In view of above and in line of parity, the amendment in Note 2 of Schedule IB of (Civil/ Electrical) of BSNL               MSRR-2009 at par to schedule IA ( for Telecom & Finance) and Schedule Ic (for Telecom Factory) is only               option to eliminate the all disputes and to pay way of “existing incumbents holding the post of executive               on regular basis on date of notification of these RRs shall continue to be eligible for promotion to the               grade of AGM (C/E)s EE (C/E)s “ so that the executives who have already draw higher pay of EE(C/E) (E5 or               E6) may also bear responsibility of the post. Sub. :- Request for arranging relieving of the DEs and DGMs on completion of hard tenure.               We would like to bring to your kind notice that many executives cutting across all cadres and disciplines               are waiting for their genuine transfer orders after completion of tenure postings in J&K, NE-I & NE-II ,A&N               and other hard tenure areas. Furthermore some DEs and DGMs have been compelled to stay in the hard               tenure areas even after issuance of transfer orders by Corporate Office, by way of not relieving them by               respective circles, against the will and interest of the executives. For example, Sri S.C.Maharana, DGM,               ETR, Siliguri, HRMS NO. 198306352 has completed 4 (four) years at Siliguri. It is surprising that transfer               order is issued by corporate office way back in Oct’2015 but the officer has not been relieved yet on the               pretext of his reliever not joining. Similarly Shri Ashis Kumar Pal ,AO NE-II Circle, Dimapur is not being               relieved for the last four months. This is resulting into their frustrations and making the transfer order in-               fructuous. Their last hope of relieving in ERP just after 3 months of transfer order is also not taking shape.               They are left with less than two years of service to superannuate. There are many similar cases also where               your esteemed intervention is highly solicited.               In view of the above, it is requested to cause necessary actions to relieve all the officers under               Transfer from tenure postings including Sri S.C.Maharana, DGM, ETR from Siliguri and to join in               Odisha circle at the earliest please. Sub:-  JAO,LICE  40%examination(2013Batch)under  New  syllabus  and  Request  for  Reserving  required               posts  for  those  approached  Supreme  Court  and  other  CATs  and  for  the  qualified  JAO  Candidates  of               Rajasthan Circle and Tamilnadu Circle but not declared as qualified due to want of vacancies due to               wrong calculation of vacancies –Reg.               We would like to bring the following to your benign consideration and favorable orders please.               The reductions of eligibility years were promulgated by an amendment for appearing the JAO, LICE, under               40% quota after the implementation of new syllabus. Further JAO LICE has been notified as per amended               RR. In this juncture we wish to submit our opinions relating to this issue for your benign consideration.               Due to the ambiguous questions and discrepancies in the JAO part II examinations conducted during the               year 2009, various court cases were filed. One SLP is pending before the HON’BLE Supreme Court and due               to this the provisional promotion orders were issued to the qualified JAOs in KERALA CIRCLE and they are               anxiously awaiting for regular absorption accompanied with the pre-appointment training. Many court               cases relating to the said JAO LICE examinations on various topics are pending before in several Hon’ble               Courts across the country and the final judgments are not yet awarded.
