22.10.2013: CMD
writes to DoT for payment of arrears
due to 78.2% IDA fixation benefit: It
is reliably learnt that vide DO no.
1-19/2012-PAT (BSNL) dated
21.10.2013, Sh. R.K. Upadhyay, CMD,
BSNL wrote to Secy(T), DoT to reconsider
the decision of payment of arrears
to the BSNL employees for the period
01.01.2007 to 09.06.2013 in order of
positive boosting of moral of BSNL
employees at this crucial financial
position of BSNL.
It is also
understood that CMD has also
mentioned in the letter that as per
the agreement dated 12.06.2012 it
was agreed that the actual payment
will be made prospectively and
arrears will be deferred till the
financial position of the company
improves, but with the Presidential
Directives dated 10.06.2013 no
arrears will be paid. It has become
difficult to extent similar
treatment to working employees and
those who retired between 01.01.2007
upto 09.06.2013. He also requested
DoT to extent the benefit of 78.2%
IDA revision to the
officials/officers retired during
01.01.2007 upto 09.06.2013. |
22.10.2013:GS,
President, OS(East) met Member(S),
DoT Sh. S.C. Mishra and requested
him to confirm his presence to
attend the 4th AIC
of AIBSNLEA at Nashik(Maharashtra).
Member(S) mentioned that he will
confirm his programme shortly. We
had a detailed discussion about the
revision of pension and its arrears
for the executives/non executives of
BSNL retired prior to 01.01.2007 and
post 01.01.2007 to 09.06.2013.
Member(S) informed that he has
cleared the following proposal which
is being sent to DoP&PW /DPE/ DoE
for approval
(a) For
pre 2007 pensioners, the pension
will be revised as on 01.01.2007
applying the 78.2% IDA fixation but
the actual payment will be from
10.06.2013. The pension arrears
between 01.01.2007 and 09.06.2013
will not be paid.
(b) For
post 2007 pensioners, their pay will
be notionally fixed as on 01.01.2007
like serving employees by applying
78.2% IDA fixation. Permission is
being sought from DoP&PW for
relaxation of Rule-33 & 34 of CCS
Pension Rules-1962 so that pension
can be calculated on notional pay.
Their pension accordingly will be
revised from their date of
retirement but actual payment will
be from 10.06.2013 only. However,
other retrial benefits like leave
encashment, DCRG, Commutation will
be paid based on the revised
pension.
We protested against such
deprivation to the pensioners and
mentioned that withholding of
pension arrears is against natural
justice and decision by the Hon'ble
APEX court. Such decision will
unnecessarily drag the pensioners to
court of law. Member(S) mentioned
that he is aware such developments
likely to take place in future but
in view of the Presidential order
dated 10.06.2013 nothing else can be
proposed. |
22.10.2013:GS,
President, OS(East), AGS(HQ) met CMD,
BSNL and requested him to attend our
4th All India Conference at Nashik
as Chief Guest. CMD assured that
upto Monday he will confirm his
programme.
We also extended our sincere thanks
to him for writing a DO letter to
Secy(T), DoT to consider and modify
Presidential Directives issued on
10.06.2013 for implementation of
78.2% IDA pay fixation order for
considering the payment of arrears
to BSNL employees and pension
arrears to BSNL pensioners who
retired during 01.01.2007 to
10.06.2013. CMD appreciated our
concern and assured to discuss the
matter in DoT in person. |

DoT Ms. Annie Moraes and discussed
the 78.2% IDA implementation to BSNL
Pensioners. We protested the
proposal of withholding the pension
arrears and requested to consider
the proposal to avoid harassment and
injustice to the pensioners. She
appreciated our concern and assured
to have a fresh look in to the
matter. |

