JOINT FORUM OF EXECUTIVES AND NON-EXECUTIVES :- GS, FS attended the joint forum meeting  and discussed the following issues

1)Rescind FDI increase in Telecom :- The Cabinet has now hiked Foreign Direct Investment (FDI) from 49% to 74% in Telecom Sector. Various reports have come in the media about the leakage of conversations through the private telecom companies. Increasing FDI to 74% further aggravates the situation adversely affecting national security. Certain restrictions or conditions made by govt. will have no effect on the MNCs, which will find out ways and means to overcome these restrictions

2)The Access Deficit Charge (ADC) :-  ADC is levied on the private telecom companies to be paid to the Public Sector PSU, towards providing telephones in rural areas which are financially unviable. Even then, only a portion of the loss of BSNL is made up by this. In last year also there was  huge reduction on this count. In Financial year of 2006-07 the ADC received by BSNL was about Rs. 3200 crores which will now be reduced to about Rs. 2000 crores adversely affecting the finance of BSNL as well as provision of phones in rural areas. The decision of Telecom Regulatory Authority of India (TRAI) is completely unjustified and intended to favour private telcos. It is stated that due to reduction of ADC, the rates of ISD will come down. But such hopes have been belied in the past. 3) Other issues concerning to the viability of BSNL

 

AAO COURT CASE : GS, President and FS met senior advocate engaged for AAO court case on 22.03.07 and held conference for about two hrs. All the relevant points were brought to the notice of the advocate to enable him to argue the case forcefully.

Today GS, President and FS attended the proceedings at Hon'ble Delhi High Court in connection  with AAO court case. The case was argued by our advocate effectively and the writ petition has been admitted. This is a very positive development. We are moving a separate application for early hearing of the above case.

 

GS met ED MTNL Shri A.K. Arora & discussed :-

(1) Providing Plan -499 with CUG facility to BSNL Executives working in MTNL Area as sanctioned by BSNL and also requested to stop disconnections of RSTC :- ED assured to look into.

(2) Delay in issuing the sanction for GSM Service Telephone Connections to Executives of BSNL from ED Office :- ED assured to look into.

 21.03.2007;    DDG(SR) invited AIBSNLEA for discussion on pending grievances of Executives submitted to CMD, BSNL for granting formal meeting.  GS and President attend the meeting and discussed all issues in detail.  DDG(SR) after having detailed discussion, advised to submit the revised matter on some issues of greater importance so that the meeting can be arranged. We will be submitting the revised letter shortly.

 21.03.2007;   GS, President and FS met DDG(Pers) and discussed:

 a) Consideration of pending request transfers of SDE/DE (Telecom):  DDG(Pers) informed that the pending request transfers of DEs are being issued shortly.  SDE(T) request transfer cases are also under process for approval of competent authority. Based on the vacancy existing in the circles, orders will be issued soon.

b) DPC from SDE(T) to ad-hoc DE(T):   DDG(Pers) informed that the screening work has been stalled in view of the orders of Hon’ble High Court of Delhi in the 1966 reversion case.  Revised seniority list is awaited from DoT.

c) DPC from JTO(TF) TO SDE(TF):  DDG(Pers) assured to look into.

d)  Clarification to issued regarding filling up of the vacant PAs/PSs posts in the field units: DDG(Pers) informed that the case has been examined and it is understood that since as per RRs the posts of PAs are to be filled up through 100% LICE, the posts can not be filled up on local officiating basis. We protested against this stand and requested to re-examine the issue.

e) Regularisation of Section Officers (ad-hoc) and filling up of vacant ADG post of CSS:   DDG(Pers) informed that BSNL Corporate Office has asked DoT to intimate the sanction particulars of the posts transferred to BSNL from DoT without which no promotion/regularisation can take place.  We protested against the arbitrary approach of the BSNL authorities and re-iterated that the matter may be settled on priority.

f) Consideration of left-out cases from JTO(T) to SDE(T):  DDG(Pers) informed that the ACRs of the eligible JTOs has been called for. Soon promotion order will be released.

g) Clarifications on Executives’ Promotion Policy:  DDG(Pers) informed that the HLC has already discussed the clarifications asked by AIBSNLEA and Telecom circles. The clarifications are being issued shortly.             

