes and other pending
OTP applications, Modification, Retentions etc.,
affected to our members have also been discussed in
detail. Cases of transfers where orders already issued
but not relieved yet have also been discussed and
several genuine cases have been agreed by the
authorities and necessary orders will be issued shortly.
The Sr. Officers appreciated AIBSNLEA in taking up
matters with the Management in a convincing manner.

demanding Rs.22820 Pay Fixation for all to avoid

Executives in terms of Mass Promotions in all Cadres
during 2018. Even though AIBSNLEA was the Support
Association by that time we could yield much for the
benefits of Executives when the then Majority
Association was asking for only CPSU cadre Hierarchy.
AIBSNLEA is always for the better promotion prospective
of Executives but on practicality.
Presently , even our long pending genuine promotions in
all cadres are lasting for years together and our
executive comrades are deeply frustrated in a way that
cannot be narrated here through words but it can be
experienced by those who have been really affected viz
SDE(T) to AGM(T) , AO to CAO , SDE(E) to EE(E) , SDE( C
) to EE( C ) , PS to PPS , PPS to Sr PPS and all others.
Here we are not blaming only to the Management for not
happening the promotions , but what contributions from
the MA(Majority Association ) and SA( Support
Association ) have been rendered is the matter of
concern for the Executives in BSNL. Had AIBSNLEA been in
the helm of affairs, certainly the promotion orders
could have been released already in all Cadres is an
assured fact based on our past experience as had been
showcased in 2018. Why did MA and SA sign MOU with
Management? What is the logic behind it? Do any OM from
DOT is there to issue promotion orders through MOU?
Moreover, what is the basic logic behind in arranging
signature from one welfare association for promotion ?
Is it not the utter failure of MA and SA ? In many
departments and PSUs , pending promotion orders are
being released and why only in BSNL it has been not been
happened ? Is it also not the failure of MA and SA of
BSNL ? Intentionally AIBSNLEA has not taken part in
this drama because we felt that MA and SA are not
serious on getting the promotion orders released, though
we have the support of Thousands of beloved executives
Executives made mandate for MA and SA for extracting out
the genuine rights of the executives including due
promotions from Management than engaging with some sort
of drama. Even now we feel that enough windows of
possibilities are there to get the long pending

Update on the Status of the Court Case filed by AIBSNLEA
against UOI (DOT) on Withdrawal of the Additional
Increment in the same Scale on Functional Promotion
under EPP: Writ Petition (C) No 9237 of 2018.

in the Hon’ble PB CAT New Delhi for quashing the orders.
Accordingly, Hon’ble PB CAT after some hearings quashed
& set aside the said order of DoT dated 05.07.2017. Even
after that DoT continued to reduce the pension of the
BSNL retiree executives, against this AIBSNLEA filed a
Contempt Petition in the Hon’ble PB CAT New Delhi.
Thereafter DoT stopped reducing the Pension/revising the
Pay fixation by obtaining an undertaking from the

the Honb’le High Court, Delhi. As per the suggestions of
AIBSNLEA in the meeting held on 30.09.2019, BSNL
Management again written a letter to the
Secretary (Telecom) on 22.07.2021 requesting to withdraw
the DoT order dated 05.07.2017. But surprisingly DoT vide
its letter dated 30.03.2022 once again directed to
implement the order dated 05.07.2017 which is against
Hon’ble PB CAT New Delhi order dated 21.12.2017 and it
is Contempt of Court.
AIBSNLEA CHQ promised and written on
website on 23.06.2022 that AIBSNLEA is going to issue “Legal Notice” to DoT,
and file the Application and Counter Affidavit in the Honb’le High Court, Delhi through our Sr. Counsel.
Accordingly AIBSNLEA has filed an Application in Hon'ble
HC of Delhi through our Senior Counsel immediately on
the opening of the Court on 04.07.2022 after vacations.
This Case is listed for Yesterday i.e. 13-07-2022, but
the Court could not sit on some reasons and posted
further for hearing on 05-08-2022.
AIBSNLEA is the only Association taken up
this very prestigious case wherein all Executives both
absorbed in BSNL and directly recruited by BSNL are
affected financially, especially during Pension
Calculation on Superannuation.

Status of All India Eligibility List of JAOs 2016 & 2018
AIBSNLEA CHQ met the concerned officers in BSNL
Corporate Office and enquired about the preparation of
the All India Eligibility List of JAOs recruited in the
Year 2016 and 2018. In this regard it is mentioned that
AIBSNLEA CHQ is pursuing this matter continuously for
the past 10 months. The list of 2016 JAO batch is being
consolidated & vetted by Pers branch.
There is a mismatch of details in respect of recruitment
& appointment previously. Now after getting recruitment
data from Corporate office Recruitment section and the
data received from various Circles are being reconciled.
AIBSNLEA is following the matter regularly. The AIEL of
JAOs of 2016 Batch is expected to be finalized within a
couple of weeks time.
After publishing of JAO 2016 batch list, the work for
reconciliation & finalization of AIEL for JAO 2018 batch
will be started and finalized soon.