President, OS(East) met JST, DoT Sh.
V. Umashankar and discussed the
78.2% IDA implementation to BSNL
Pensioners. We protested the
proposal of withholding the pension
arrears and requested to consider
the proposal to avoid harassment and
injustice to the pensioners. JST
opined that he is in favor of giving
the pension arrears but for quick
decision and immediate relief to
pensioners he approved the present
proposal. |
18.10.2013: GS
met Member(Services), DoT and
requested for implementation of
78.2% IDA fitment benefit to BSNL
Pensioners, who retired Pre
01.01.2007 and Post retired
01.01.2007. Member(Services)
mentioned that now the case after
the comments of Member(Fin.), AST &
JST has came to his office & now
finally he has drafted the comments
i.e.
(a) Pre
01.01.2007 retired BSNL Pensioners: Their
pension will be consolidated pension
w.r.t. 78.2% IDA fitment benefit,
30% IDA pay fixation on 01.01.2007 &
accordingly their commutation DCRG
benefits will also revised.
(b) Post
01.01.2007 retired BSNL Pensioners: Draft
contained that BSNL Pensioners
retired after 01.01.2007 & before
10.06.2013, pension will be
notionally fixed up on the day of
his retirement and this proposal is
being sent to Deptt. of Expenditure,
DOP&PW & DPE for clearance because
at present no rule permits pension
revision on notional pay fixation.
The commutation DCRG & other
pensioner's benefits will be
consolidated w.e.f. 01.01.2007
itself. The actual payment on 78.2%
IDA fitment benefit will be paid
after 10.06.2013 only. No arrears
will be paid to BSNL pensioners
before 10.06.2013 since the BSNL
serving employees will also not get
arrears as per DoT order.We
emphasized that revised pension
arrears to BSNL pensioners can't be
denied as per Govt. rules & Hon'ble
Supreme Court judgments. Member
(Services) appreciated our concern &
agreed that legal cases can't be
avoided. |
10.10.2013: GS,
AGS(Finance) met Member (Services),
DOT and requested for early
issuances of 78.2% IDA pay fixation
order of BSNL Pensioners. Members
(Services) mentioned that the
proposal for fixation of pension
w.e.f. 10.6.2013 is in internal
clearance but till date it has not
been finalized due to different
views. Regarding arrear payment, he
mentioned that it is directly
related to BSNL serving employees
and in DoT order dated 10.6.2013,
BSNL serving employees will not get
arrears. Hence, BSNL Pensioners will
also get the same treatment.
Moreover, BSNL has commented about
revision of pension is "question
does not arise" has
also created problems which has to
be corrected by BSNL. However, he
told that after the internal
decision of DOT only the case may be
sent to nodal Ministers for
clearance. |
28.09.2013:: GS,
President, OS(East) and some Odisha
circle comrades met Sh. Shabaz Ali,
DDG(TPF), DoT and Govt. Nominee BSNL
Board director today at Bhubaneswar,
Odisha and discussed:
1) DoT
support to BSNL in its growth: We
requested to provide Govt support to
BSNL for its growth and survival,
because without the support of Govt.
No PSU can flourish/survive. DDG (TPF)
appreciated our concern and
explained that Govt. is serious for
the growth of BSNL and recently
Govt. Has recommended for the refund
of BWA spectrum charges of Rs 8300
Crs to BSNL and to waive off the
national loan. Hence, BSNL will be
benefited by getting relief of Rs
1400 Crs against national loan
payment to DoT as well as refund of
BWA spectrum charges Rs 8300 Crs
which will help in its growth. The
payment of pension contribution on
actual basic pay is being taken up
by DoT to cabinet along with the
MTNL employee's pension case
shortly.
2) 78.2% IDA fixation for BSNL
pensioners: We
requested for early issuance of the
order of 78.2 % IDA merger for the
BSNL pensioners. DDG (TPF) informed
that the matter has been referred to
DoP & PW for concurrence of
necessary relaxation to fix up pay
notionally for BSNL pensioners on
last pay drawn and paid. Hence the
pension arrears can be paid from the
date of retirement of BSNL
pensioners retired after 1-1-2007
and before 10-06-2013. He mentioned
that DoP&PW concurrence is expected
within 15-20 days and thereafter the
order from DoT will be issued. He
also clarified that it doesn't need
approval of cabinet since DPE OM
dated 2-4-2009 was issued after
cabinet approval only. He assured
early action in this regard.
3) HR
issues in BSNL: DDG(TPF)
as BSNL board Director mentioned
that now in all board meetings BSNL
management will apprise the status
of HR issues and will ensure true
implementation of cabinet decision
on ITS officers deployment and
promotion to BSNL absorbees. He also
mentioned that absorption process in
BSNL against CGM/GM/DGM posts under
rule 37 pension rule is over and
shortly the order will be issued.
Similarly, the promotion order of
BSNL absorbed Gr 'A' level officers
will also be issued against
JAG/SAG/HAG level posts.
Finally he appealed that the BSNL
employees should sincerely work for
its growth, since the Govt. Is
providing its full support to BSNL |

and discussed regarding
(a) 78.2%
IDA pay fixation of BSNL pensioners
retired pre 01.01.2007 and post
01.01.2007: We
expressed our serious concern
against the BSNL's reply given to
DoT on this issue wherein DoT is
making issue complicated as
mentioned by Member(S) in
yesterday's meeting. GM(Estt.)
clarified that BSNL has simply
replied the DoT letter but can't
stop DoT to issue order for BSNL
Pensioners pay fixation and pension
revision. On our request, he assured
that BSNL will sent a DO letter to
Secy(T) to clarify the position
shortly.
(b) Regularization
of offg. JTOs: We
requested to take immediate steps
for regularization of offg. JTOs.
GM(Estt.) mentioned that legal
opinion for creation of
super-numeric posts has been sought
from BSNL's advocates Sh. R.D.
Aggrarwala, Sr. Advocate and Sh.
Rathi, BSNL's Advocate in Harayana
Circle and their legal opinion is
awaited. However, he mentioned that
orally Sh. Rathi Advocate told that
creation of further super-numeric
posts may not be advisable Hence,
after receiving the legal opinion in
writing, some other steps will be
taken for regularization of Offg.
JTOs immediately.
(c) Allowing
option to JAOs who joined after
7.5.2010: We
requested to issue order to allow to
exercise option to departmental JAOs
who joined after notification of
NEPP on 07.05.2010. GM(Estt.)
mentioned that matter was processed
by GM(FP) for clarification and the
same has been taken up with GM(FP).
(d) Fixation
of pay on promotion for Executive
employees with 3% in the previous
pay and then 3% on
promotion: We
requested for fixation of pay on
promotion for executive employees
with 3% in the previous pay and then
3% on promotion as per DPE orders.
GM(Estt) mentioned that as per DPE
guidelines the matter is being sent
to DoT for clarification/endorsement
shortly.
(e) 20%
HRA to A&N Circle and NE-II Circle
Dimapur etc.: GM(Estt.)
informed that the matter has been
sent to DoT for the
endorsement/clarification of DPE
order in BSNL at par other PSUs.
(f) JTO
Phase-I Training to Offg. JTOs, who
have already undergone the same
training in WB Circle: We
requested to issue direction to WB
Circle. GM(Estt.) mentioned that
comments of GM(Trg.) are awaited on
this issue. |

