working in the post of JTO for the past 12 years and they have undergone two terms of JTO(phase-I) training. In Tamilnadu Circle our Officiating JTOs had got clear verdict from Hon'ble CAT/Chennai vide OA.No.587/2013 that they have to be regularized against the vacancies upto 2000-01 and Hon'ble CAT/Chennai also questioned that how the persons who have completed seven years of Service as on 28.2.2013 made a claim to be accommodated on promotion against vacancies of the year 2001 or 2002 which was arisen before the date of their first appointment. The same OA 587/2013 was uphold by the Hon'ble High Court, Chennai In the meantime CGM, TN Circle filed a SLP in Hon'ble Supreme Court, New Delhi. No interim Injunction was granted by the Hon'ble Supreme Court, New Delhi in this regard. After obtaining approval from Corporate Office, New Delhi LICE JTO-2013 passed TTAs were posted in TN Circle (after undergone required training) by giving an undertaking (Subject to the outcome of SLP) In view of the above facts, it is requested that all the Officiating JTOs may be absorbed/regularized after the Field training against the vacancies of 2000-01 as per the judgement pronounced by Hon'ble CAT/Chennai vide OA 587/2013 and uphold by Hon' ble High Court, Chennai so as avoid Contempt of Court petition and further litigations . The reduction of eligibility years were promulgated by an amendment for appearing the JAO, LICE, under 40% quota after the implementation of new syllabus. Further JAO LICE has been notified as per amended RR. In this juncture we wish to submit our opinions relating to this issue for your benign consideration. Due to the ambiguous questions and discrepancies in the JAO part II examinations conducted during the year 2009, various court cases were filed. One SLP is pending before the HON'BLE Supreme Court and due to this the provisional promotion orders were issued to the qualified JAOs in KERALA CIRCLE and they are anxiously awaiting for regular absorption accompanied with the pre-appointment training. Many court cases relating to the said JAO LICE examinations on various topics are pending before in several Hon'ble Courts across the country and the final judgments are not yet awarded. In Rajasthan and Tamilnadu Circles 18 (4+14) of JAO Part II qualified candidates in the stipulated standards are awaiting for their absorption. So many precious years have passed away and their requests are not yet considered and the inordinate delay has its own impact. More over the vacancies declared for the JAO Part II, under 40% quota FOR THE EXAMINATIONS OF 2009 & 2012 were only in TENTATIVE NATURE and not year wise as stipulated for Competitive Examination. In this situation it is requested that before the conducting the ensuing JAO LICE examination under new syllabus, the required number of vacancies, in the respective circles, in the cadre of JAO, where the litigations have arisen/ candidates are affected due to notifications on TENTATIVE NATURE OF VACANCIES, may kindly be kept as reserved, keeping in mind to avoid the crisis, if any which may arise in future, otherwise it will force the deprived applicants to resort in the second round of litigation which is an avoidable one.
