In our opinion, keeping executives' in E3 scale for 10 years will result in huge demotivation and financial losses to already deprived executives. Therefore, instead of keeping executives' in E3 scale for 10 years, the promotion of executives' from E3 grade of SDE to E4 grade of DE is a better option by abolishing the non- functional grade of Sr. SDE altogether or the pay scale of Sr. SDE, DE, DGM and NFSG should be outrightly upgraded to E4, ES, E6 and E7 scales respectively to take the permanent solution. The associations have demanded for fixation in the upgraded scales of E2 and E3 w.e.f. from 01.01.2007 and payment of arrears may be considered when the financial position of BSNL improves. The Court case regarding JTO to SDE promotions in the Hon’ble CAT Bench Chandigarh came for hearing on 31st March 2016 and dismissed. However, still there is a stay order granted by the Hon'ble High Court of Kerala on promotion from JTO to SDE. The next date of hearing of the case in the Hon'ble High Court of Kerala is 04.04.2016. After vacation of the stay orders by Hon'ble High Court of Kerala, the CPC proceeding for JTO to SDE promotions will be expedited. ii. The Court case regarding SDE to DE promotions came for hearing in the Hon’ble CAT Bench Chandigarh on 31st March 2016 and posted for further hearing on 23.04.2016. Similarly, iii. The Court case regarding AO to CAO promotions also came for hearing in the Hon’ble CAT Bench Chandigarh on 31st March 2016 and posted for further hearing during May 2016. Actual date of hearing will be known shortly.  Status of Hon'ble Supreme Court case hearing on 16.03.2016 on TES Gr "B" seniority: In the Court No. 6 at Item No. 1 Hon'ble Mr. Justice Fakkir Mohamed Ibrahim Kalifulla and Hon'ble Mr. Justice S.A. Bobde heard the case on TES Gr."B" seniority wherein the 147 LDCE quota SDEs Senior advocate Mr. Saran demanded contempt against the recent 213 DGMs promotion orders. Hon'ble Apex Court after hearing the arguments didn't admit the contempt application mentioning that the 213 DGMs promotion orders have been issued subject to outcome of the court case and there is no stay order on promotions and this case is pending for hearing here in the Apex Court . The senior advocate of 147 SDEs further pleaded to decide the case along with the Rule-206 seniority case. But the Hon'ble court didn't agree on the plea and adjourned the court. Other side advocate Mrs. Rani Chhabra demanded de-tagging of the 147 SDEs seniority case from the Rule-206 seniority case. The next date of hearing will be intimated later on. Since, the contempt of the court against the DGM promotion is not admitted in the Hon'ble Apex Court, now BSNL management can continue to fill-up all the vacant DGM posts.  Status of cases CA No.4389/2010 (UOI & Ors. Vs. Sohan Lal Sayal), SLP (C) No.24303/2013 (K.S. Hegde Vs. UOI & Ors.), SLP (C) No.32284/2013 (Manoj Kr. Tripathi Vs. UOI & Ors.) and etc. on TES Gr "B" seniority in the Hon'ble Supreme Court on dated 16.03.2016: The next date of hearing in the matter is 18.04.2016.  Status of Court Case regarding referendum of Executive Associations in BSNL: The case regarding referendum of Executive Associations of BSNL came up for hearing on 23rd March 2016 in the Hon'ble High Court of Karnataka but could not be heard and deferred for four weeks. Next date of hearing will be intimated later on. Hon'ble High Court of Karnataka has presently granted stay orders on the referendum of Executive Associations of BSNL. TELEWAVE 44 MARCH-2016