01.01.2007. Member(S) mentioned that
matter is under consideration to the
Internal Finance of DoT and a
decision is to be taken that whether
DoT can implement order w.e.f.
10.06.2013 and the clearance is not
required from DoP&PW or Cabinet on
this issue. And in case the matter
is sent to other Ministries, the
reply received from BSNL , wherein
BSNL has categorically mentioned
that "The
referred orders have been
implemented in reference of absorbed
BSNL employees as on 10.06.2013
only. Since the orders are effective
only from this date, the issue of
pay revision , notional or
otherwise, of those employees who
retired between 01.012007 and
09.06.2013 does not arise".
has un-wantedly added this para in
the reply which may create problem
and it needs rectification. However,
he clarified that the matter is
being examined on all these aspects.
From the discussion, it appears that
the issue is being made further
complicated on the pretext of BSNL's
reply which can be resolved with the
intervention of Secretary, DoT or
Hon'ble MOC&IT. It is a great
discrimination to BSNL Pensioners
who retired prior to 10.06.2013. |

78.2% IDA merger for the pensioners::Vide
the action taken report on the
minutes of the 22nd meeting of
standing committee of voluntary
agencies (SCOVA), dated 12-09-2013,
item no 9, It is now officially
confirmed that DOT is processing to
extend the benefit of 78.2 % IDA
merger to the pre 2007 and post 2007
pensioners only from 10-06-2013.
This has already been reported by us
on 27-08-2013 and also on 05-09-2013
when we met DoT officers and
discussed the issue. This is a
serious injustice to the pensioners
as part of the pension of more than
one lakh pensioners is being
confiscated by such decision of DoT.

27.08.2013: Implementation
of 78.2 IDA pay fixation benefit to
BSNL Pensioners: GS,
AGS(Fin.) met Director(Staff) DoT Sh.
P. Khanna and Joint Secy(T), DoT Sh.
V. Umashankar and discussed about
implementation of 78.2 IDA Pay
fixation to BSNL pensioners.
Director(Staff) DoT mentioned that
the case has been sent to AST
through Member(S), DoT for
clearance from SU Cell for the pay
fixation on last pay drawn for
pensioners who retired from
01.07.2007 to 10.06.2013. He
mentioned that actual pension will
be revised w.e.f. 10.06.2013 only
and for notional pension fixation
the matter has to be sent to DoP&PW
to relax Rule-116 as special case.
We immediately met Jt. Secy(T), DOT
Sh. V. Umashankar and requested to
clear the proposal. Jt. Secy.(T)
traced the file and immediately
cleared it and sent to Director(PSU)
for further action. During
discussions he mentioned that
Member(S) has asked our comments on
last pay drawn proposal and now it
is cleared from us and it is also
proposed to get clearance from DoP&PW.
Hence, after the approval of DOT
Internal Finance clearance, it will
be sent to DoP&PW and thereafter the
pension revision will take place
w.e.f.10.06.2013 only. However, he
assured an early action in this
regard.
(b) Recruitment
of GMs/PGMs under Pension Rule-37 in
BSNL: JST mentioned that recruitment
under pension Rule- 37 in BSNL is
over , about 34 ITS officers have
applied. BSNL has already conducted
CPC to fill up CGM/PGM level posts
by absorbed ITS officers. |
27.08.2013 GS,
AGS(HQ), AGS(Fin.) and CS KTK
Circle met Director(HR), BSNL Board
and discussed the following
(a) Modifications
of DEs posting order on promotion in
KTK, TN, CHTD, STR Circles: We
requested for consideration of
modification in DEs posting order on
promotion in KTK, TN, Chennai TD and
STR Circles wherein many DEs have
been posted to distant Circles. Most
of the DEs have crossed 54-55 years
age and from distant Circles it is
difficult to look after their family
and health. Director(HR) after
detail discussions mentioned that
after examining the percentage
shortage in Circles some decision in
this regard may be taken.
(b) Filling
up of DGM posts: We
requested to fill up vacant DGM
posts. Director(HR) mentioned that
Sr. GM(Pers.) has been asked to put
up the proposal. He assured an early
action in this regard.
(c) Filling
up of vacant STS posts: We
requested to fill up all the vacant
STS posts in Telecom Engg. and
Telecom Finance wing by utilizing MT
quota vacant posts. Director(HR)
mentioned that 1000 DEs posts will
be enmarked for MT quota and similar
action in CAO Cadre will also be
taken. However, he told that Sr.
GM(Pers.) has been asked to move the
proposal so that in future regular
promotion only may take place at STS
level.
(d) Regularization
of Offg. JTOs: We
requested for regularization of 1500
Offg. JTOs by creation of
supernumeric posts. Director(HR)
assured to look into the matter.
(e) Restructuring
of AD(OL) Cadre: We
requested for restructuring of AD(OL)
cadre and revision of pay scale as
the Committee headed by Sh. Harsh
Wardhan, Addl. GM has already
submitted its report. Director(HR)
assured to look into the matter.
(f) Implementation
of 78.2 IDA Pay fixation benefit to
BSNL pensioners pre-retired and post
retired of 2007: We
requested Director(HR) to use his
good office to take up the matter
with DoT for early implementation of
78.2% IDA pay fixation case of BSNL
pensioners. He immediately spoke to
GM(Estt.) and directed him to
discuss the matter and assured for
early action.
(g) Filling
up the vacant EEs(C/E) posts: Director(HR)
mentioned that matter is under
consideration and shortly decision
will be taken in this regard. |