 19/03/2007:  

An interactive Session was also arranged after OPEN SESSION. In which Shri S.C. Misra, Sr. DDG(Estt.) BSNL New Delhi clarified all HR issues raised by Com. GS. The interactive session continued about Two Hours. Sr. DDG(Estt.) BSNL ND also clarified all the queries raised by the Delegates. 

Com. M.L. Pareek, CAO JPTD, Jaipur & Com. O.P. Jat, SDE(RTTC), Jaipur are elected as Circle President & Circle Secretary respectively.

Com. Prahlad Rai, GS after discharging his duties as Circle Secretary Rajasthan Circle will resume CHQ on 20.03.2007.

VALUATION OF PERQUISITE OF ACCOMMODATION IN RESPECT OF BSNL EMPLOYEES: BSNL BOARD HAS TAKEN DECISION THAT THERE IS "NO CONCESSION" IN THE MATTER OF ACCOMMODATION PROVIDED BY THE COMPANY (BSNL) TO ITS EMPLOYEES. IN VIEW OF THIS DECISION TAKEN BY THE BSNL THERE WILL NOT BE ANY DEDUCTION OF INCOME TAX FROM THE ALLOTEES OF QUARTERS. Shri Pradeep Goel AGS(C/E) and Shri P.C.Joshi AFS met DDG (Elect.), DOT and discussed regarding progress for cancellation of with drawl 2^nd ACP consequent upon the meeting held on 10^th Jan 2007 with Secretary DOT with the association: The matter was discussed in detail. DDG(Elect), DoT has assured to look into the matter with a positive view.

Shri Pradeep Goel AGS (C/E) and Shri P.C.Joshi AFS met Jt. DDG (B/W), and discussed  the following matters:

(a) Tenure transfers: We requested that transfer orders of all the officers who have completed their tenure at hard stations must be issued latest by 31^st March 2007:-  Jt. DDG (B/W) informed that the tenure transfer orders will be issued latest by 15^th April 2007.

(b) Promotion from JTO(C) to SDE(C):- Jt.DDG(B/W) informed that the file for adhoc promotions will be once again sent to Director (HRD) for approval.

(c) Promotions from SDE(C) to E.E.(C):- ACR and Vigilance clearance have been called for 53 SDE(C) and process started for 35 posts of Executive Engineer (C) and the DPC would be conducted soon. (d) Promotions from E.E.(C) to S.E.(C): - Promotion orders likely to issued shortly.

 

GS, President, AGS (Civil/Electrical), AFS met Sr. DDG (Estt.) BSNL and discussed :-

(a) Clarifications regarding Executives' Promotion Policy :-  As directed by Director (HRD) to HLC regarding issue of clarifications on Executives Promotion Policy asked by AIBSNLEA and Telecom Circles. Sr. DDG (Estt.) Chairman HLC informed that the clarifications asked by AIBSNLEA and other Telecom Circles have been received from DDG (Pers) & soon the meeting of HLC will be convened for clarifications. On some issues he  informally clarified that those who got Adhoc / Regular Promotion during 01.10.2000 to 01.10.2004 will be given first Financial Upgradation between 4 to 6 years, he also clarified that one time relaxation for training will also be given.

(b) Date of effect of implementation of revised IDA pay scale for the executives w.e.f. 01-10-2000:  We requested to grant the actual benefits w.e.f. 01.10.2000 :- Sr. DDG(Estt.)  confirmed that the comments of finance wing has been received. Now the case is being sent to Management Committee for approval. He also informed that the recommendations of Dr. Vinay Shai's Committee  are being taken into consideration.

(c) DPC from EE(C) to SE(C) :- Sr. DDG(Estt.) informed that the DPC work is over to fill up about 5 SE(C) posts and now case is sent for approval to CMD, BSNL.