Gupta met Jt. Secretary(T), DoT Shri

discussed regarding
(a)
78.2% IDA fitment benefit for BSNL
Pensioners retired before and after
01.01.2007 : We
requested for early issuance of
order w.r.t. 78.2% IDA fitment
benefit for BSNL Pensioners retired
before 01.01.2007 and after. JS(T)
mentioned that the Presidential
Directive of BSNL Employees for
78.2% IDA pay fixation was issued
through their section but for BSNL
pensioners the necessary order has
to be issued by DoT Establishment
Cell under the control of Memeber(S).
However, he mentioned that one
executive order from DoT may solve
pension revision issue of both the
pensioners pre and post 01.01.2007
and advised to take up the matter
with Member(S).
(b)
Implementation of E2 and E3 standard
IDA pay scales for JTO/SDE
equivalent executives in BSNL: We
requested for implementation of E2
and E3 standard IDA pay scales for
JTO/SDE equivalent executives in
BSNL. JS(T) mentioned that he is
aware of the issue but was non
committal.
During discussion JS(T) expressed
his serious concern about the
Viability of BSNL and advised that
BSNL Unions/Associations should take
immediate steps for the revival of
BSNL. We explained that apart from
many reasons the accountability and
discipline in most of the Circles is
missing, also the Govt. support to
BSNL. He appreciated our concern and
mentioned that whether VRS can help
BSNL? But it can be implemented with

AGS(HQ) met DDG(TPF) DoT Shri Shahbaz Ali and requested for early
release of 78.2% IDA Pay fixation order of BSNL Pensioners retired after
01.01.2007 and pension revision order of BSNL pensioners retired before
01.01.2007. DDG(TPF) mentioned that matter is being dealt by STP Cell of
Estt. Section of DoT. However, he told that BSNL pensioners will get
arrears even if the order is delayed for some time. He clearly told that
in his opinion DoT has to issue the order since DPE has issued order
after the approval of cabinet. |
26.06.2013:GS,
AGS(HQ) met Director (Estt.), DoT and requested for immediate issuance
of the 78.2% IDA Pay fixation and pension revision order for BSNL
pensioners post retired on 01.01.2007 and pre retired 01.01.2007.
Director (Estt.), DoT mentioned that matter is under consideration in
STP Cell to draft the proposal for order in this regard. He assured an
early action. |

Decisions of Core
Committee meeting held on 14th June 2013.
A meeting of the Core
Committee of Forum of BSNL Unions / Associations was held on 14th
June at National Council office. The following decisions were taken
after detailed discussion:
1. 78.2%
IDA fixation and connected matters
Letters
to be sent to Member (F), DOT expressing appreciation and seeking early
issue of orders on pension, directions to CCA , BSNL etc. for payment
as per 78.2% IDA pay fixation. Another letter to be sent to DOT for
getting the arrears of IDA at least from 01-04-2013, with copy to BSNL
Management.
2. All
India Convention on Revival of BSNL
The All India
convention to be held at Mavlankar Hall, if available. The date is
tentatively fixed as 3rd August 2013. Approximately 1000
delegates are expected. Number of delegates for each union will be
allotted. Food packets and water will be supplied to the participants.
Necessary fund for the arrangements for the convention to be collected
from the all India unions. The arrangement for lodging of outstation
delegates will be arranged by the concerned unions for their members.
Members of Parliament /Trade union leaders will be invited to address
the Convention.
3. Com.
G.R.Sharma is entrusted with the task of collecting and managing the
funds in connection with the conducting of the All India Convention.
4. Efforts
should be made to meet all the Members of the GoM and present our view
point.
We
should meet Directors and all the concerned officers in BSNL with regard
to the procurement of equipment and other connected matters to ensure
that effective action is taken for the revival of company. |
Decisions of the Meeting
of the Forum held on 13th June 2013
A meeting of the Forum
of BSNL Unions / Associations was held at FNTO office at 1600 hours on
13th June 2013. Com. C.Singh GS NFTE presided. Com.
V.A.N.Namboodiri, Convener briefed the house about the developments
after the last meeting and the agenda to be discussed in the meeting.
After detailed discussion, the following decisions were taken.
I. 78.2%
IDA PAY FIXATION :
1. The
meeting congratulated the workers for the whole-hearted support and full
preparation for the Indefinite Strike from 12th June, which
compelled the DOT/BSNL Management to come down for discussion and
settlement by issuing the order for 78.2% IDA Pay Fixation w.e.f.
01-01-2007. The Meeting expressed its appreciation to DOT and BSNL for
the issue of the order, though belated.
2. The
meeting demanded that the HRA and other allowances should be paid on the
basis of the 78.2% IDA pay fixation, at least from 01-04-2013, as per
the agreement of 12-06-2012.
3. DOT
Orders for 78.2% fixation for pre-2007 pensioners should be got issued
at the earliest.
4. For
the post-2007 pensioners, clear instructions should be got issued so
that there will be no ambiguity in drawing their pension with the 78.2%
IDA fixation.
5. Any
other issues arising in this connection should be taken up with
management.
II. SUPERANNUATION
BENEFIT OF BSNL RECRUITED EMPLOYEES :
The Forum decided to immediately take up the issue of 30%
superannuation benefits to the BSNL recruited employees as this was one
of the agreements on 12.06.2012. The other two agreements, CCL and 78.2%
fitment are settled now. As per the agreement, the committee constituted
already submitted its report. The Management has to take a decision
immediately. has to seriously deal with the issue.
III. REVIVAL
OF BSNL & CONNECTED MATTERS:
The Convener reported about the actions taken by the Forum so far
including the submission of Memorandum to the Chairman, Group of
Ministers, other Members of the GoM, Prime Minister etc. Some senior
Members of Parliament of various political parties have been met and
requested to take up the matter with the government. This has to be
continued. After thorough discussion, the following decisions were
taken:
1. To
organise an All India Convention at New Delhi in the first week of
August 2013 to focus the attention on the revival and strengthening of
BSNL, connected matters and providing better service. Similar
Conventions at Circle and District levels should be organised within the
next three months.
2. Pressurise
the BSNL Management and ensure that the Works Committees are held
regularly which should be effectively utilised for improvement of
services.
3. Regular
meetings/interactions of the Forum leaders with the Management have to
be held so that issues connected with expansion, development,
procurement of equipment etc, can be effectively discussed.
4. Sustained
efforts and actions to be taken to oppose and defeat the anti-PSU policy
of the government which is hampering the growth of BSNL. The management
should be continuously pressurised for efficient functioning and the
workers should be educated and motivated for providing a better
service.
5. A
Core Committee of the Forum is formed to negotiate with the DOT,
Management etc. and for effectively intervening in settling the issues.
The following are the members nominated to the Core Committee: Coms.
V.A.N.Namboodiri(Convener), P.Abhimanyu (BSNLEU), C.Singh (NFTE),
Jayaprakash (FNTO) K.Sebastin (SNEA), Prahlad Rai(AIBSNLEA) and N.D.Ram
(SEWA BSNL).
6. The
Forum should be formed in all circles and SSAs without further delay.
IV. CLOSURE
OF TELEGRAM SERVICES OPPOSED:
The meeting expressed
its strong protest against the decision of the BSNL to close the
telegram services w.e.f. 15th July 2013. The Unions were not
even consulted. The Forum will discuss the issue with the management to
ensure that the telegram services are maintained.

1930 hours with vote of thanks by the chair. |
14.06.2013:Core
Committee of the Forum meets:
The Core Committee of the Forum met today the 14-06-2013, and discussed
about the implementation of the decisions taken by the Forum in it's
meeting held yesterday. Com. V. A. N.Namboodiri, Com. P. Abhimanyu, com.
Chandeswar Singh, Com. K. Sebastin, Com. Prahlad Rai, and Com. K.
Jayaprakash participated in the meeting. The following decisions are the
decisions:-
1) To hold the National Convention at New Delhi, tentatively
on 03-08-2013. It will be held in the Mavlankar Hall. Delegates from all
the circles should attend the Convention. Prominent trade union leaders
and members of the Parliament will be invited. Other details will be
finalized by the Core Committee shortly.
2) Members of the Core Committee should meet the Group of Ministers
immediately and present our case on BSNL's viability.
3) Members of the Core Committee should meet the concerned Directors of
BSNL Board as well top officers of the Corporate Office and discuss
about increasing the revenue, improving quality of the services, etc. |
14.06.2013:Forum
decides to launch a powerful nationwide movement to strengthen BSNL:A
meeting of the Forum took place at New Delhi yesterday the
13-06-2013, to essentially discuss about the ways and means to improve
the financial viability of BSNL. A very useful and constructive debate
took place. It was decided in the meeting, to launch a nationwide
powerful movement, involving the employees, to improve the financial
viability BSNL. The following decisions are taken in this direction:-
1) To continue to unwaveringly fight against the wrong and anti-BSNL
policies of the government.
2) To continue to take action with a view to pressurize the BSNL
Management for timely procurement of equipments and all essential items
for improvement of the quality of services.
3) To conduct a campaign among the employees for the improvement of
their work culture as well as their interactions with the customers.
4) To continuously keep a watch on the wasteful expenditures being
incurred by the Management and to stop it. |
14.06.2013:Forum
decided to conduct conventions at National, Circle and District levels:
With a view to
effectively launch the nationwide campaign to strengthen the viability
of BSNL, it is decided by the Forum to conduct conventions at the
National, Circle and District levels. The National Convention will be
held at New Delhi, in the first week of August, 2013.The conventions at
the Circle and District levels will also be conducted expeditiously |

thefunctioning of the Forum was discussed. With a view to take timely
decisions and interventions, it was decided to form a Core Committee.