 

GS, AGS (Civil/ Electrical), AGS (General Line Discipline) and CS Delhi Circle met Director (HRD) and discussed:-

j) Cancellation of Transfer order of two DEs promoted on adhoc basis: We requested for cancellation of transfer order of two DEs of Chennai TD Circle Shri Durairaj and Thungraj who have been transferred &posted on promotion to NE Circle from Chennai TD against the accepted Policy. Director (HRD) directed DDG (Pers) to look into.

a)  Issue of Minutes of the Formal Meeting held with Secretary, DoT on 10.01.2007:   We requested Secretary, DoT to direct the concerned authorities to issue the minutes of the formal meeting held on 10^th January, 2007 so that further follow up action can be taken up with DoT Administration/ BSNL Management.  Secretary, DoT directed Sr. DDG(SR), DoT to issue the minutes of the meeting immediately.   

b)  Improvement in the BSNL Executive Promotion Policy:   We impressed upon to review for improvement in the BSNL Executive Promotion Policy.  The Promotion Policy recently implemented is not as it was assured to Group B officers at the time of their absorption in BSNL, i.e. non-post based time bound promotion policy.  We also requested that the Promotion Policy available in other CPSUs is much better than that offered to us now. We requested that as soon as Navratna status is conferred on BSNL, the BSNL Executive Promotion Policy should be reviewed and brought at par with that available in other Navaratna PSUs. Secretary, DoT assured to look into.

c)  One time placement of SDE to the grade of Sr. SDE as on 01.10.2000 through cadre review concept in BSNL:  We requested Secretary DoT to intervene in the matter so that the agreements/assurances given by the Department of Telecom and BSNL Management at various points of time to provide one time placement of SDE in the Sr. SDE grade as on 01.10.2000 through cadre review concept is considered and agreed to.  Secretary DoT assured to look into.

d) Date to effect of implementation of revised IDA pay scales for the executives with effect from 01.10.2000, fixation of AAOs Pay-scale, withdrawal of 2^nd ACP to SDE(C), Non-integration of HR functions in BSNL etc.:   Secretary, DoT told that all these issues have been discussed in the formal meeting on 10.01.2007 for which the minutes will be issued shortly and accordingly implementation will take place. The matter of AAO pay-fixation is already being sent to Ministry of Finance with recommendations.

e)  Payment of Pension to Executives retiring from BSNL:   Secretary, DoT informed that the case was discussed even today in the Committee of Officers constituted for this purpose.  Thereafter this will be sent to Telecom Commission and finally to Cabinet.  We requested that the issue be settled at the earliest.  He assured that the matter being bigger one, will take some time but efforts will be to settle it favorably. 

f)  Absorption of Group A officers in BSNL :  We expressed our serious concern over the delay in the absorption process and the fact that the growth of BSNL is affected adversely. Secretary, DoT appreciated our feeling and informed that DoT administration is making efforts to resolve the issue and is having dialogue with the representatives.  About 3 meetings have already taken place and now the discussions are at final stage.  Hopefully, the issue will be resolved within a month or two. The decision of Hon’ble High Court, Delhi is also awaited where the case is slated for 16^th March, 2007 for final hearing.

06/03/2007:-GS, President and Editor met Shri Rakesh Babu, DDG(CS) and discussed;

a)      National roaming and STD facility on GSM service telephone connection to all executives,  STD facility on RSTC to all STS officers as available in DoT and STD facility on RSTC in one-India plan:  DDG(CS) informed that all these issues were discussed in the BSNL Management Committee but no decision could yet be taken by the MC.  He advised that the Association may further take up the issues with CMD, BSNL.

b)     Introduction of Plan 525 with CUG facility in MTNL area and disconnection of RSTC by MTNL in some areas:  DDG(CS) informed that matter has been taken up with MTNL authorities and soon necessary guidelines/instructions will be issued in the matter.

c)      Concessional Telephone facility to retired employees:  DDG(CS) informed that the Memo for Management Committee has been prepared and the same is pending with MC for a decision.

1966 SDE (T) Reversion Case : The case was heard on 26.02.2007 in Hon'ble Delhi High Court. The next date of Final Hearing is given 27th August'2007. During hearing we could understand that Hon'ble Court will be issuing instructions to respondents DOT/BSNL not to operate revised Seniority list of TES Group 'B' Officers issued on 11.11.2004. In view of Hon'ble Court directions reversion will become in-effective till the outcome of the Final Decision. Click Here for Copy