13.06.2013:Meeting
of Forum of BSNL Unions and Associations held on 13.06.2013:
The Forum of BSNL Unions & Associations
leaders met and discussed regarding proper implementation of 78.2% IDA
Pay Fixation order for serving employees and BSNL Pensioners. It was
decided that Forum will immediately discuss with BSNL Management to
review 78.2% IDA Pay fixation w.e.f. 01.04.2013 as per agreement since it is
already delayed by one year and during this FY-2012-13 BSNL's losses have been
reduced from Rs. 8600 Crores to Rs. 8200 Crores. Similarly, it was
decided to impress
upon DoT for early issuance of 78.2% IDA Pay fixation order for BSNL
Pensioners retired before 01.01.2007 & after 01.01.2007.
2. Forum discussed the issues related Viability of BSNL i.e. Govt.
support as committed at the time of its formation, procurement of
material in field units and improvement in quality of services in
available resources by changing our attitude etc. Forum will continue to
impress upon Govt. of India for refund of Rs. 8000 Crores BWA Spectrum,
Notional Loan, reimbursement of license fees & USO charges, payment of
OPEX charges etc.
Forum will also continue to oppose VRS, disinvestment of BSNL and
Unbundling of BSNL's last mile conductor etc. Forum will impress upon
BSNL Management for early procurement of material viz Telephone
instruments, Cables, Jointing Kits, Type-II BB Modems, MLLN Modems, OF
cables, GSM equipment and Battery & Power Plants etc.
In this regard, Forum representatives will regularly meet CMD BSNL, Board
of Directors and other concern senior level officers for early
procurement and to monitor the developments regularly.
Forum also decided to organize National Convention in the First Week of
August-2013 at New Delhi and thereafter within three months the state
level conventions to create awareness w.r.t. Viability of BSNL. District
level conventions will also be organized during next three months.
A
strategic group (Core Committee) of Forum comprising General Secretaries
, AIBSNLEA, BSNLEU, NFTE-BSNL, FNTO-BSNL and SNEA(I) is constituted to
hold regular meetings for day to day work monitoring purpose. Forum
meeting will also take place once in a month positively to monitor &
discuss the developments.
Forum leaders also discussed for the full implementation of agreement
signed on 12th June'2012 especially for the purpose of
provision of superannuation benefits to directly recruited employees as
per DPE guidelines. A committee was constituted one year before to
examine the matter and to submit the recommendations but till date
committee has not submitted the report.

12.06.2013:
78.2% IDA
Pay fixation for serving employees and BSNL Pensioners:
GS discussed with the concerned officers BSNL
Corporate Office, PAT Cell regarding implementation of 78.2% IDA Pay
fixation order w.e.f. 01.01.2007 for serving employees and BSNL
pensioners. It is clarified that pay fixation on 78.2% IDA will be w.e.f.
01.01.2007 and allowances from 10.06.2013. The arrears may be paid
only when BSNL starts making profit as per the agreement. At present,
the medical reimbursement with voucher for outdoor treatment,
Professional Upgradation Allowance and HRA will continue to be paid at
Basic Pay with 68.8% fitment. On this issue, we immediately discuss the
matter for immediate review on 01.04.2013 as per the agreement since the
order is delayed upto 10.06.2013.
It is also clarified that DoT will shortly issue order for BSNL
Pensioners revision of Pension Order on the basis of 78.2% IDA fitment
benefit who retired after 01.01.2007 to 31.05.2013. On that basis only
the BSNL C.O. will endorse to all the Circles for revision of Pension
Order (L.P.C.) and it will be sent to respective CCAs for pension
revision. The arrears will be calculated as per DoT order only.
It is understood that the pensioners who retired before 01.01.2007 or
upto 31.12.2006 for them DoT may consider for pension revision. On this
issue Unions/Associations have to pursue immediately for early orders. |
12.06.2013:
GS,
AGS(HQ) met GM(SR) and discussed
(a) Membership Verification of
Majority executive Association :
GM(SR) mentioned that BSNL Corporate Office SR
Cell has already processed the proposal for Membership Verification of
majority executive Association in BSNL.
In view of this, all the CHQ Office Bearers, Circle/ Branch Secretaries
are requested to concentrate on Organisational activities to strengthen
the Association and to achieve majority Executives Association status
when the referendum starts.

Settlement of the pressing
issues discussed in the formal meeting held with AIBSNLEA on 29th
- 30th April'2013:
We requested for early settlement of
the pressing issues discussed in the formal meeting held on 29th
- 30th April'2013 with AIBSNLEA. GM(SR) mentioned that one
important issue of our charter of demand i.e. implementation of 78.2%
IDA Pay fixation has been resolved and the other issues like withdrawal
of local officiating promotions and introduction of looking after
arrangements, introduction of E-1, E-2 standard IDA pay scales for JTO/SDE
equivalent executives, CPCs to fill up HAG/SAG/JAG/STS/Group-'B' level
posts and other important issues have been discussed with the concern
GMs and now these issues will be shortly discussed with Director(HR) and
CMD, BSNL for early settlement. |

to call off the Indefinite
Strike to be organized from 12th June, 2013
in view of the
orders issued by DoT & BSNL for implementation of DPE OM dated 2nd
April, 2009 on implementation of 78.2% Pay fixation w.e.f.
10.06.2013.
Congratulated
all the BSNL employees for their full support & involvement in making

Historical achievement of Forum of BSNL Unions and Associations on
implementation of 78.2% IDA Pay fixation
Forum of BSNL Unions and Associations continuously persuaded for
implementation of DPE OM dated 2nd April,2009 on 78.2% IDA
Pay fixation for the last four years. The OM was issued as a total
package of 2nd PRC recommendations and that time
BSNL's net profit for the year 2008-09 was Rs. 574 crores after tax and
1272 crores before tax. But the
BSNL Management continuously pleaded that since BSNL has started making
losses since the years 2009-10 onwards, it is not possible to implement
the DPE order. BSNL Unions and Associations also did not pressurize the
Management for its implementation. But on dated 25.05.2012 & 21.05.2013 BSNL
Management issued order for the payment of all the allowances as
recommended by 6th CPC to the deputationist ITS Officers in
BSNL ignoring the losses of BSNL which gave clear cut message that
BSNL's losses is not the real criteria to deny the implementation of DPE
order but it is the willingness of the Management to whom they give or
to whom they deny. It created unrest and resentment among the BSNL
employees and the Forum of BSNL Unions / Associations served notice of
Indefinite strike w.e.f. 12th June 2012 and Mass Dharna on 6th
June,2013 which was very successfully implemented but later on the
indefinite strike call was deferred in view of the agreement signed
between BSNL Management and the representatives of BSNL
Unions/Associations on 12th June,2012.
BSNL Board approved the proposal for implementation of 78.2% IDA pay
fixation and sent to DoT in Sept'2012 for approval. DoT raised queries
twice which were immediately replied by BSNL. But, instead of giving
approval DoT referred the case to BRPSE for comments since BSNL is
making continues losses. BRPSE replied that it has no concern with
regard to pay and allowances paid by the PSU but it is concern only when
some revival plan is submitted. Delay seriously frustrated the BSNL
employees and finally the BSNL Unions/Associations served notice for
Indefinite strike w.e.f. 12th June 2013. In response to the
agitation Call given by Forum, the DoT administration and BSNL
Management started thinking for the settlement of issue and finally with
the intervention of Secy(T), DoT Hon'ble MOC&IT approved the proposal on
10th June,2013 and on the same day DoT issued the
Presidential Directive for implementation of DPE OM dated 2nd
April'2009 on 78.2% IDA pay fixation. On the basis of DoT Order, BSNL
Corporate Office also issued order for implementation of DPE ON dated 2nd
April,2013. In this manner, the consistent efforts of BSNL
Unions/Associations made Historical achievement for BSNL employees.
AIBSNLEA was always at the forefront during struggle.
Once again, we extended our sincere
thanks to all the members for their active participation in Mass DHARNA
& Demonstration and also readiness to make indefinite strike call a
complete success. We also extended sincere thanks to all the Senior
Officers in DoT and BSNL for their positiveness in implementing the DPE
order. |

DoT issued Presidential Directives for implementation of 78.2% IDA pay
fixation order. BSNL order will follows immediately. Forum of BSNL
Unions / Associations consistent efforts yielded result in getting
released the order. We are extremely thankful to all the struggling BSNL
employees for their active participation and involvement in making the
agitation call a great
success.
We also extend our sincere gratitude and thanks to Hon'ble
MOC&IT, Secy(T), Member(F), Addl. Secy(T), Jt. Secy(T), DDG(TPF) DoT, CMD, BSNL,
Director(HR), Director(F), Director(CM), Director(CFA) & other Board of
Directors and all the
concerned officers of DoT and BSNL, who played a positive role in
issuing 78.2% IDA

The Forum of

Strike w.e.f. 12th June'2013 after the issuance of order from BSNL
Corporate Office for implementation.

devotion so that we may demand further arrears payment in the days
to come as per the agreement.

10.06.2013: Forum
of BSNL Unions/Associations meeting with CMD, BSNL:
The representatives of BSNL Unions/Associations met CMD, BSNL and
extended sincere thanks for his efforts in getting approved 78.2% IDA
Pay fixation case from DoT. CMD, BSNL mentioned that on Friday itself he
along with Chairman TC, Addl. Secy(T) & Member(Fin) met Hon'ble MOC&IT
and discussed the issue. Hon'ble MOC&IT agreed with our pleading for
implementation of 78.2% IDA pay fixation. Even after that some
resistance was there in DoT Administration but Secy(T) overruled and
directed to process the case for approval to issue Presidential
Directive. However, he mentioned that BSNL employees are 'my strength'.
He also appealed for the growth of BSNL & its revenue. |
10.06.2013:
GS, AGS(Fin) , Convener Forum Com. V.A.N. Namboodiri, GS, President
SNEA(I) met DDG(TPF) Shri Shahbaz Ali for early clearance of the
DFA for 78.2% IDA pay fixation order and also requested for issuance
revised pension order for BSNL pensioners. DDG(TPF) assured that
Presidential Directives on 78.2% IDA Pay fixation case will be issued
shortly to ensure that indefinite Strike in BSNL don't take place. Also,
mentioned that revised pension order for BSNL Pensioners on the basis of
78.2% IDA pay fixation will be also be issued by DoT shortly wherein
pensioners are to get their arrears.
It is understood that 78.2%
IDA pay fixation order from DoT & BSNL will be issued today or tomorrow
positively. |
10.06.2013:
GS,
AGS(Fin.) met Sh. Sanjeev Gupta, Director(PSU), DoT and discussed
regarding implementation of 78.2% IDA Pay fixation order. Director(PSU)
mentioned that, it is understood that Hon'ble MOSC&IT has approved the
proposal and on receiving the approval through Secy(T)/AST/JST, he will
sent the DFA to DDG(TPF) for clearance. Hence, we may expect
Presidential directives order today or tomorrow, if every thing goes
smoothly.
He also appraised that Group
of Ministers
(GoM)
Meeting is now fixed up on
12.06.2013 at 15.30 Hrs instead of 11.06.2013. |
10.06.2013:
Implementation of 78.2% IDA Pay Fixation Case:
GS contacted concern officers in DoT on implementation of 78.2% IDA pay
fixation of DPE OM dated 2nd April,2009 as approved by BSNL Board. It is
understood that Hon'ble MOC&IT has approved the proposal for
implementation today morning and sincere efforts are being made in DoT
for issuance of Presidential Directives immediately. The orders are
expected today itself from DoT & BSNL. Further developments in this
regard will be intimated soon. |
07.06.2013:Dear Comrades, At 18-45 hrs. today, it was informed by the CMD,BSNL that
the DoT has taken decision to approve 78.2% IDA merger and that the
order will be issued today or on Monday, by the DoT. As far as
Forum CHQ is concerned, nothing is confirmed, unless order is issued by
the DoT. Hence, let us wait for the order to be issued and till then
there should not be any let up in the preparations for the strike.

07.06.2013:
A
meeting of the Forum took place yesterday, the 06-06-2013. Com. Islam
Ahmed presided over it. A thorough discussion took place, in which
all the developments, including the discussion with the Secy(T), DoT and
the 5th June Dharna, were reviewed. GS and AGS(Fin.) attended the
meeting.
Finally,
the meeting unanimously decided to intensify the preparations for the
indefinite strike. The following decisions were taken in this regard.
1) Press meets are to be conducted at circle and district
levels on 10.06.2013.
2) With a view to mobilise the employees, massive Lunch
Hour Demonstrations are to conducted on 11.06.2013.
3) To meet the Secretary, BRPSE tomorrow the 07.06.2013
and to discuss the issue.
In view
of the above developments and decisions, CHQ calls upon all the
Circle, District and Branch Unions to fully gear up the mobilisation for
the strike and to make it a resounding success. |

CGO Complex, New Delhi and requested to reply the queries of DoT on
78.2% IDA pay fixation case of BSNL employees. Director(BRPSE) mentioned
that BRPSE is not concern with the pay fixation or allowances of BSNL
employees, it is only concern, when the revival proposal is sent to
BRPSE. Moreover, BSNL is not a sick industry. However, he told that
Secretary, BRPSE is on foreign tour and will return on 17th
June 2013 thereafter only the comment to DoT may be sent after her
approval. It has already been informed to Director(PSU), DoT.

incorrect and partial
implementation of DPE orders for BSNL Employees during Revision of
wages and payment of IDA w.e.f. 1/1/2007 onwards : BSNL Employees
were accorded 68.8% IDA merger w.e.f. 1/1/2007 vide DPE order dated
26/11/2008 amounting to net loss of 9.4% in pay fixation as on 1/1/2007
vide subsequent DPE order dated 2/4/2009 followed by recurring loss
of IDA calculated by DPE on the basis of 78.2% IDA Merger w.e.f.
1/1/2007.

Forum
of BSNL Unions & Associations meeting with Chairman TC & Secy(T):
The representatives of
Forum of BSNL Unions/Associations met Chairman TC & Secy(T), DoT and
submitted memorandum copy regarding measures to be taken for revival
and revitalization of BSNL and MTNL, the strategic Telecom PSUs, to
protect the interest of the Telecom Industry as well as that of the
public .
Secy(T) appreciated our concern and referring to our discussions held on
04.06.2013, he
further told that since GoM are meeting on 11.6.2013 to discuss this
issue, the strike call given is not proper. We mentioned that 78.2%
IDA pay fixation case recommend by BSNL Board on the basis of an
agreement signed on 12.06.2012 between Forum of BSNL Unions/Associations with BSNL
Management is pending in
DoT for the last 10 months and now referred to BRPSE for comments whereas,
the BRPSE Officers has clarified that since
BSNL is not a sick PSU, BRPSE need not to give any comment & it is the
concern PSU and administrative Ministry to decide such pay/allowance
related issues. We also requested even if the comments are necessarily
required he may use his good office to get the early comments from BRPSE
for early settlement of the issue to avoid unrest in BSNL. Chairman TC &
Secy(T) further mentioned that he
don't want to go for further discussions on this issue since the BSNL
Management has signed the agreement and he assured that he will try to
resolve the issue at the earliest and advised us to speak him tomorrow
evening on this issue.
However, we have to continue to prepare for
successful implementation of the indefinite strike call w.e.f. 12th
June' 2013 till the time issue is resolved favorably. GS, AGS(Fin)
attended the meeting. |

GS
discussed with Sr. GM(Pers.) regarding
(a) Holding
of CPC from SDE to DE promotion to fill up 1860 DEs posts
since the court case in Hon'ble CAT Chennai is disposed off. Sr. GM(Pers.)
mentioned that CPC process has been initiated to DE Promotion but the
approval of the Competent Authority is to be taken to operate SDEs
seniority list no. 6 & 7. We pleaded that seniority
list no. 6
has already operated in the year 2010, while promoting 2700 DEs.
However, he assured an early action in this regard.
(b) CPC to
fill up DGM vacant posts:
We requested
to file petition in Hon'ble High Court Kerala in 147 SDEs (LDCE quota)
seniority case for early pronouncement of the judgment since it is
reserved for more than four months period. Sr. GM(Pers.) mentioned that
BSNL's advocate in Kerala has been requested to file petition in this
matter. |

Unions/Associations will be held at 15.00 Hrs tomorrow (i.e. 06.06.2013)
to decide the strategies for successful implementation of Indefinite
Strike w.e.f. 12.06.2013. |

successfully implemented throughout the country with great enthusiasm
and active participation of all BSNL employees. It has given a
message for great success of proposed Indefinite Strike w.e.f. 12th
June, 2013.

Office Bearers, Circle / Branch Secretaries are requested to ensure
successful implementation of Indefinite Strike Call w.e.f. 12th
June,2013 throughout the country.
